Observed staff in the toddler classroom change a diaper and leaned away from the changing table and used their hand to open the trash can lid in lieu of the foot petal due to the can being in the corner of the room and not accessible from the changing table. Staff then moved the can closer to the changing table and changed another diaper. Staff placed the soiled diaper on a plastic bin next to clean diapers while finishing the diaper change. When directed by the Certification Representative that the diaper should be thrown away immediately, the staff person removed the diaper from the bin and placed it on the changing table above the child's head. The diaper was not discarded immediately by placing the diaper into a plastic-lined, hands-free covered can.

The operator will develop a drop off procedure which includes a process for checking diaper bags and other bags brought into the facility and a log to document the checks for each classroom. The procedure and logs are to be approved by the Central Region Office of Child Development and Early Learning prior to use. Completed logs will be maintained on file by the facility director and be made available to the Department Representative when requested. This will be done for a period of 3 months from the date this Plan of Correction is accepted by the Central Regional Office of Child Development and Early Learning.
Staff person #1 found a firearm in child #1's diaper bag. The owner, director and/or the assistant director did not immediately call law enforcement to come and assess the situation and take possession of the firearm. The firearm was taken to the office by staff person #4 and #5 and left unsecured until it was returned to the parents shortly after the firearm was discovered.

3270.113(a)/3270.113(a)(1) · Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises. The legal entity must submit documentation in a format approved by DHS proving that the facility procedure for counting children is followed at all times e.g., a checklist. The legal entity will confirm continuing compliance by sending copies of the documentation to the Central Regional Office of Child Development and Early Learning no later than Monday morning by 9:00 am for the prior week for a period of three months.
Continued Non-Compliance: On 03/06/2025 an unannounced monitoring was conducted at the facility. Upon arrival, after ringing the doorbell and waiting for someone to answer the door, Certification Representative observed 2 children (older toddlers) come to the door. Both children were looking at the Certification Representative through the window of the door and 1 of the children grabbed a hold of the crash bar of the door and was hanging from the bar trying to open the door, while saying "someone is at the door". Certification Representative did not see a staff person with the children. Certification Representative rang the doorbell a second time and 2-3 additional children (older toddlers) also came to the door peering out the door to see who was there. Staff person #7 came and opened the door. Upon asking where the staff person was, she stated that she was at the corner. Later staff person #7 stated she was "right there" pointing to the preschool (4 & 5 year old classroom) door talking to another staff person. Staff person #7 was not physically present with their group to provide proper supervision (see, hear, direct, assess) while talking to the staff person in the doorway. The facility's acceptable plan of correction submitted on 03/24/2025 stated the legal entity will begin using the checklist to count children as soon as the form has been approved by the Regional Office. The legal entity shall do this checklist for a minimum of three months for the date the checklist is approved and will send it to the Regional Office weekly. On 06/02/2025, the operator has not been submitting the supervision and ratio checklists on a weekly basis as required in the directed plan of correction. The most recent checklists were received on 05/20/2025 for the week of May 12 - 16, 2025.

Upon arrival, after ringing the doorbell and waiting for someone to answer the door, Certification Representative observed 2 children (older toddlers) come to the door. Both children were looking at the Certification Representative through the window of the door and 1 of the children grabbed a hold of the crash bar of the door and was hanging from the bar trying to open the door, while saying "someone is at the door". Certification Representative did not see a staff person with the children. Certification Representative rang the doorbell a second time and 2-3 additional children (older toddlers) also came to the door peering out the door to see who was there. Staff person #7 came and opened the door. Upon asking where the staff person was, she stated that she was at the corner. Later staff person #7 stated she was "right there" pointing to the preschool (4 & 5 year old classroom) door talking to another staff person. Staff person #7 was not physically present with their group to provide proper supervision (see, hear, direct, assess) while talking to the staff person in the doorway.
