    3270.104(a) · Furniture must be durable, safe, easily cleaned and appropriate for the child's size, age and special needs.

    According to staff statements and documentation, on 2-14-25 in Phillips Hall during breakfast, an older toddler fell off an adult-sized chair used for school-age children and was injured by hitting their face on the floor between two chairs causing the child's nose to bleed and swell. The chairs and tables being used for approximately 20-23 young and older toddlers to eat breakfast were not age appropriate. Many young and older toddlers were unable to reach the table while sitting on their chairs and had to sit on their knees to reach the table to eat.

    3270.113(b) · A facility person may not use any form of physical punishment, including spanking a child.

    Video and audio was captured on 8/12/21 from 2:07 to 2:30 PM from inside a school bus while staff were sorting children onto two buses to return to the facility from a field trip. Interviews were also conducted with facility staff that revealed that children were sitting on the bus for approximately 50 minutes while a plan was developed and executed to handle a crisis. Facility Person #1 was observed standing in the bus aisle, talking to a seated young school age child, when they turned towards Child #1, who was also seated, looked at the child, and pushed their elbow into that young school age child's face. Facility Persons #1 and #2 had directed Child #2 to move their legs out of the aisle. When the child did not comply, both staff physically moved the child's legs. When the child placed their legs in the aisle again, Facility Person #1 responded by aggressively moving the child to the seat in front of where the child had been sitting. The child's head was hit off of the bus ceiling while attempting to clear the seat back. The child immediately began to cry. When the bus returned to the facility at 2:30 PM, and as children were exiting the bus, Facility Person #3 was observed pulling Child #3 by the arm forcefully out of the seat. That young school age child was observed holding their arm and crying as they walked up the bus aisle.

The first part of the training should involve all child care administrative staff in order to establish crisis management procedures, in which all staff will then be trained in the second part of the training.

At 2:30 PM, when the bus arrived at the facility, and children began to get out of their seats, Facility Person #3 yelled at Child #3, a young school age child, "Go now! Get out!"
