    3270.113(a)/3270.113(a)(1) · Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises. 1.Children must be supervised at all times (This portion of the plan shall have an immediate correction date). 2.The legal entity must arrange for all staff to complete the Better Kid Care Training titled, "Supervision: Teamwork." Documentation of completed training must be submitted to DHS and be kept on file at the facility. The Legal Entity shall provide a date for when this training will be completed.

    The facility self-reported the following: On 12/24/25, around 10AM, staff person #1 left the Infant room and didn't communicate that they were leaving the room to staff person #2. Staff person #2 did not know staff person #1 left the room. Staff person #2 thought staff person #1 was in the back of the room. Staff person #2 stepped out of the room to speak to another staff person. 3 Infant were left alone for approx.1 minute.

    On 7/30/25, the facility self-reported the following: On 7/29/25 at approx. 4:30 pm, staff member #1 transitioned 3 1-year olds from the Mighty Movers room to the Little Learners room to combine for the end of the day. As staff member #2 was closing the room for the night, child #1 was found hiding underneath the cubbies that were mounted on the wall. It was reported the class "Just came over" and child was alone for a minute. Staff member #1 did not conduct a name to face check upon leaving the room and entering the next room.

A facility person may not use any form of physical punishment, including spanking a child.

    Facility self-reported the following incident: On 4/5/24, at approximately 9:00 am, a parent heard staff #1 yell "absolutely not" and witnessed staff #1 snatch something out of the children's hands. The teacher wrapped one arm around child #1's chest and "slammed" the child into a chair. The teacher had child #2 under the arm, taking child #2 to another chair. When staff #1 saw the parent, the staff put child #2 down gently. The children were crying.

The last time the child's head was pushed down, the child bumped their head on the top of the cot and the child cried. Staff person #1 must do one of the following: provide documentation that the trainer has become PQAS-certified or at least is on the waiting list, request the instructor provide documentation, such as their Pediatric First-Aid/CPR Instructor Card from the PQAS-approved organization or the approved curriculum organization, that the instructor is approved to offer Pediatric First-Aid/CPR training on behalf of their organization, or receive pediatric first-aid/CPR training in an approved curriculum by a PQAS-certified trainer. Staff person #2 will have until 03/09/2023 to complete the required training. Until such time as the required training has been completed, staff person #2 must be supervised, when interacting with children, by an AGS who has completed the required training related to this citation. If there are no staff available to supervise staff person #2 staff person #2 may not work in a child-care position at the facility. Staff person #4 must receive pediatric first-aid/CPR training in an approved curriculum by a PQAS-certified trainer. Until such time as the correction is implemented, staff person #4 must be supervised, when interacting with children, by an AGS who has completed the required training related to this citation. If there are no staff available to supervise staff person #4, staff person #4 may not work in a child-care position at the facility.

    Staff person #1 has acceptable pediatric first aid/CPR training in an approved curriculum; however, the trainer has not provided documentation that they are PQAS-certified in that training topic. Staff person #2 has not completed the following required pre-service training within 90 days of their date of hire (see LIS code sheet): "Get Started with Center-based Care: Building Blocks for Quality". The file for staff person #2 included the 6-hour "Health and Safety Basics: Requirements for Certification" which was completed on 06/14/2019 and does not count toward the new Health and Safety Professional Development (PD) requirement. Staff person #3 did not complete the Get Started with Center-based Care: Building Blocks for Quality within 90 days of initial hire (see LIS code sheet); the training was completed on 08/06/2022. Staff person #4 has acceptable pediatric first aid/CPR training in an approved curriculum; however, the trainer has not provided documentation that they are PQAS-certified in that training topic.
