On the day in question there were eighteen children present in the agency. The agency exceeded it's licensed capacity. 1240-04-01-.12 Physical Facilities Corrective plan: Agency will maintain adult: child ratios at all times and licensed capacity. Agency agreed that she would comply with the three days a week the agency can have ten percent, one child more, allowing sixteen children when school age children are in attendance, or thirteen children when preschool age children only are in attendance.

Observation Violation: During onsite unannounced visit, PE observed that the Adult: child ratios were not maintained. PE observed fourteen children with two educators. Seven of the children were under the age of two years of age therefore, a third educator was required. 1240-04-01-.21 Plan of Correction: PE reviewed rules with the Primary Educator. The agency will make sure there are always enough educators present and have a third educator when ages require a third educator.
