Observation: An employee worked at the agency for years, quit, moved out of state, and then returned almost immediately to at first be a substitute and later be employed full time again. When the employee said she wanted to be full time, the agency appropriately sent her back to be fingerprinted again. However, the agency did not wait for her background clearance letter to arrive; they let her continue to work without it. Even though this was an unusual circumstance and the agency knows this person well, the agency should not have allowed the employee to continue to work until the new background clearance letter arrived stating she was OK to work with children. 1240-04-01-.07 Criminal Background Check and State Registry/Records Review Procedures Corrective Action: The employee was immediately told that she could not work until she was cleared through the fingerprinting process. The agency then followed through with submitting the necessary paperwork to get the situation remedied and get a conditional clearance letter. It was not until that letter arrived that they allowed the employee to return to work. Program Evaluator provided technical assistance to speed up the process and provided phone contacts for the agency. The director states she knows that no one is allowed to work until cleared to work with children, and this unusual circumstance caused her to make the error, which she says will never be repeated. The agency understands that this is a major violation.

Observation: There was a mealtime supervision lapse during the 8-1-18 assessment when educators were doing non-food service related tasks instead of fully focusing on children while they ate lunch. Due to the possibility of choking, children need to be closely supervised while they eat in a child care agency. 1240-04-01-.11 SUPERVISION Corrective Action: The assessor that observed the violation and the agency Program Evaluator both gave technical assistance to correct the violation and prevent this from happening again. A Plan of Corrective Action was developed. The agency was put on notice that they cannot continue to be in violation regarding supervision without facing further consequences. A caregiver used a Mr. Clean Magic Eraser on the child's face causing a chemical burn or abrasion. No chemicals can be used on a child's skin and, in fact, anything put on a child's skin is to be by parental written permission only. While this was not done with the intention of hurting the child, the caregiver showed poor judgement and was immediately sent home. She has since been terminated from employment due to her actions. 1240-04-03-.07 STAFF Corrective Action: The caregiver was terminated from the program. The rest of the caregivers received more training on parental authorizations required for anything put on a child's skin, best practice, and licensing rules in general.
