On 6/14/2024, Staff #1 was observed on video from 6/8/2024 at 12:40 PM grabbing Child #1 by the arm quickly and placed the child on the floor between her legs. Staff #1 sat on a chair and made Child #1 sit on the floor. Staff #1 would not allow for Child #1 to get up for approximately 2 minutes. Staff #1 used her arms and legs to keep Child #1 sitting on the floor. It was also observed on video from 6/8/2024 at 1:27 PM, that Child #1 was trying to throw a stuffed animal at the other children in the room. Staff #2 grabbed the stuffed toy out of Child #1's hands. Child #1 walked over to the children and sat on the tabletop arms crossed and head down Staff #2 walked over to Child #1 and grabbed his upper left arm and pulled him off the table. Child #1 was pulling away and was trying to get back on to the tabletop. Staff #2 pushed Child #1 with his arm a few times and then had the child grabbed by his upper right arm holding him with one hand while pushing the table away with the other. Then Staff #2 had Child #1 by his left arm, using her right arm to grab his upper arm and her left arm to grab his forearm and pulled him away. As she did that the child dropped to the ground on his knees. Child #1 then pulled a chair over and began punching the chair. Staff #2 came from behind Child #1 and grabbed both of his upper arms to pull him up. Child #1 got up but pushed back against Staff #2. Staff #2, still holding the arms, pushed the child forward slightly and then let go.

The policy must also address that the facility will not allow the use of physical discipline under .113(b) and include procedures for staff discipline in the event that a staff is found to use physical discipline. Both the updated supervision policies and new supervision procedures must be submitted to the Northeast Regional Office for approval prior to implementation. Once approved by the Department, the director will ensure that all current employees and any new hires are trained on the policies and procedures, and it must be documented in their files.

On 5/18/2023, Staff #1, Staff #2 and Staff #3 all had current clearances on file. However, the clearances were not updated within 60 months as required by the CPSL. Staff #1 completed the state police clearance on 9/15/2022, the child abuse clearance on 11/10/2022 and the FBI clearance on 11/12/2022. The previous clearances on file for Staff #1 were dated as follows: 6/14/2017 for the state police and child abuse clearances and 6/15/2017 for the FBI clearance. Staff #2 completed the state police clearance on 4/17/2023 and the child abuse clearance on 5/2/2023.
