3270.113(a)/3270.113(a)(1) · Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Children must be supervised at all times. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises. The legal entity must arrange for all facility staff to receive a minimum of two hours of training regarding supervision of children. The legal entity must receive DHS approval of the training content prior to scheduling the training.
Staff person #1 and another staff person had the preschool children outside in the play area. One of the children refused to come out of the play area to go inside. Staff person #1 had the other children in the doorway lined up ready to go back to the classroom inside the daycare. The other staff person went back onto the play area to get the child refusing to come inside. Staff person #1 and the other staff person then brought the children back into the daycare, down the stairs and to the bathroom area to wash hands. Staff person #1 and the other staff person completed a count of the children when they arrived at the bathroom area and noticed one of the children (child #1) was missing and not with the group at the bathroom area. Staff person #1 immediately went back down the hallway and up the stairs to go outside to look for child #1. When staff person #1 reached the door to go back out, there was a man at the door knocking. The man told staff person #1 that there was a little boy in the backyard of the home directly down from the parking lot area of the daycare, and staff person #1 went and got child #1 and brought him back into the daycare. Child #1 was approximately 600 ft from the door of the daycare and was unsupervised by staff person #1 for approximately 2 minutes.
