Each child not enrolled in a public or private school shall have had a health examination performed by a health care provider within: i. A child shall be exempted from a physical examination, immunization, or medical treatment if the parent objects thereto in a written statement submitted to the center, signed by the parent, explaining how the examination, immunization, or medical treatment conflicts with the child’s exercise of bona fide religious tenets or practices. i. Religiously-affiliated centers shall have the authority to withhold or grant a religious exemption from the required immunization for children entering or attending their centers without challenge by any secular health authority, as specified in N.J.A.C. 8:57-4.4. ii. The center shall maintain the parent’s written statement on file as part of the child’s record. 6. Those children with immunization exemptions may be excluded from the center by the Office of Licensing or the Department of Health during a vaccine-preventable disease outbreak or threatened outbreak, as determined by the State Commissioner of Health.

The food shall be stored in the refrigerator, returned to the parent, or discarded with the parent's consent. All unused food shall be discarded if not consumed by the end of the day.

Toileting procedures shall be supervised by a staff member as appropriate for the ages and developmental needs of the children. 1. At least one staff member shall be physically present in the room or area in which children are napping and shall be able to summon other staff members without leaving the room or area. 3. Naptime preparations shall have been completed and all children 18 months or above are resting or sleeping, while all children under 18 months of age are sleeping.

In room 6, an infant was sleeping in a crib in the back corner behind other cribs where staff could not see them. In room 12, a child was in the bathroom with the door closed where staff could not see them. In room 1, children were walking around with toys in their mouths without staff intervening. In room 2, children were going behind cribs and pushing them toward children playing on the floor. 6-10-25: In rooms 4 and 14, a child was sitting on the bottom shelf of the diaper table without staff intervening. 6-10-25: In room 16, a child was sleeping in the corner of the room and behind a toy shelf out of sight of all staff. 6-10-25: In room 14, a child was eating food from an earlier mealtime off the floor without staff intervening. 6-10-25: In room 1, children were climbing up on top of the toy shelf to look out the window without staff intervening. 6-10-25: Children were climbing out onto and sitting on top of the tunnel in the outdoor play area without staff intervening. 7-16-25: In room 16, a child was kneeling on a staff spin chair while another child was spinning them around in a circle without staff intervening. 7-16-25: In room 1, several children were walking around the room with sticks and a pair of goggles in their mouth without staff intervening. 7-16-25: In room 1 children were observed standing on chairs along the window and another child was pulling the chairs out from under them. 7-16-25: In room 1 a child was observed climbing up on the table and jumping off without staff intervening. 7-16-25: In the outdoor play area, children from room 9, were observed standing up on the top of slides without staff intervening. 8-6-25: Ensure children are not walking through the hallways unsupervised.
