The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

    At approximately 9:45 am, 14 children were present in the older toddler classroom. When certification representatives were walking into the older toddler classroom as staff #3 stated they were a taking a child to the restroom. Staff #4 was asked which children were in their primary supervisory group and 5 children all 3 years of age were identified. When staff #1 was asked, 2 children were identified, and she stated her other 2 children went to the bathroom with staff #3. Staff #1 was asked who was responsible for the other children in the classroom and staff #1 stated the children were in the primary group of staff #3, who took the 2 children to the restroom. At this time, 6 children in the classroom were not identified and accounted for by a staff person. Staff #3 returned to the classroom with one child. Staff #1 assumed 2 children from their primary group were taken to the restroom by staff #3. These unidentified children were still in the classroom and not identified as part of staff #1's primary supervisory group. When all staff were present, staff #4 identified 5 children all 3 years of age, staff #1 identified 4 children ages 2 and 3 years of age and staff #3 identified 5 children all 3 years of age.
