A facility person may not single out the child for ridicule, threaten harm to the child or the child's family and may not specifically aim to degrade the child or the child's family.

    A review of the classroom video footage (snack and play) from 2/2/23 revealed that Child #3 threw their snack carrots on the floor. Staff person #1 removes child #3 from their chair at the table and begins yelling, "pick up the carrots". Staff person #1 then sits in the child's chair eating a bag of carrots while continuing to tell him to pick up the carrots. Staff person #2 carries over a large foot pedal trash can for the child to throw the carrots into. Child #3 is forced to pick up carrots for approximately 6 minutes. A review of the classroom video footage (snack and play) from 2/2/23 revealed that staff person #1 comes up behind child #3 and yells at a high volume directly into his ear, "No food - go to carpet". (This action startled Child #3 causing the child flinch) Staff person #1 then takes a plastic dustpan and places it against the arm and shoulder of child #3 to move him away from the table because child #3 is eating the snack that belonged to another child. Staff person #1 then takes child #3 by one arm and pulls him from the table to the carpet area where child #3 falls to the floor. A review of the classroom video footage (snack and play) from 2/2/23 revealed that Staff person #1 asked child #3 to put on his jacket as the class was lining up to go outside. When child #3 responded "no" to putting on the jacket staff person #1 told the child they "would stay inside by yourself" Staff person #1 stated to the entire class, "we will go outside and look for kitty cats and then stated, " Child #3 wont, he will be staying inside by himself". Staff person #1 then took Child #3 by one arm and sat the child down against the wall and stated, " No you don't want to go, I'm not fighting with you, see you later". A review of the playground video footage from 2/2/23 reveals that staff person #1 picks up child #3 by one arm and removes from the toy box area across the yard onto the rubber surface. This action of grabbing the child by one arm caused the child's feet to lift from the ground. A review of the classroom play video footage reveals that during circle time Staff person #2 is trying to get Child #3 to sit at circle time. staff person #1 reaches across the floor and pulls child #3 by the ankles across the rug. Child #1 is laying on his back and side when he pulled by the ankles.
