Both were placed back at the table with built-in seating and fell asleep again. On 06/28/2024, during an inspection visit, Certification Representative and Staff Person #1 had a conversation relating to the previous inspection visit, which was on 05/30/2024. During the conversation, staff person #1 made a statement that they, "listened to the recording to make sure they had everything done". Certification Representative questioned what they meant, and staff person #1 stated they recorded the last visit using a phone in their pocket. Audio recording an individual without their consent is in direct violation of Pennsylvania's Wiretap Act, codified at 18 Pa. Cons. Stat. § 5703. Throughout the conversation, Certification Representative reiterated several times that a person cannot record without consent of all parties. Staff person #1 stated that it wasn't a video recording and consent was not needed. At the end of the conversation, staff person #1 stated, "well I'm recording today too". Certification Representative did not give consent for either recording.
