3270.32(a)/3270.192(4) · The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Revise and submit written policies and procedures regarding the CPSL hiring requirements to ensure that all facility persons (new and existing) have the required CPSL clearance documents within the required timeframes in accordance with the CPSL.

The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in § 3270.124(f) (relating to emergency contact information). Complete and submit a current up-to-date child service report for the indicated children. Ensure that child service reports are completed for all children as specified in this regulation.

3270.113(e) · A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs. The chair straps cannot be used to restrict or confine a child's movement. Cease using the chair straps to restrict the child's movement. Develop and submit written policies regarding the proper use of toddler chairs. Notify all facility staff persons of this policy. Submit verification of the notification.

On 4/9/25, children in the young toddler classroom were observed strapped in chairs restricting their movement. The restraints were not prescribed as adaptive equipment for children with special needs.

3270.20(a)(1) · The operator shall immediately notify a child's parent and shall telephone notice to the appropriate regional office within 24 hours if a child in care at the facility is hospitalized or receives emergency room treatment. Complete and submit the incident report. Ensure that incident reporting is completed as specified.

On 11/3/23, a child received emergency room treatment subsequent to sustaining an injury at the facility and the operator failed to notify the regional office within 24 hours of the emergency room treatment and mail a written report within 72 hours after the occurrence.

3270.95(a)/3270.95(b) · Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met. Ensure that the director or designee knows how to activate the fire detection system for testing. Ensure that the fire detection system is tested every 30 days, documented in writing and retained with the fire drill log.

On 12/12/23, the facility's fire detection system was accessible and not able to be tested.

During renewal inspection, cert rep observed chipped paint in the preschool classroom on the lower level behind the sand table.
