A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person # 1 may not work in a childcare position at the facility. The Child Protective Services Law (CPSL) was revised to include the requirement for the National Sex Offender Registry (NSOR) Clearance effective 9/30/2019. The CPSL also states that anyone hired after 9/30/19 was required to have the NSOR clearance to work in childcare.

File for Staff # 1 was not in compliance with CPSL regulations. File for Staff # 1 did not contain the NSOR clearance.

During a complaint investigation conducted on 11/15/22 & 11/21/22, it was determined that Staff Person #1 was force feeding Child #1, a young toddler on 11/9/22. In a video of the incident, Staff Person #1 is observed force feeding Child #1 by holding the child's head back with one hand while forcing a spoon in the child's mouth with the other hand while the child is screaming. In the video, Staff Person #1, is also seen pulling Child #1 by one arm from her seat and trying to make the child forcibly sit by shaking the child and slamming the child onto the ground on her backside twice while the child resisted, cried and screamed.

Operator will develop a behavior management policy that clearly explains risk factors for challenging behaviors and use tools related to child development and learn strategies to manage children with challenging behaviors including appropriate discipline techniques. The policy will also discuss different behavior management techniques and discover the benefits of using positive redirection to teach children self-regulation and acceptable behavior. The operator shall send a copy to the Regional Office for approval. Once approved, the operator shall hold a staff meeting for all staff to go over the behavior management policy. Staff will sign a statement affirming that they have read and understand the policy.
