M. Hicks, administrator, was present and assisted with the visit. Currently, this center operates with a Notice of Compliance issued on February 2, 2024. The last sanitation inspection was completed January 9, 2026 earning a superior rating. The last fire inspection was completed July 1, 2026 and the facility was approved for daytime care only. Children were observed engaging in activity center play, outdoor play, lunch and nap routines. Observed interactions between teachers and children were positive and nurturing in nature. The following violations of child care requirements were documented. Violation Number Comment Rule 849 Leftover medicines were not returned to the parent after the course of treatment was completed, after authorization was withdrawn or after authorization had expired and/or medication was not discarded within 72 hours of completion of treatment or withdrawal of authorization. There was an expired container of Aquaphor in space #2. .0803(12) 1811 Shelter-in-place or lockdown drills were not practiced every three months and/or drill record was incomplete. A shelter-in-place or lockdown drill was not practiced every three (3) months. .0604(u);.0302(d)(8) 1825 All staff did not review the center's EPR Plan during orientation and/or on an annual basis with the trained staff. Documentation of the review was not maintained on file. There is no documentation that staff have reviewed the EPR plan since 2024. .0607(f) The violations documented above must be corrected immediately. A signed and dated letter of compliance can be mailed or emailed to me and must be received by January 27, 2026. If mailing, you must submit two (2) signed and dated copies. My mailing and email addresses are noted at the bottom. The letter of compliance must detail how the violations were corrected. If it is determined that submitted information was inaccurate or willfully falsified, an Administrative Action, including Revocation of the facility’s license could be issued. COMPLIANCE HISTORY Prior to today’s visit your compliance history was 88% over an eighteen (18) month period. FACILITY PROFILE This facility is owned by Pilot Baptist Church. The corporation is listed as current/active in the North Carolina Secretary of State corporation’s database. The corporation that owns this facility is required to always maintain a current/active status. Failure to do so could result in an Administrative Action including Suspension or Revocation of the facility’s child care license. CHILDRENS RECORDS I reviewed ten (10) percent of children’s records, and they were observed to be in compliance with Child Care Requirements. STAFF RECORDS I reviewed ten (10) percent, or more, of staff records, and a violation was documented. There is no documentation that staff reviewed the center’s Emergency Preparedness and Response plan yearly. You informed me that all staff reviewed the EPR plan during the September 23, 2025 staff meeting but it was not documented as you believed it was no longer required. Documentation that staff reviewed the EPR plan annually must remain on file to verify that all staff are familiar with the plan should a natural or manmade disaster occur. If you do not want to do an individual acknowledgement of the review for each staff person I recommend using a log for staff to sign that explains the EPR plan was reviewed with them during a staff meeting. MEDICATION An expired container of Aquaphor that expired September 2025 was observed in space #2 for an enrolled child. I would encourage staff to have parents fill out a new ointment permission form should one container run out, and they bring a new one, even if it is the same type. The expiration is likely to be different. Should parents be the ones to note the ointments expiration date on the form staff should ensure it is correct. PROGRAM RECORDS While reviewing the shelter-in-place and/or lockdown drill log I observed that they were not completed every three (3) months. A drill was conducted on January 6th and then May 13th. Then it happened again between the July 29th and December 29th drills. Both drills were four (4) months apart. Child Care Rules that one of these drills is completed and documented on the DCDEE form quarterly to ensure staff and children remain familiar with procedures in case of these emergencies. You were under the impression this had to be completed once during the quarter. OUTDOOR PLAY AREA I observed that there are several metal spikes used to secure the black borders around the large play equipment and another play area that are beginning to protrude. When these stakes show signs of rising I would either hammer them back flush with the border top or put in a request that maintenance do so. Periodically these stakes begin to rise over time and must be put back into place to avoid any protrusion or entrapment hazards. ABCMS-CRMINAL BACKGROUND CHECK PORTAL The Division sent out several emails since 2024 regarding every administrator/owner completing the ABCMS Moodle training. You will need to use your business NCID. If you have not completed the ABCMS Moodle training, please complete it immediately. Once you have completed the training you will receive an access code to complete the Roster set-up, please wait 48 hours prior to using the access code (it takes about 2 days before you can use it). As stated in G.S. 110-90.2 & .2703(r) child care operators are to notify the Division of any new child care providers working who were hired or moved into the child care facility within five business days. The process of notifying the Division has changed and is now captured in ABCMS. This change has been in effect since February 2024. If needed the training may be found at the following website: https://www.dcdee.moodle.nc.gov/course/view.php?id=119. Once the training has been completed and access has been given, you must verify your facility roster to ensure current staff are noted on the roster. This information should be updated in ABCMS on an ongoing basis as staff members are hired and when their employment is terminated. TECHNICAL ASSISTANCE & REMINDERS Technical assistance was given regarding completion of the permission to administer ointments (etc.) forms. Staff should review all medication permission forms to ensure that parents list a specific amount to use such as “pea sized,” “quarter sized,” “1 oz,” etc. They must also indicate a specific time to use the ointment or medication. “As needed,” and “when needed,” are not sufficient. I recommend that staff or maintenance till and redistribute the wood mulch on the large playground as it is compacted in some areas and has been kicked out from beneath the swings. Technical assistance also discussed related to having staff keep their purses and personal bags in a locked cabinet/area or locked in their car. If the purse is in the children’s environment and assessable it may be hazardous if items that are required to be locked in storage are inside. Items could range from otc medication, cleaning items, lighters, etc. If it is not locked then I may look though it to ensure no hazardous products are inside. Child care licensing requirements are established to ensure a safe and healthy child care environment. It is your responsibility to maintain compliance with all applicable laws and rules. The best way to do so is to periodically review the child care laws and rules. The current rule book dated July 1, 2025, is available at the DCDEE website listed above. There are also modules of the new Child Care Rules available on Moodle, which can be found on the Division website. The following child care requirements were monitored: supervision, permit restrictions, staff/child ratios, adequate/approved space, and discipline. Permit restrictions for this facility include first shift care only and observed to be in compliance. Children were observed napping or resting in each space, waking from naptime, as well as outdoor play and snack time. Observed interactions between the teachers and children were nurturing in nature. The following violations of child care requirements were documented today. Violation Number Comment Rule 303 Children were not adequately supervised at all times. You were all given the chance to ask questions. It was noted that there was an incident where a child was left alone in space #8, briefly, while the group was lining up to go outside. While outside it was observed that the child was not present and a staff member not assigned to the group in space #8 went inside to retrieve the child. You stated that a meeting was conducted with one of the staff considered responsible and they received a write-up. This staff member no longer works at the center. Staff also confirmed that a staff member, whose child was enrolled at the time, would often discipline their child by yelling or spanking the child in the bathroom or in the room while children were present. If it is determined that submitted information was inaccurate or willfully falsified, an Administrative Action, including Revocation of the facility’s license could be issued. Any repeat of the violations documented during the visit may warrant some type of Administrative Action. ALLEGATIONS There was a concern regarding alleged violation of the child care requirement related to supervision, discipline, and staff/child ratios. FINDINGS I reviewed and discussed the allegations with you, M. Wood. The allegations were also reviewed with the assistant administrator, W. Dean, and several other staff members. You were all given the chance to ask questions. It was noted that there was an incident where a child was left alone in space #8, briefly, while the group was lining up to go outside. While outside it was observed that the child was not present and a staff member not assigned to the group in space #8 went inside to retrieve the child. You stated that a meeting was conducted with one of the staff considered responsible and they received a write-up. This staff member no longer works at the center. Staff also confirmed that a staff member, whose child was enrolled at the time, would often discipline their child by yelling or spanking the child in the bathroom or in the room while children were present. This staff member also no longer works at the center. TECHNICAL ASSISTANCE Technical assistance given related to training on classroom management and discipline. I encourage you to review the Southwestern Child Development Commission website at www.swcdcinc.org which also offers approved training on these topics for a fee. They currently offer the following trainings: “Bite Marks,” “Classroom Rules and Behavior Expectations,” “Active Supervision Counts,” and various other topics. Technical assistance discussed related to ensuring that the discipline policy and supervision requirements are reviewed with staff periodically. If they do not remember the policy or procedures they should be able to locate and review them quickly when needed. Based on the information received, and my observations, the allegation regarding supervision, staff/child ratio and discipline are substantiated. Due to documentation of a substantiated allegation an Administrative Action may be warranted and issued to the child care center. M. Wood, administrator, was present and assisted with the visit. Currently, this center operates with a Notice of Compliance issued February 2, 2024. The posted sanitation inspection was completed January 12, 2024 earning a “Superior” rating. The last fire inspection was completed July 8, 2024 and the facility was approved for daytime care only. Children were observed having breakfast, engaged in free play in activity centers and teacher directed group time activities. The following violations of child care requirements were documented. Violation Number Comment Rule 812 Electrical outlets and power strips, not in use, which were located in space used by children did not have safety outlets or were not covered with safety plugs unless located behind furniture or equipment that cannot be moved by a child. There was an uncovered outlet by the washer and dryer in the laundry area and also one by the desk in the space #10. 10A NCAC 09 .0604(c) 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file. First Aid training not completed within the required timeframe for the employee hired 3/27/24. .1102(c) The violations documented above must be corrected immediately. A signed and dated letter of compliance can be mailed or emailed to me and must be received by September 19, 2024. If mailing, you must submit two (2) signed and dated copies. My mailing and email addresses are noted at the bottom. The letter of compliance must detail how you the violation was corrected. Please be aware any written information you submit regarding the correction of the violation is legal documentation. Therefore, it is important that all submitted information is accurate and truthful. If it is determined that submitted information was inaccurate or willfully falsified, an Administrative Action, including Revocation of the facility’s license could be issued. PROGRAM RECORDS You informed me that new staff has been hired since the last full monitoring visit. I reviewed six (6) staff files, and a violation was documented. Staff hired 3/27/24 completed the American Heart Associate (AHA) Basic Life Support (BLS) CPR and AED training. However, this only covers the CPR requirement per Child Care Rules. The staff member needs to complete a First Aid training within the next two (2) weeks. If First Aid was covered during their 3/28/24 BLS training, then the trainer/organization should include that on the completion of that module on the card for verification. I also observed that the staff person hired 6/6/24 completed the same BLS training on 7/2/24. They need to complete a First Aid training by September 6th to remain in compliance. I left a copy of the AHA CPR and First Aid courses that meet NC Child Care Rules requirements information with you. SAFETY AND HEALTH I observed an uncovered outlet in the laundry area by the washer and dryer near one of the restrooms used by children. There was an uncovered outlet by the desk in space #10 used for care of school-aged children. However, the school-aged children will not use the space until this afternoon. I recommend placing a sign to remind staff and church members who may use the spaces to recover the outlets when they unplug an item. STAFF/CHILD INTERACTION: OBSERVATIONS Although not required I observed class schedules in each space. There are age-appropriate materials and toys available in each space as well. Children engaged in age-appropriate activities during the visit such as teacher directed art, activity center play and outdoor play. I also observed a group time in space #8 that included dancing and following instructions of a children’s song to shake their “wiggles” out and a dinosaur hunt. This was a great activity to work on listening and gross motor skills. Children in space #4 worked at the table, with their teacher, coloring a page that was all about the letter “T.” She informed them this would be added to the books they’re making. This was a great opportunity to build fine motor skills and cognitive skills as the worked on recognizing the letter “T” and what words and objects begin with the letter. BEHAVIOR MANAGEMENT AND REDIRECTION: Children are naturally curious and creative, which means they often explore to learn. They inevitably test boundaries and engage in challenging behaviors due to this curiosity and drive to learn. Positive relationships are essential for the development of children’s social competence. There are positive steps and routines that can be used to limit challenging behaviors and guide children to more positive choices. Providing positive guidance through nurturing and responsive relationships and supportive environments to promote children’s self-control, teach responsibility and help them make thoughtful choices. Effective behavior management focuses on the child’s development and require the caregiver to understand what behaviors and reactions are appropriate for the that child and their age. Encouraging staff to take trainings on the topics of challenging behaviors, behavior management and redirection is a great way to help develop ways to respond and redirect behaviors without on saying “No.” Franklin-Granville-Vance (FGV) Smart Start and the Southwestern Child Development Commission are great places to find useful trainings on this and many other topics. TECHNICAL ASSISTANCE & REMINDERS: I recommended that staff store their personal handbags in locked storage if brought into the facility. This will ensure that any items that may be contained in handbags will be in locked storage such as individual medication, disinfectant wipes, lighters, etc. which are often kept in handbags. Remember if it is in the environment, it may be monitored as well. Continue to remind staff that they are required to model appropriate eating habits by only eating foods that meet nutritional requirements while caring for children. The Clean Water for Carolina Kids program is expanding to the Clean Classrooms for Carolina Kids program. This is a legislatively mandated effort to address lead and asbestos hazards in North Carolina public schools, licensed child care centers, and licensed family child care homes. Participation allows facilities to meet all rule requirements for identified lead and asbestos hazards, as required by law. Rules 10A NCAC 41C .1001 through .1007 require all programs to be free of lead and asbestos hazards. RTI is coordinating all the lead in water, paint and asbestos testing and remediation. There are webinars you can watch to get instructions. Go to https://www.cleanwaterforuskids.org/en/carolina/ for more information. Currently operating child care facilities are required to test for lead in paint and asbestos once unless the consultant notes a concern during a visit and refers the program to environmental health. All existing licensed programs should have completed the application summary for their program regarding lead paint and asbestos by November 1, 2024. The application may be found on the website noted above. Child care licensing requirements are established to ensure a safe and healthy child care environment. It is your responsibility to maintain compliance with all applicable laws and rules. The best way to do so is to periodically review the child care laws and rules. The complaint report was received via April 22, 2024. Upon arrival, facility administrator/contact, Margaret Wood, was present and today’s visit was reviewed with her. Child Care Consultant, Felicia Faison, accompanied me today. Ms. Wood introduced Ms. Faison and I to Wendy Dean, who is serving as the facility’s assistant administrator. The allegation pertaining to inadequate supervision was reviewed with you, Ms. Dean, and applicable staff. Applicable child care requirements were monitored during the visit and overall attendance was documented. Based on the allegation, each room was not observed and enrollment for each group was not documented; however, overall attendance was documented today. There was a total of 43 children present today ranging in ages from birth to five years of age. The space, capacity, and enrollment worksheet was not completed today. Children observed today were playing outdoors within the fenced play area and interacting with assigned staff. One group of children, all two years of age, were observed upon arrival playing within a fenced play area that was not approved for use; however, is owned by the church and is located on the same premises as the child care facility. Ms. Faison and I measured the space today and will add the area to the outdoor play areas for approval. When asked, you did not have specific written permission from the children’s parents/guardians to play within the fenced area. You stated you were unaware that permission was needed since the area is located on the same premises as the child care facility. We will email you a revised plan to reflect the addition of the fenced play area after today’s visit along with a revised space calculation sheet reflecting the total square footage and total number of children allowed based on square footage. A violation regarding the use of unapproved space was documented today and verified as corrected during the visit. Findings - Allegation: There is a concern of inadequate supervision in the classroom for two-year old children. You and the applicable staff were interviewed and given an opportunity to share information regarding the allegation. Observations were also conducted to monitor supervision of children who are two years of age and were present today. Ms. Faison and I conducted observations in one (1) specific room today, Room 5. When asked, this is the only room being used that currently has children that are two (2) years of age present. We observed a total of eight (8) children, all of which were two years of age. When asked, this facility, does have a video/camera system, however, when I asked to observe specific footage from specific dates, ranging from March 12, 2024, through March 27, 2024, Ms. Wood stated the video/camera system was not equipped to maintain footage for that length of time. Ms. Wood stated the video/camera system was new and records footage but also erases footage after a specific length of time; therefore, based on this information, I could not review footage during the above documented time frame. You stated the recorded footage begins on April 11, 2024. When asked, you did have video footage saved on your cellular phone from one incident that occurred in Room 5 on March 27, 2024. The footage was about 15 seconds in length and showed children, which you stated were all two (2) years of age playing, walking around the room that was in view of the camera. Two (2) staff members were observed in the footage. At the beginning of the video footage observed, a staff member was attempting to open a window in Room 5 and her finger got stuck. A second staff member was observed walking over to assist her while also supervising the children. One (1) child was observed seated at a table eating and drinking. The child was observed positioned within close proximity to the two (2) staff members while at the table. The video footage reflected a child approaching the child that was eating and drinking. The child physically placed her hands around the child’s neck as the child was observed drinking. A staff member saw this incident occur and promptly intervened and assisted the children. That is all that could be seen from the video clip provided. No other video footage was provided. After this incident occurred, an incident report was completed to document what happened, and the information was shared with both parents of both children involved. When asked, it was stated that staff will “shadow” a child that may tend to bite, hit, or show other signs of aggression. By “shadow”, staff will remain close to the child and will intervene when needed to keep all children safe. It was reported during interviews today that staff will divide into smaller groups at times to better manage the children. Staff also worked with a child recently that predominately spoke Spanish. Staff provided a spiral notebook that they developed with phrases written in both English and Spanish to use throughout the day when communicating with the child that spoke Spanish. Staff also developed posters of phrases to reference during the day with the child and all the children in the group. The posters were not observed today. You stated when an incident occurs an incident report/ouch report is completed and maintained on file. If medical attention is required, you submit a copy of the completed incident report to your assigned Child Care Consultant. You also maintain an incident report log and document when incidents occur. Incident reports and an incident log were observed on file today. When asked, the facility has developed and implemented a biting policy that all parents receive a copy of and sign at enrollment. The facility has also developed and implemented a guidance and discipline policy that all parents receive and sign at enrollment. These policies were referenced today. These policies are part of the enrollment packet paperwork that is reviewed and given to parents. Both policies have an area for parents to sign as acknowledgement of receipt of the policies. You further stated a biting log is maintained and completed as biting occurs. This documentation is maintained on the appliable child’s file for review. When asked about sharing video footage with persons/parents that have concerns or request to review the video footage, you stated it is not customary to permit others to view the footage due to privacy of other children. The facility has implemented a Camera Policy that is shared with and signed by all parents during enrollment. A copy of the policy was reviewed today. When asked, this facility does use a program, (Bright Wheel), to share information and pictures with children’s parents/guardians. Based on observations, information received, and reviewed during today's visit, this allegation was unsubstantiated. A violation was documented today but was not related to the allegation of inadequate supervision. The following violation was documented today: Violation Number Comment Rule 209 Children used space that was not approved. A group of eight (8) children were present with two (2) assigned staff members playing within a fenced area that was not approved space. GS 110-91(1)&(4-5) The violation documented today must be corrected immediately. If at any time you are unable to correct the violation within the specified time frame, please send a written statement regarding the violation and why an extension is needed to verify compliance. Please email a signed letter of compliance to me by May 9, 2024. A two-week time frame has been established to allow you time for submitting your compliance letter. This timeframe is not intended to be used as a guide for correcting violations, as violations should be corrected immediately. CCSA has Birth-To-Three Specialist Coaches that provide practice-based coaching to staff caring for young children. You can contact the CCSA regarding this program and see if someone can provide some training or resources that you may find helpful to you and your staff. The CCSA may also have resources and information available to share with parents of young children. We also discussed contacting the Healthy Social Behavior Specialist working with programs in Franklin County. There is a Challenging Behaviors Helpline available to child care providers. You can call 1-888-600-1685, press option 1, to speak to a Behavior Support Advisor for advice and resources specific to challenging behaviors.
