3290.113(a) · Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. The requirement for supervision on and off the facility premises includes compliance with the staff:child ratio requirements in §§ 3290.51-3290.52 (relating to maximum number of children; and staff:child ratio). TIERED LIS: 1. Children on the facility premises and on facility excursions shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. This portion of the plan shall have an immediate correction date. 2. The legal entity shall require all staff persons at the facility to attend, a minimum 2-hour training regarding supervision and ratio within 2 weeks of the approval of this plan of correction. The training must be approved by the Department prior to implementation. Documentation of the completed training will be provided to the OCDEL-DHS representative by email upon completion. The training may count towards the mandatory 12 training hours required by the Department. The provider will provide a date by which this will be corrected.
CONTINUED NON-COMPLIANCE. Previously Cited: On 4/17/2026 at 10:00am, Staff Person #2 was observed in the childcare space with seven children (two young toddlers and five preschool aged children, one of whom was related) while Staff Person #1 was in the next room with one preschool aged child. At that time, Staff Person #2 had identified two young toddlers to be under their supervision, while Staff Person #1 had identified the remaining preschool children as under their supervision. At 10:12am, Staff Person #2 was observed to leave the childcare space to refill their coffee while Staff Person #1 remained with all eight children. Staff Person #2 remained out of the childcare space for several minutes before returning. While the childcare space was being inspected, Staff Person #2 would walk out of the space two more times, leaving their two young toddlers out of their direct line of sight. On 6/8/2026 at approximately 12:10pm, certification representative approached the outdoor play area of the facility from the driveway. Staff Person #1 was observed to be outside of the fenced-in outdoor play area, assisting another individual with a household task in the driveway. Staff Person #1 had their back to the play area when certification representative arrived. When Staff Person #1 was asked if they were responsible for any children at that time, Staff Person #1 pointed to and named the two young toddlers on the other side of the fence at the top of the play area. Staff Person #1 was not present in the childcare space with the children and did not have direct line of sight of the children at the time.

In the meal area, a pair of kitchen shears was observed in a drawer which was accessible to children. In the outdoor space under the deck, three two-by-four boards were laying on top of the facility's air conditioning unit. Nine exposed bolts were observed to be sticking up out of the boards. This space is adjacent to play space and is accessible to children.

On a shelf to the left of the window in the childcare space, in a green bin filled with wooden block toys, seven blocks were observed to be damaged by chewing, as evidenced by teeth marks and splintered wood. A blue bin containing wooden train tracks contained several pieces of track that were splintered. In the outdoor play space, a large plastic playhouse with a green roof was observed (playhouse closest to the facilty building). There was a large, sharp crack observed in the roof of the playhouse. Also in the outdoor play space, a red and yellow ride-on toy (without eyes) was observed to have rusty bolts sticking up near the front wheels of the toy.
