The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

In one of the closing rooms, Staff Person #1 and #2 had a total of 12 preschoolers. Neither staff were able to identify which specific children were assigned to them in Primary Care Groups.

3270.51 · When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30. The required staff:child ratios must be maintained at all times.

On the morning of 2/18/25, a parent dropped off her 2 young school aged children. Staff Persons #1 and #2 were supervising the group of 26 school aged children (mostly young school agers). Staff Person #1 at that time, had 14 children in her care group and Staff Person #2 had 12 children in her care group. The parent stayed there with her children until Staff Person # 3 arrived at 7:45am. The school age room was out of ratio by 2 children, from 7:34 - 7:45am.

On 7/17/24, Staff Person #1 aggressively tossed Child #1 down on his rest mat so that he would stay on his mat. Child #1 reportedly does not fall asleep for nap. Non-nappers are taken to an "awake" room at 2:00pm, however Child #1 and other non-sleepers are expected to stay on their mats, with nothing to do, from 12:45 - 2:00.

The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs.

Staff person #1 said that when she was changing Child #1 after Splash Day (on the child's towel on the floor), she admittedly crossed her legs over the child to keep the child from squirming as she changed her out of her swimsuit. Staff Person #2 sometimes tucks blankets/sleeping bags around 1-year olds (on rest mats on the floor), so that the child is unable to squiggle out and get up at rest time.
