Guidance being used by staff is not appropriate as evidenced by an educator squeezed a child's cheeks in an attempt to stop him from crying. Immediate action: Educator was terminated. Preventative action: Co director has provided "The Way We Speak to Children Matters." reading materials to all staff. Compliance monitoring: Directors will provide extra resources to ensure educators are not getting frustrated. This will involve extra breaks if needed.

8.9.4.23 · A PERSONNEL AND STAFFING REQUIREMENTS
The educators 1 and 2 who were driving the transportation van(s) was not capable of providing care and supervision of children as evidenced by child being left alone in the van for 2.5 hours. Must follow conditions of operations issued with this survey. 8.9.4.23.A.9.:A program will maintain staff/child ratios and group sizes at all times based on the youngest child present in the group. Children must never be left unattended whether inside or outside the facility. Staff will be onsite, available and responsive to children during all hours of operation. All educators shall perform headcounts at regular intervals throughout the day. Finding The child in the van was left unattended when a headcount was not properly done and they still continued into the park. A child was left in the van unattended for 2.5 hours. Must follow conditions of operations issued with this survey. 8.9.4.28.J.:At all times, drivers will have a way to communicate to the facility the number of children being transported. Drivers will maintain a log to include the name of child, drop off and pick up times of all children being transported. The log will be kept for a minimum of 12 months for review. 8.9.4.12 · A, K, N LICENSING ACTIONS AND ADMINISTRATIVE APPEALS
The licensing department may initiate negative licensing action based on (1) violation of any provision of these regulations, especially when the licensing authority has reason to believe that the health, safety or welfare of a child is at risk, or has reason to believe that the licensee cannot reasonably safeguard the health and safety of children., (6) failure to properly protect the health, safety and welfare of children due to impaired health or conduct or hiring or continuing to employ any person whose health or conduct impairs the person’s ability to properly protect the health, safety, and welfare of the children. Child was left unattended in a van for approximately 2 hours. No medical services were called to evaluate when the child was discovered. Immediate action: 8/6/2025 Conditions of Operations was delivered to suspend transportation services for children attending the center. This suspension of transportation services will remain in effect pending the outcome of the investigation, and pending the determination of what further action, if any, might be necessary as supported by the investigation results. From the review of staff records, it was determined that 4 out of 22 staff records does/do not include documentation of current first-aid and cardiopulmonary resuscitation training. Toys and equipment in the Preschool/Toddler playground are not safe in that the slide has sharp edges or points along with exposed screws under the slide. From the review of staff records, it was determined that 1 out of 1 staff records does/do not include signed acknowledgement that the personnel handbook had been read and understood. See Staff Records 8.9.4.22 form for staff who need to complete the acknowledgement. Education Program Coordinator was not allowing staff to pray which is a violation of the regulations because it is a required statement for the personnel handbook. On 8/8/24 the facility has amended the policies and procedures.
