The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs.
At the time of the inspection on 3/18/25, observed the video footage shot at nap time on 3/12/25, child #1 lying on their mat and staff person #2 sitting on the bean bag next to the child. Per staff #2, in order to comfort the child, staff person #2 put their legs across the child torso area appearing to prevent the child from getting up for approximately 15 minutes.

A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Staff Person # 1 must be removed from child care position by close of business. DHS required FBI clearance must be obtained before staff person #1 may resume a child care position.
At the time of renewal inspection, file of staff person #1 did not contain DHS required FBI clearance. File of staff person #1 included FBI from Department of Education, which is not acceptable.

3270.131(d)(5)/3270.131(e)(3) · A health report shall include a review of the child's immunized status according to recommendations of the ACIP. The facility shall implement dismissal policies in accordance with the Department of Health regulation in 28 Pa. Code § 27.77 (relating to immunization requirements for children in child care group settings). Children #1, #2, #3, #4, and #5 must be dismissed from care by close of business 9/11/23 and may only return to care when the immunization record is updated or when a parent provides a written, signed exemption letter.
At the time of the complaint investigation, health record of child #1, #2, #3 and #4 did not include influenza immunization recommended by ACIP, record of child #5 did not include 4th dose of DTAP. Letters of exemption were not on file.
