3A:52-6.3(a) · 1. Food shall not be shared among children using the same dish or spoon; and v. Unused portions of food shall be labeled with the child's name, date, and type of food. The food shall be stored in the refrigerator, returned to the parent, or discarded with the parent's consent. All unused food shall be discarded if not consumed by the end of the day.

Ensure that food requiring refrigeration is stored in a refrigerator or stored in insulated lunch boxes, wherein cooked food and dairy products were observed sitting out in cubbies in Room 4.

3A:52-2.3(d) · The requirements for co-location of a center within a multi-use building are as follows, during operating hours, the Office of Licensing may require the center to operate in a separate room, floor, or section of the building; have or use a separate entrance or toilet facility; meet any other physical plant, staffing, program, or other operational requirements that are deemed necessary to protect the children from serious risk of harm stemming from the co-location; not share common areas, such as hallways, gyms, or bathrooms; and have a schedule for outdoor time, if the outdoor play area is shared.

Ensure that the center prevents co-mingling by securing all center space from other building occupants. The center is located within a large community center, which had many people from the public inside utilizing the facility. The center must ensure that all classrooms and bathrooms that are used towards center's licensed capacity are inaccessible and secured from the public utilizing the community center. Additionally, the multipurpose rooms, which are approved center spaces and used towards the center's licensed capacity, were observed being used by the community center during inspection. The center must either secure those spaces and ensure that they are not used by the community center during the center's operating hours, or have the rooms removed from the center's licensed space/capacity. Submit a Plan of Action to the OOL detailing steps center will take to ensure compliance and include timeframes for completion. 5/20/25-MOU received from center. Violation remains open for observation of compliance. 7.8.25-MPR 2 doors were open and members in the facility had access to the licensed space. MPR 1 was being utilized by the community. 9/19/25-3 classroom doors were observed either open or unlocked, allowing public access to the center space. 11/14/25-Multi purpose rooms removed from center's license, they will now be used as field trips with signed permission slips as needed. Classroom doors were observed propped open. Center must ensure that those doors are secured. Center to submit an MOU to OOL detailing steps taking to build security and ensure space remains secured from the community center occupants.

3A:52-7.5(b)(10) · (9) The center shall develop and follow a policy on the administration of medication and health care procedures to children, which shall include the following provisions: before administering a health care procedure associated with a child’s health condition, such as the use of a blood glucose monitor, nebulizer, or epinephrine pen, the center shall ensure that all staff members who administer the procedure are taught to do so by the child’s parent or another appropriately-trained person.
