8.9.4.24 · H SOCIAL-EMOTIONAL RESPONSIVE ENVIRONMENT
Educators are not actively engaged with children when out on the playground. The educator took her eyes off the children in the playhouse for approximately 3 minutes to assist another child putting on socks. This allowed the child time to convince another child to remove her pants. There has been a pattern of lack of supervision. Another incident involving this same child was reported in December 2025 that convinced another child to remove his pants. There is a blind spot in one of the playhouses on the playground. (CAP) According to the New Mexico Child care Regulations 8.9.4.24.H.2. Educators must be actively engaged with children. Educators talk, actively listen and respond to children appropriately by responding to children's questions and acknowledging their comments, concerns, emotions and feelings. Educators knew of existing problematic behaviors with one child and got lax when monitoring this child. This allowed the child to convince another child to take off her pants. Immediate Action: The area this occurred was in a blind spot in a playhouse. This playhouse will be required to be permanently barricaded to prevent future incidents from happening. Preventative Action: The Center will perform a risk analysis regarding the safety risks of not being actively engaged with the children that are supervised. The risk analysis will include the steps the Director will take to identify the issues, assess the risk and the appropriate disciplinary actions and timelines to correct the behaviors and prevent future incidents. The risk analysis will include drafting a plan outlining staff trainings on NM Childcare regulations and Safety and Supervision. The risk analysis should be sent to the respective Compliance Officer for approval within 10 days. The Safety and Supervision training will be conducted by the staff and training will be done on the NMELS website. Trainings should be scheduled within 15 days and certificates of completion shall be forwarded to the respective Compliance Officer immediately upon completion. All trainings should be completed no later than 3 months from the date of onset of the Corrective Action Plan. Compliance monitoring: Review camera logs monthly to ensure there are no blind spots. Doing periodic walk throughs to ensure all blind spots are identified and eliminated.
