Staff Person #4, who has lived in New York in the past five years, did not have a NY Sex Offender Registry check or the NY Child Abuse Clearance on file at the facility or applications for the clearances at the time of inspection.

The Child Protective Services Law (CPSL) was revised to include the requirement for the National Sex Offender Registry (NSOR) verification certificate effective 9/30/2019, requiring anyone hired after 9/30/19 to have the NSOR verification certificate to work in child care. The CPSL revision also includes the removal of the provisional hire period as of 12/31/2019. Effective December 31, 2019, the 90-day provisional hire period was obsolete and has been replaced by a 45-day provisional hire period. The new 45-day provisional hire period is only permitted once the certified child care facility applies for a provisional hire waiver and it is granted by OCDEL. LACKING REQUIRED HIRING DOCUMENTS: Staff Person #1 may not work in a child care position at the facility until the Child Abuse clearance and NSOR verification certificate are on file at the facility.
A renewal inspection was conducted on 7/9/2021. At that time, the file for Staff Person #1 was reviewed. Staff Person #1 had FBI and State Police Clearances on file at the facility. Staff Person #1 had applied for the NSOR verification certificate on 6/3/21 and the child abuse clearance on 6/14/21. Staff Person #1 had not yet received these and they were not on file at the facility. The facility did not have a provisional hire waiver allowing Staff Person #1 to work supervised until she received the child abuse clearance and NSOR verification certificate.
