3270.113(b)/3270.113(e) · A facility person may not use any form of physical punishment, including spanking a child. A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs. The Legal Entity / Director will establish a discipline policy. The policy will include the facility's use of acceptable methods of discipline as well as what discipline is prohibited at the facility. The discipline policy must be submitted to the Department prior to implementation for approval. Once approved by the Department, the director will ensure that all current employees and any new hires are trained on this policy.
Staff interviews indicated the following incidents occurred at the facility. On 8/21/23, Staff # 1 told Child # 1 that the child needed to lay down and if Child # 1 did not lay down Staff # 1 would hold the child down. Staff # 1 then forced Child # 1 to lay down by forcefully pulling his legs out from under him (he was laying on his stomach with his knees scrunched up under him), turning Child # 1 so Child # 1 was laying on his back, and then pushing Child # 1 down on his back and holding Child # 1 there with their forearm. Staff # 1 held Child # 1 in that position for approximately 30-45 seconds. On 8/22/23, Staff # 1 grabbed a child by the arm in an angry manner and drug the child to a center. Staff interviewed said the child was upset and staff heard the child say to Staff # 1; "you can NOT do that to a child." Staff # 1 then responded; "Well the child needs to listen."

Staff interviews indicated that on several occasions, Staff # 1 has used harsh and demeaning language towards children. Staff # 1 also received a write-up on 5/11/23, due to this staff not using appropriate tones and disrespectful language towards children. Staff interviews also indicated that, Staff # 1 would treat Child # 1 different than other children in the way Staff # 1 spoke to the child and the actions of Staff # 1 towards Child # 1.
