A child was observed asking to go to the bathroom, being given permission, and walking out of the cafeteria unsupervised. Staff Person #2 was reminded that children should be supervised when going to the bathroom, Staff Person #2 said that the bathroom is just down the hall and that staff do not accompany the children until the teachers leave the school building at 3:30. Later during the inspection, a child was observed asking to get a drink from the water fountain, being given permission, and then walking out of the cafeteria unaccompanied by a staff person. Staff Person #2 was reminded that children must be accompanied when leaving the cafeteria. Staff Person #2 then got up and walked to where the child was able to be seen while getting a drink from the water fountain.

3270.32(a)/3270.192(4) · The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. The Child Protective Services Law (CPSL) was revised to include the requirement for the National Sex Offender Registry (NSOR) verification certificate effective 9/30/2019, requiring anyone hired after 9/30/19 to have the NSOR verification certificate to work in child care. The CPSL revision also includes the removal of the provisional hire period as of 12/31/2019. Effective December 31, 2019, the 90-day provisional hire period was obsolete and has been replaced by a 45-day provisional hire period. The new 45-day provisional hire period is only permitted once the certified child care facility applies for a provisional hire waiver and it is granted by OCDEL. All clearances are required to be kept on file and updated every 60 months.
Paperwork was reviewed for the renewal inspection. At that time, the file for the director, Facility Person #1, date of hire 9/6/16, was reviewed. The file contained a volunteer PA Child Abuse Clearance dated 9/28/20. A PA Child Abuse Clearance for employment is required. The file contained an FBI Clearance dated 9/7/21. The FBI Clearance was not completed through DHS. The FBI Clearance is required to be completed through DHS. The file contained an application for an NSOR certificated dated 9/9/21, but not the completed NSOR certificate. The file did not contain PA State Police Clearance, PA Child Abuse Clearance, or a DHS FBI Clearance completed prior to the current clearances that would have been required for Facility Person #1 to begin work on 9/6/16. A file for Facility Person #2, date of hire 4/28/16, was reviewed. Facility Person #1 stated that Facility Person #2 does not have an NSOR certificate and has just applied for the clearance. The file contained a DHS FBI Clearance dated 4/19/16. The FBI Clearance was required to be updated by 4/19/21. The file did not contain PA State Police Clearance or PA Child Abuse Clearance completed prior to the current clearances that would have been required for Facility Person #2 to begin work on 4/28/16.
