1. Department of Health Vulnerable Persons Abuse Registry check; 2. TBI/FBI Fingerprint and Background check; 3. TBI/FBI Sex Offender Registry; and (b) This evidence shall be obtained by the program prior to employment. (c) The program shall immediately review the report of the background check received from the Tennessee Bureau of Investigation, and shall immediately consult with the Department to resolve any questions relative to the person’s status. Upon determination that the person’s status prohibits the person from having access to children as described in this Chapter, the program shall immediately exclude such person from access to children. Failure to exclude the person under this part will result in immediate suspension of the program’s certificate of approval. (d) A new fingerprint sample must be obtained, for all employees, every five (5) years. Assistant did not have a TBI Fingerprint sample on file. A letter will not work. She stated she didn’t remember being fingerprinted at the Sherriff’s Department. She needs to have a fingerprint sample immediately. Staff need to be printed and results received prior to hire!

0520-12-01-.06 PROGRAM OPERATION.(1) Each program shall maintain a system that enables all children in the program’s care to receive a level of supervision that is appropriate to their age and their development, physical and mental status so as to ensure their health and safety and that allows program personnel to know the whereabouts of each child. (i) Staff shall position themselves strategically for adequate supervision and quick response. Assistant Ms. Christa was walking inside of the classroom leaving students alone outside. I advised her she cannot even step into the classroom if she is the only one outside. (14) All child care programs shall require any person employed in a position requiring proximity to children
