    3280.113(a)/3280.113(a)(1) · Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. TIERED LIS: Children must be supervised at all times. The legal entity must arrange for all facility staff to receive a minimum of two hours of training regarding supervision of children. The legal entity must receive DHS approval of the training content prior to scheduling the training. The legal entity must submit documentation in a format approved by DHS proving that the facility procedure for counting children is followed at all times e.g., a checklist. The legal entity will confirm continuing compliance by sending copies of the documentation to the Regional Office of Child Development and Early Learning on a weekly basis for a period of three months after DHS approves the documentation format. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in their assigned group. The staff person shall be physically present with the children in their group on the facility premises and on facility excursions off the facility premises.

    On 8/26/25 a certification representative conducted a complaint investigation. During the investigation, staff #1 and #2 reported that on 8/18/25 a child eloped from the school yard, while off school premises. The child had been away from facility staff for about 5-10 minutes before being located by staff #1 a few blocks away from the school yard. Staff #1 reported becoming aware of the missing child within seconds of them leaving the school yard.

    During the on-site renewal inspection the following conditions were observed: The basement area was under construction; an incomplete HVAC install was suspended resulting in the ceiling, walls, and floors in disrepair. Rest equipment, toys, play equipment, furniture and supplies were all exposed to the sheet-rock dust/ dirt debris. An uncovered child accessible sump pump was in the space. The basement conditions on date of inspection contained visible hazards and was not conducive for childcare space. The stair rail to the facility's entrance contained rust and damaged peeling paint. The bathroom walls, floors and sink were dirty and in disrepair; the mounted sink was surrounded by a large hole in the wall. The damaged wooden fencing in the outdoor play yard was collapsed, exposing nails and sharp edges. Two small wading pools were filled with water, play equipment and toys were in disrepair. The outdoor shed in the play yard contained peeling paint. On date of inspection, the Indoor and outdoor conditions of the facility pose a potential health and safety threat to children when in care.
