Staff #1- may not work in a child care position at the facility until clearance is obtained. TIERED LIS: 1. The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. This portion shall have an immediate correction date. 2. The legal entity must create a written policy that will define how they will keep track of all clearances, trainings, and necessary documentation pertaining to the CPSL. The legal entity will need to review this policy regularly to ensure compliance. This policy must be approved by DHS before implementation. The operator shall provide a date for when this policy will be created.
During renewal inspection staff files were reviewed. Staff #1 lived outside the state of Pennsylvania within the past 5 years. Staff #1 did not have the required child abuse clearance from the state of Indiana on file at the time of inspection.

3270.111(c) · Daily activities shall promote the development of skills, social competence and self-esteem. Daily experiences shall recognize the child as an individual and give some choice of activities that respect personal privacy, lifestyle and cultural background.
During a complaint investigation staff admitted that a child was put in time out for roughly two hours due to an incident with another peer. This caused the child to not be able to partake in developmental activities, and did not aid the social competence and self-esteem of the child.

Staff #1 did not request for the NSOR clearance before working with children. The clearance was not obtained until 1/17/24. Staff #2 requested for the NSOR clearance on time, however, did not receive it until past the 45-day due date and was still working with children. Staff #3 did not request for NSOR prior to working with children. Clearance was not obtained until 3/25/2024. Staff #4 did not apply for the State police clearance prior to working with children. It was not obtained until 12/21/23. Staff #5 did not apply for an updated FBI Clearance within the 5-year requirement and was still working with children. Last FBI clearance was dated for 10/13/2018 and update was received on 4/30/2024. (See code sheet for date of hire/first day working with children).

The legal entity must receive DHS approval of the training content prior to scheduling the training. This training must be conducted by a live PQAS approved trainer and when no children are present in care. Further, this training will not be allowed to count towards the annual twelve hours of training required by regulation.
The facility self- reported that child #1 absconded from the facility on 8/15/22 and was gone for roughly 90 minutes. Staff initially pursued child but lost sight of child.
