This portion of the plan will have a date that is 10 weeks after the submission of the first two-week schedule. TIER 5: The legal entity will develop a staff and parent policy for ensuring parents do not leave the premises until the second facility person is on the clock at the facility. The policy will be submitted to the Department for review. The legal entity will have each current staff person sign an acknowledgement of receipt of the policy. The legal entity will have each parent of a currently enrolled child sign an acknowledgement of receipt of the policy. This policy will be added to the staff and parent handbook. The legal entity will submit all signed acknowledgments, the updated staff handbook and the updated parent handbook to the Department. This portion of the plan will have a date that is within 5 days of all staff and parents signing their acknowledgment of the new policy.

2nd CITATION: The CR arrived at the facility on 2.25.26 at 6:32 AM and observed Staff person #1 enter the building and turn on the lights at 6:55 AM. The 1st child was seen entering the facility at 7:45 AM, with the parent leaving at 7:48 AM. The 2nd child was taken into the facility at 7:49 AM and the parent left at 7:51. The 3rd child and the 4th child were taken into the facility at 7:55 AM with the parent of the 3rd child leaving at 7:58 AM and the parent of the 4th child leaving at 7:57 AM. The 2nd staff person entered the building at 7:58 AM, meaning that Staff person #1 was alone with more than 1 child from 7:51 AM until 7:58 AM. The CR observed 5 more children enter the facility between 8:03 AM-8:22 AM. At 8:35 AM Staff person #3 was seen exiting a vehicle that had been in the parking lot since 7:51 AM and entering the building with the 10th child. At 8:40 AM the 11th child entered the facility. 3270.113(a) · Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.
When the CR entered the facility at 8:45 AM, supervision and ratio were assessed. The CR counted 10 children in the main classroom despite observing 11 children enter the building. The 11th child, a preschool child, was then observed sleeping alone on the other side of an L-shaped, solid, vinyl fence. The L-shaped, solid, vinyl fence was approximately 4 feet tall. The preschool child was sleeping between the two sides of the L-shaped, solid, vinyl fence. All three staff in their current locations could not see through the L-shaped, solid, vinyl fence in order to supervise the sleeping preschool child. No staff member was able to see, direct, or assess the sleeping preschool aged child.
