3280.32(a)/3280.192(4) · The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person # 1, # 2, # 3 and # 4 may not work in a childcare position at the facility. The CPSL was revised on 9/18/2018 to include a requirement that all clearances be updated and on file at least every 60 months.

Files for Staff # 1, # 2, # 3 and # 4 were not in compliance with CPSL regulations. File for Staff # 1 contained expired clearances. State police was dated 2/10/20, Child Abuse was dated 3/6/20, FBI was dated 2/23/20 and NSOR was dated 3/20/20. File for Staff # 1 contained a 2 hour Mandated Reporter Training. File for Staff # 2 did not contain a State Police clearance. File for Staff # 3 contained an NSOR clearance dated 3/2/20 and a 2 hour Mandated Reporter Training. File for Staff # 4 contained an NSOR clearance dated 3/2/20 and a 2 hour Mandated Reporter Training.

The emergency contact and fee agreement forms weren't updated every 6 months for the following children: Child #1, Child #2, Child #3, Child #4, & Child #5..They were completed in February 2023 and were not updated until January 2024.

The operator shall mail or deliver a written report to the appropriate regional office within 72 hours after hospitalization of a child in care, emergency room treatment of a child in care, death of a child in care, a facility fire requiring the services of a fire department.

During a complaint investigation started on 10-4-23, staff person #1 admitted that she did not notify the Regional Office within 24 hours of Child #1 receiving emergency room treatment on 9-21-2023. She also admitted that she didn't submit a written report to the Regional Office within 72 hours of same incident with Child #1 receiving emergency room treatment.

During a complaint investigation that was started on 10-4-23, it was determined that a dog at the facility bit Child #1, on 9-21-2023, in the back of the head, resulting in 14 stitches.
