    3270.113(a)/3270.113(a)(1) · Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Children must be supervised at all times. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

    On the playground, Staff #1 turned away from child #1, for approximately 15 seconds to 1 minute to help another child. While staff #1's head was turned, child #1 ran to the gate of the playground. Child #1 exited the gate and went into the building. Staff #1 saw the child in the hallway and followed after child #1 as he entered a classroom. Staff #1 found child #1 in a classroom behind a shelf. Child #1 returned to the playground with staff #1. Child #1 was in the building, unsupervised for approx. 4 minutes.

Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

    An in-person fire safety training took place on 3/1/22, but the trainer was not a fire protection professional (An individual knowledgeable and competent in fire inspections, fire detection, fire suppression systems and practices, fire service training, emergency preparedness planning and emergency evacuation whose competence is demonstrated by membership in a professional organization which promotes firesafety education.) Staff persons 1-3, 5-6, 8-16, 18-24 attended this training as their annual fire safety training. These staff have been employed for more than 12 months. The facility's previous training was conducted more than a year ago, on 2/25/21.

A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

    Mandated reporter trainings on file for staff person 2 were dated 6/28/16 and subsequently 2/28/22. The updated training was not obtained within 60 months as required by the CPSL. The state police clearance and Child abuse clearance on file for staff person 4 were "volunteer clearances" and not for employment purposes. Mandated reporter trainings on file for staff person 5 were dated 8/16/2016 and subsequently 2/23/22. The updated training was not obtained within 60 months as required by the CPSL. The staff persons Pennsylvania state police clearance (8/17/16), the child clearance (8/13/16) and the DHS FBI clearance (9/30/16) all expired during the previous year and they were not updated prior to expiration. The updates were obtained as follows: PA State police dated 2/28/22, Child Abuse clearance dated 10/15/21, and DHS FBI clearance dated 10/20/21.

An area of the surfacing on the infant/young toddler playground was peeling up and was able to easily be broken off, creating a choking hazard (less than 1 inch in diameter). Pieces of the surfacing on the toddler playground were separating from the surfacing allowing for mulch like pieces to accumulate on the playground (less than 1 inch in diameter).
