    3270.113(a) · Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. TIERED LIS: 1. Children must be supervised at all times. 2. The provider will review the following policies with all staff: cell phone policy, supervision policy to include playground supervision and name-to-face checks over thresholds. Documentation of this review will be provided to DHS. 3. The provider will ensure staff participate in in-person training and coaching on the topic of supervision and creating positive learning environments, to be provided by the ELRC. Documentation of participation will be provided to DHS. 4. The provider must submit documentation in a format approved by DHS proving that the facility procedure for supervision is followed at all times. Members of leadership should document random checks of playground supervision and classroom supervision for each classroom at least 2 times a week. Random checks can be conducted in person or through the cameras to ensure authenticity. The provider will confirm continuing compliance by sending copies of the documentation to the Regional Office of Child Development and Early Learning on a weekly basis for a period of three months after DHS approves the documentation format.

    Photographic evidence was shared showing teachers gathered together eating fast food meals on the playground. Photos showed teachers sitting on the ground filling out paperwork. Another teacher was sitting under the equipment looking at a personal cell phone. Another image showed a teacher sitting in a classroom looking at a cell phone. During an observation of teachers on the playground, teachers were observed looking at cell phones, chasing one another around the playground, and gathered together having conversations while children engaged in water play. It was reported and confirmed by the owner, that a child had been left unsupervised on the playground for approximately one and a half minutes. The owner reported that as the staff transitioned into the building from the playground, a child exhibiting behavior problems needed the assistance of a teacher to transition to the classroom. A face to name check was completed but the child hid from the group as they proceeded inside.
