This facility currently operates with a Five-Star Child Care License that was issued on January 16, 2020. The last Sanitation was conducted on April 3, 2025, and received a “Superior” classification and nine (9) demerits. The last Fire Inspection was conducted on August 23, 2024, and the facility was approved for daytime care only. The last Fire Drill was conducted on July 23, 2025. The last Lock Down/ Shelter-in-Place was on June 5, 2025. The last Playground Inspection was conducted July 11, 2025. Upon arrival, I was greeted by the director, Chelsey Mitchell. I stated the purpose of my visit and was assisted on a walk-through of the facility, where attendance was documented, and observations made. The infants were observed being held and participating in routine diaper changes, children and teachers were very engaged in indoor free play and activities, and school agers were outdoors having free play under the shelter. Today, a partial assessment of applicable child care requirements was conducted, which included license posted, permit restrictions, supervision, staff/child ratio, qualified criminal background checks, staff training and general safety. Storage and administration of medication were monitored. Medication authorization was monitored. Child Care programs are expected to always achieve and maintain compliance and are required by NC GS 110- 90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation (s) documented may impact on the compliance history score. The facility compliance history was reviewed with the operator. The program’s compliance history was ninety three percent (93%) as of 7/29/25. The following violations were cited, and technical assistance was offered. Violation Number Comment Rule 428 A current activity plan was not posted for each group of children for reference. A current lesson plan was not posted and one lesson plan had no date on it in school age classroom. GS 110-91(12); .0508(a) 843 A drug or medicine was administered after its expiration date. An EPI pen in the space 9 had expired on 5/25. 10A NCAC 09 .0803(1)(d) 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file. J. Samuels first aid expired on 7/1/25. Ms. Samuels is registered for this training 8/6/25. .1102(c) 1049 All staff did not successfully complete certification in CPR training appropriate to the age of the children in care. Verification of staff completion of the CPR course from an approved training organization was not in the staff file. J. Samuels CPR training expired on 7/1/25. Ms. Samuels is registered to take the training on 8/6/25. .1102(d) 1874 The Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy was not reviewed with new staff prior to providing care with children and/or a signed acknowledgement with all the required information was not maintained in the staff person's file. Kawalec did not have a signed copy of this training in her file. .0608(d)(1-4) 1897 The child care administrator and all staff did not complete the Recognizing and Responding to Suspicions of Child Maltreatment training within 90 days of employment. All staff must complete important training such as how to spot suspicions of child maltreatment and abuse and what steps to take next to prevent this. Shaken Baby Syndrome must be reviewed with all staff members prior to the first day of hire. You and your staff were provided with an opportunity to ask questions regarding interpretation and implementation of all child care requirements. Child care licensing rules and regulations are established to ensure a safe and healthy environment for children in care. Chelsey Cosper, administrator, accompanied me during a walk-through of the facility. During the visit, I discussed the allegations with Ms. Cosper, and additional staff members. Limited monitoring of child care requirements occurred during today’s visit. The following violations were observed and/or confirmed during today’s visit. Violation Number Comment Rule 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. On 4/1/25, a staff member rapidly placed a child back on their nap mat when the child would not stay on the mat. G.S. 110-91(10) 907 Discipline was related to food, rest or toileting. On 4/1/25, in attempt to correct a child’s behavior, two staff members took a 2-year-old child’s blanket and pillow away during naptime, because the child would not listen to the staff members instructions. .1803(a)(4-6) 1877 A child was restrained as a form of discipline and the child's safety or the safety of others was not at risk. On 12/20/24, a staff member restrained a two-year-old child to a chair by holding the child in the chair by their hands, holding the child’s head, and standing in front of the chair, not allowing the child to get up. The same staff member placed another two-year-old child in chair and restricted the child’s movement, by physically remaining in front of the child, repeatedly putting their hands on the child’s legs, not allowing the child to stand up. .1803(a)(10) Violations must be corrected immediately. The last Annual Compliance visit was conducted on April 1, 2024. The facility currently operates with a Five-Star Child Care License that was issued on January 16, 2020. The last Sanitation Inspection was completed on November 19, 2024, with a "Superior" classification and seven (7) demerits. The last Fire Inspection was conducted on August 23, 2024, and the facility was approved for daytime care only. The last Fire Drill was conducted on March 1, 2025. The last Lock Down/ Shelter-in-Place was on March 1, 2025. The last Playground Inspection was conducted on February 17, 2025. The North Carolina Department of Secretary’s website was used to check the status of “Wallburg Academy LLC.” corporation on March 2, 2025. The facility’s owner is current/active. Upon arrival, I was greeted by the assistant director, Jennifer Samuels, and director, Mrs. Chelsey came later on in the visit. I stated the purpose of my visit and conducted an assisted walkthrough of the facility, where attendance was documented, and observations made. The children were observed participating in routines diaper changes in the infant classroom. The children were playing in centers, and some classes were playing outdoors. The twos were dancing to music. Today I completed a full assessment of Applicable Child Care Requirements; license posted, restrictions maintained, staff/child ratio and adequate approved space. Program Records and Criminal Background Checks were also monitored. Staff and Children’s files were monitored as well as Emergency Drills, Medication, Playground Inspections and Transportation. Today I monitored three (3) buses. I monitored tires, seatbelts, insurance and registration. All of the buses were equipped with a first aid box and a mounted fire extinguisher. All vehicles have been maintained and were checked for overall safety. All three vehicles are insured through "Progressive Southeastern Insurance" company which expires 4/16/25. All buses need to have proof of registration on the buses. 1. Chevy 2006 minibus tag number EMB 4152 expires in June 2024. 2. 2.Chevy 2006 minibus tag number ECN 4942 expires in June 2024. 3. 3.Chevy 2018 minibus tag number EMB 4151 expires in June 2024. Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. As of March 2, 2025, your facility is at a 91 percent compliance rate. Today eleven (11) children’s files were monitored and found to be in compliance. All staff files were monitored and found to be in compliance. The director emailed me staff and training worksheets on March 20, 2025. The signature on the forms serves as verification that the information provided is accurate and correct. The following violations were cited, and technical assistance was offered. The last Annual Compliance visit was conducted on April 1, 2024. The facility currently operates with a Five-Star Child Care License that was issued on January 16, 2020. The last Sanitation Inspection was completed on November 19, 2024, with a "Superior" classification and seven (7) demerits. The last Fire Inspection was conducted on August 23, 2024, and the facility was approved for daytime care only. The last Fire Drill was conducted on March 1, 2025. The last Lock Down/ Shelter-in-Place was on March 1, 2025. The last Playground Inspection was conducted on February 17, 2025. The North Carolina Department of Secretary’s website was used to check the status of “Wallburg Academy LLC.” corporation on March 2, 2025. The facility’s owner is current/active. Upon arrival, I was greeted by the assistant director, Jennifer Samuels, and director, Mrs. Chelsey came later on in the visit. I stated the purpose of my visit and conducted an assisted walkthrough of the facility, where attendance was documented, and observations made. The children were observed participating in routines diaper changes in the infant classroom. The children were playing in centers, and some classes were playing outdoors. The twos were dancing to music. Today I completed a full assessment of Applicable Child Care Requirements; license posted, restrictions maintained, staff/child ratio and adequate approved space. Program Records and Criminal Background Checks were also monitored. Staff and Children’s files were monitored as well as Emergency Drills, Medication, Playground Inspections and Transportation. Today I monitored three (3) buses. I monitored tires, seatbelts, insurance and registration. All of the buses were equipped with a first aid box and a mounted fire extinguisher. All vehicles have been maintained and were checked for overall safety. All three vehicles are insured through "Progressive Southeastern Insurance" company which expires 4/16/25. All buses need to have proof of registration on the buses. 1. Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. As of March 2, 2025, your facility is at a 91 percent compliance rate. Today eleven (11) children’s files were monitored and found to be in compliance. All staff files were monitored and found to be in compliance. The director emailed me staff and training worksheets on March 20, 2025. School age children were out for spring break and were playing a game on the playground. Today I completed a full assessment of Applicable Child Care Requirements; license posted, restrictions maintained, staff/child ratio and adequate approved space. A child with asthma was prescribed "Ventolin" from his doctor but, the parent did not include all the correct information on the form to administer the medication. This form must have a starting and ending date on it and signed by the parent. 10A NCAC 09 .0803(4)(6-9) The above violations must be corrected immediately. The Division has determined that your facility is in Cohort 2, which means your preparation year is from July 1, 2024 to June 30, 2025. This complaint was received by the agency on February 19, 2024. Today, Kaye Adkins, Licensing Supervisor, assisted me on this visit. Upon arrival we spoke with the director, Chelsey Cosper, and assistant director, Jennifer Samuel and we discussed the purpose of our visit. We conducted an assisted walkthrough of the facility with Ms. Cosper. Today we monitored staff/child ratios, supervision, and health and safety. During today’s visit, all classrooms were observed to be in ratio. Allegations: There are concerns regarding staff /child ratios. Observations and Discussions: During today’s visit, we reviewed attendance records from the two-and-three-year-old classroom, on the dates in question of 2/14/24 and 2/19/24, and on 2/13/2024 at the direction of the director. This classroom is the first room on the right when you enter the facility. The reporter stated that on 2/14/24 the classroom had mixed ages of two and three-year-old children for a total of 17 children with one staff member. The reporter also stated that, while staff was standing in the doorway, two (2) children ran out of the classroom and ran to the front door where they were stopped by the administration. When we asked Ms. Cosper if she was aware of this, she stated that the incident occurred on 2/13/24, not 2/14/2024. Ms. Jennifer stated that she was the person up front that caught the two children walking out of the classroom. Ms. Jennifer stated that the teacher in the classroom was reading a story to the children and was unaware that the two children had left the room. The reporter also stated on 2/19/24 the same classroom was out of ratio again with (9) two-year-old's and (9) three-year-old's to one staff member. The reporter stated that they called for assistance, but no one came. Ms. Jennifer stated that in their procedures, any time a teacher comes close to being out of ratio they are supposed to call one of the administrators up front, using their cell phone or Bright Wheel to ask for an extra person. I asked if the classroom in question was out of ratio on these days and Ms. Jennifer stated that this teacher was out of ratio with 12 children at the time this incident occurred. However, she also stated the teacher did not follow procedure and failed to contact the administrators up front to inform them. The ratio in the classroom requires no more than nine (9) children to one (1) staff member. I asked if the parents of the two children that ran out of the classroom were notified of this incident, and Ms. Cosper stated they had not been notified because the two children were caught in the doorway. Resolution: Based upon observations, review of the attendance sheets, and discussions with the director and assistant director, the allegation regarding staff/child ratios was substantiated. Violation Number Comment Rule 301 Minimum staff/child ratios and group sizes for the number and ages of children in care were not met. The last Fire Inspection was conducted on August 2, 2023, and the facility was approved for daytime care only. The last Fire Drill was conducted on October 26, 2023. The last Lock Down/ Shelter-in-Place was on September 21, 2023. The last Playground Inspection was conducted November 1, 2023. Upon arrival, I was greeted by the classroom coordinator, Ashley Hince. I stated the purpose of my visit and was assisted on a walk-through of the facility, where attendance was documented, and observations made. The children were observed participating in routines, indoor free play, and outdoor free play. Today, a partial assessment of applicable child care requirements was conducted, which included license posted, permit restrictions, supervision, staff/child ratio, qualified criminal background checks, staff training and general safety. The following violations were observed during today’s visit. Lysol wipes, Windex and disinfectant spray were found near the drivers seats. .2820(b) 1123 All vehicles used to transport children were not free of hazards. A Chevrolet bus transporting children did not have a secured bench seat in it. This was found in bus tag number ECN-4942. 10A NCAC 09 .1002(a) 1835 The medical action plan was not updated on an annual basis or when changes to the plan were made by the child's parent or health care professional.
