  3280.113(a) · Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. TIERED LIS: 1) Children must be supervised at all times. 2) The legal entity must arrange for all facility staff to receive a minimum of two hours of in-person training regarding supervision of children. The legal entity must receive DHS approval of the training content prior to scheduling the training. 3) A written policy must be implemented and provided to DHS regarding the supervision of minor household children and children enrolled in the child care facility. This policy must include the whereabouts of minor household children during child care hours.

  Child #1 was inappropriately touched by a minor household member during nap time. Staff person #1 was responsible for the supervision of the Child #1 when this incident occurred. (It should be noted that the minor household member no longer resides at this facility.)
