AT THE HEIGHTS Facility ID: 34001400 Consultant: KELLY HEALY Operation Type: Center Case Number: Visit Date: 5/8/2024 Number Present: 74 Completed Date: 5/8/2024 Age: From 0 To 5 Total Minutes: 360 Time In: 09:00 AM Time Out: 12:30 PM Time In: 01:30 PM Time Out: 04:00 PM List to Use: Center Type Of Visit: Annual Comp Full Announced/Unannounced: Unannounced OBSERVATIONS SECTION: An unannounced annual compliance visit was conducted at this child care center to monitor compliance with applicable childcare requirements, including compliance with requirements located in Child Care Rule Section .3000 in all child care spaces to include two NC Pre-K classrooms five and six, where children participating in the NC Pre-K program are enrolled. This visit was conducted by Kelly Healy and Emily Lamquaye, Child Care Consultants with Shelby Moody, Center Director. Your program currently operates with a Five Star license. Restrictions include daytime care only, meeting enhanced ratio minus 1, maximum group size of 20 and s/c ratio of 1/10 in NC Pre-K classroom space 5, meets enhanced ratios, meets enhanced space, children under 2 ½ years old in rooms with direct exits only. The license was observed and the restrictions were found in compliance. The NC Secretary of State website was reviewed on 5/07/2024. The program’s compliance history was 93% prior to today’s visit. All programs are required to maintain at least 75% compliance. A walk-through of the facility was completed today. Indoor and outdoor areas were observed. Staff/child ratio and space capacity were monitored as indicated on the attached worksheet. Supervision was adequate during the visit. I observed staff/child interactions today. I observed children playing in activity centers, outdoor play, and routine care. I observed materials and activities that were available to the children in the classrooms. A sanitation inspection was completed 2/27/2024. The last fire inspection was conducted 05/25/2023. Program records and required postings were monitored. A fire drill was conducted on 4/22/2024. A shelter in place drill was documented on 2/25/2024. An outdoor inspection was documented on 5/01/2024. Staff files and children’s records were monitored per DCDEE procedures. Nutrition requirements were monitored per DCDEE procedures. Storage of hazardous items was monitored today. Storage and administration of medication were monitored. Medication authorization was monitored. During today’s visit, there was one group of children, ages three and four, who were on a field trip. Ms. Lamquaye and I told Ms. Moody that we would observe the bus when we returned from lunch, however the bus driver had an emergency and left the site with the bus. The NC Pre-K requirements in section .3000 of the childcare rules were monitored for compliance. Staff-child ratios and maximum sizes required in Child Care Rule 10A NCAC 09 .3009 were verified in compliance. A selection of files was monitored for completed health assessments and developmental screenings. Your program was also monitored for compliance with implementing an approved curriculum as required for all four- and five-star licensed facilities where four-year-old children are enrolled. Your facility uses Creative Curriculum. The center uses the Teaching Strategies Gold instrument to document evidence of children's ongoing progress and documentation was viewed today. You stated that you use Class DOJO to communicate with parents. You stated parent conferences are conducted in addition to home visits, winter and valentine parties, and parent committee meetings. The following violations were cited and corrected during today’s visit: Violation Number Comment Rule 830 A First Aid information sheet was not posted in a place for referral and/or the information sheet did not include all the required information. There was no First Aid Sheet Posted. .0802(h) 892 The center's safe sleep policy was not posted in a prominent place in the infant room where parents and caregivers were able to view daily. There was no Safe Sleep Poster on the wall in two infant rooms. .0606(b) 1899 Health and safety training topics were not included as part of on-going training within five years of completing the previous health and safety training topics. One staff person had not completed all of the Health and Safety trainings by July 1, 2023. .1103(b) 1901 All administrators and staff did not complete a professional development plan within one year of employment, that included all the required information. Several staff persons did not have a date on the Staff Development Plan. .1104(1-5) COMMENTS SECTION: Additional monitoring visits may be conducted during the year to monitor compliance with applicable childcare requirements. Technical assistance discussed during today’s visit. I have reminded Ms. Moody that each Professional Development Plan must be dated. The visit was conducted with Shelby Moody, Director, by Tammy Childress, Lead Child Care Consultant. Currently this facility operates with a Temporary License, issued on August 22, 2023, to operate first shift with a capacity of 90, and to provide care for children ages zero to five years old. Restrictions are daytime care only, and children 2 1/2 years old and younger must be in rooms with direct exits only. The Secretary of State website was checked today, and the owner, 1472 Felicity Lane, LLC, remains current on all required documents and active on the NC Business Registry. If any changes to the business type need to be made or you decide to sale your business, then you must notify your consultant at least thirty days prior to any changes occurring. The license cannot be bought, sold, subleased, transferred to another person or location or inherited. All designated indoor and outdoor spaces for child care were monitored, as well as all staff files that were not reviewed during the visit conducted on October 3, 2023. Children’s files were reviewed on October 3, 2023. All program records and documents required to be posted were monitored. The facility does not provide transportation. There are two separated playgrounds at the back of the facility. Meals are prepared at another child care facility and brought to the center. Children eat all meals in their classrooms. During today’s visit children present were observed to be engaged in group and free choice activities, personal care routines, lunch, and nap. Ms. Moody stated that facility staff use the Foundations curriculum. The following violations were cited today: Violation Number Comment Rule 524 When children 3 years and older were in care, screen time was not used to stimulate a developmental domain; was not limited to 30 minutes a day and no more than a total of two and a half hours per week, per child; and/or was not documented on a cumulative log or the activity plan that is available for review. Screen time was not documented Space 5. .0510(d)(2)(A-C) 1045 New staff, who had contact with children, did not receive at least 16 hrs. orientation within first 6 weeks. A staff member hired on September 26, 2023 had completed 9.5 hours of orientation as of December 14, 2023. .1101(a) All violations must be corrected immediately. You must submit documentation on how each violation was corrected to Ms. Childress by December 27, 2023. The documentation should be submitted by email to Ms. Childress at tammy.childress@dhhs.nc.gov. During today’s visit we again discussed the Rated License Assessment Process and the Environment Rating Scale Assessment. We reviewed the program and education components for a star rated license, how points are earned, and the Environment Rating Scale Assessment. The application for a Star Rated License Assessment and Request for an Environment Rating Scale Assessment was submitted to Ms. Childress and an Environment Rating Scale Assessment has been requested. Continue to prepare for the ERS Assessment by reviewing the Early Childhood Environment Rating Scale (revised edition) booklets, visiting the North Carolina Rated License Assessment Project website at www.ncrlap.org and reviewing resource guides/additional notes/ informational videos and participate in the free online training. Contact information for Smart Start of Forsyth County has been provided to you. Also review resource documents provided to you on October 3, 2023, regarding activities, materials, and recommendation for each age group. During today’s visit we reviewed substantial portion of the day and number of blocks in the block center. Your Temporary License will expire on February 22, 2024, and in order to continue to operate you must be issued a star rated license. In order to continue to participate in the NC Subsidized Child Care Program, you must be issued a license with Three Stars or higher. The Rated License Assessment will include a review of program standards and staff education, along with the quality point earned to determine the final star rating. Technical Assistance: Once the Facility Summary Report with the individual and overall assessments scores is received and all staff education is verified through WORKS a final visit will be conducted to determine the Star Rated License that will be issued. Health and Safety Training All staff must complete Health and Safety Trainings within one year of hire and must be repeated every five years with training certificates on file for review. These trainings can be accessed on the DCDEE website at https://ncchildcare.ncdhhs.gov under the Provider tab from the home screen, select Training and Professional Development, and finally DCDEE Moodle. If you need assistance in locating the trainings, please contact me. It is important to remember that the child care administrator and all staff members must complete the specific Health and Safety Training called “Recognizing and Responding to Suspicions of Child Maltreatment”, within 90 days of employment. This training can be accessed through Moodle or directly at https://www.preventchildabusenc.org/services/trainings-and-professional-development/rrcourse. Orientation For New Staff/ New Staff Files/ CPR/FA and Trainings Health and safety training shall be in addition to the new staff orientation requirements. Orientation topics should be a review of the policies specific to your facility. All staff, including the director, must receive 16 hours of orientation. The orientation form is available on the DCDEE website www.ncchildcare.ncdhhs.gov under provider documents and forms. All documents listed on the staff file checklist must be in staff files and available for review. All CPR/FA training must be in-person by an approved training. Online only CPR/FA courses will not be accepted. On-Going Professional Development If staff complete approved college courses in child development, for every one college credit hour (CEU) completed staff will earn 16 hours of on-going training. All staff must complete the required number of on-going training hours based upon education and experience within one year of hire and annually. The required number of training hours can be determined for each staff member using the information provided in Child Care Rule 10A NCAC 09 .1103. Staff development trainings should include content on the following: Planning a safe, healthy learning environment Steps to advance children's physical and intellectual development Positive ways to support children's social and emotional Strategies to establish productive relationships with families Strategies to manage an effective program operation Maintaining a commitment to professionalism Observing and recording children's behavior Principles of child growth and development Learning activities that promote inclusion of children with special In addition to the required Health and Safety Trainings, staff can access professional development trainings on Moodle under Early Childhood Professional Development in the categories of Child Care and Development Fund (CCDF), Early Educator Support, Licensure, and Professional Development (EESLPD), Foundations and Regulatory. Specifically, under the Regulatory section, I would encourage all staff to complete the training for “Child Care Rule Rollout” which includes a section for the overview of new rules and rule amendments effective July 2023. Staff Development Plan and Annual Evaluation All staff members must complete a Professional Development Plan and receive an annual evaluation within one year of hire. A sample staff development plan is available on the DCDEE website under Provider Documents and Forms. The Staff Development Plan and the annual evaluation are two different requirements. The purpose of the Staff Development Plan is to review staff goals and if these goals have been met, and to set new professional goals each year. The staff evaluation is to review each staff member’s job performance and to identify areas where the staff member is excelling and the areas where performance should be improved. For some areas for improvements that are of a concern regarding the health and safety of children, a specific plan of action should be clearly outlined and show the plan will be monitored. The facility is licensed to provide care to children ages zero to five-years-old and is approved to operate six classrooms within the two connected buildings. Restrictions are daytime care only, children under 3 years old in rooms with direct exits, and no cooking allowed. The Secretary of State website was checked today, and the owner, 1472 Felicity Lane, LLC, is current on all required documents and active on the NC Business Registry. If any changes to the corporation need to be made or you decide to sale your business, then you must notify your consultant at least thirty days prior to any changes occurring. The license cannot be bought, sold, subleased, transferred to another person or location, or inherited. Three classrooms with children ages one to five years old were monitored during the visit. All program records, documents required to be posted, and a sampling of staff and children’s files were monitored. The outdoor learning environment was monitored today. The facility does not provide transportation. Meals are prepared at another child care facility and brought to the center. Children eat all food in the classrooms. During today’s visit children present were observed to be engaged in free choice activities, outdoor play, large group activities, handwashing/restroom, lunch and nap. Children had macaroni and cheese, green peas, mixed fruit and milk for lunch. The following violations were cited during today’s visit: Violation Number Comment Rule 125 Daily records of arrival and departure times for children enrolled at the center were not maintained as children arrive and depart and/or were not made available for review. A child present in Space 2 was not signed in with an arrival time for today. 10A NCAC 09 .0302(d)(4) 614 Bed, cribs, playpens, cots or mats were not placed at least 18" apart or separated by partitions when in use. Cots in spaces 1 and 2 were not at least 18" apart while children were napping, and there was limited space in the classroom to allow for the required spacing. 15A NCAC 18A .2821(e) 721 All equipment and furnishings were not in good repair. A CD/Cassette Player in the music center in Space 2 did not have batteries, was not operable, and a child in the center was attempting to listen to a CD in the player. G.S. 110-91(6); .0601(b) All violations must be corrected immediately. You must submit documentation on how each violation was corrected to Ms. Childress by October 17, 2023. The documentation should be submitted by email to Ms. Childress at tammy.childress@dhhs.nc.gov. Please include in the documentation the facility name and Id#, the date of this visit, date you are writing the correction document. List each item # for each violation, the date it was corrected and how it was corrected. A sample documentation letter was emailed to Ms. Moody during the visit. The child care rules for each violation cited today were reviewed with Ms. Moody. Your compliance history affects the star rating. It is imperative that staff maintain compliance with child care rules and requirements at all times. Violations of child care requirements affect the facility’s compliance history. You must maintain a minimum compliance history of seventy-five (75) percent. During today’s visit we discussed the two-component rated license process to assist the administrator and owners in deciding if they wish to request a Rated License Assessment and an Environment Rating Scale Assessment in order to obtain a 3-5 star rated license. Begin reviewing the Early Childhood Environment Rating Scale (revised edition) booklets, visit the North Carolina Rated License Assessment Project website at www.ncrlap.org and contact your local resource and referral agency for additional resources and technical assistance. The NCRLAP website offers training and additional notes on topics such as activity areas, indoor and outdoor materials, daily schedules, sanitation, and interactions. The application for a Rated License and a request form for the Environment Rating Scale Assessment were provided to Ms. Moody during today’s visit. Please complete and return these forms to Ms. Childress by November 27, 2023. We discussed that she consider the following suggestions: 1.Dramatic Play- ** Consider adding laminated sales papers from grocery stores/coupons, chopsticks, cookbooks with pictures, classroom cookbook with recipes from the children’s families, laminated restaurant menus**. 2.Art: *** Make Art Supplies Accessible, display independent art drawings, projects, play dough, clay, wood, etc., Consider adding chalk, stencils, foam shapes, stamps/ink pads, magazines, etc. 3.Quiet Area: ***Consider adding a small handheld mirror so that children can see their faces change with different emotions, pillows and pictures of the enrolled children with their families.**** 4.Science: **** Consider using a science activity with planting that will add a “living thing” to the classroom- Plant grass, green beans, non-toxic plants, etc., add plastic Other Recommendations/Reminders: •Add children’s 3D (toilet paper rolls/clay) art work •Language interactions are important: have conversations with children while in activity areas about why they made the choices they make (logic/reasoning), encourage communication between children, add details to children’s conversations, talk with children while using computers and iPads about what they are doing. Use positive redirection- speak in the positive as opposed to using words like “no” or “don’t”. •When sanitizing tables use soapy water and sanitizers. Be cautious and do not spray sanitizing solution in the direction of children. •Monitor handwashing closely. The type of Star Rated License issued to your program will result from the points earned in the Program Component (overall score from the ERS Assessments and meeting enhanced ratios and/or space requirements), Staff Education, and a Quality Point. Please ensure that all staff members have a WORKS Account and are updated with their correct educational information. The information on each staff member’s WORKS Qualification Letter and what is shown in the DCDEE WORKS system is what will be used to determine the points in education for your license. Instructions for the DCDEE WORKS system is located in the DCDEE website at https://ncchildcare.ncdhhs.gov. Emergency Preparedness and Response Plan Emergency Preparedness and Response Training has been completed and you must complete an EPR Plan on a template at the following website https://rmp.nc.gov/portal/portal.aspx within four (4) months. A copy of the EPR plan must be printed and on file at the facility for review. After you complete the Emergency Preparedness and Response in Child Care training, you must conduct either a shelter-in-place or a lockdown drill every three months. Use the Emergency Drill Log to document these additional drills as well as the fire drills. The form is located under the Provider Documents tab on the DCDEE website at www.ncchildcare.ncdhhs.gov. The EPR Plan will be reviewed with all staff upon hire during orientation, whenever changes to the plan occur, and at least yearly. The date of the review of the plan with staff should be documented on the Staff and Training Worksheets. In addition, the administrator must review the plan annually in the portal and make updates if required. Once reviewed, print off the first page of the plan which will reflect the date of the review. After you complete the Emergency Preparedness and Response in Child Care training, you must conduct either a shelter-in-place or a lockdown drill every three months. Use the Emergency Drill Log to document these additional drills as well as the fire drills. The form is located under the Provider Documents tab on the DCDEE website at www.ncchildcare.ncdhhs.gov. The EPR Plan will be reviewed with all staff upon hire during orientation, whenever changes to the plan occur, and at least yearly. The date of the review of the plan with staff should be documented on the Staff and Training Worksheets. In addition, the administrator must review the plan annually in the portal and make updates if required. Once reviewed, print off the first page of the plan which will reflect the date of the review. A summary of today’s was reviewed with and provided to Ms. Moody, and she was given the opportunity to ask any questions. The visit was conducted with Shelby Moody, Director, by Tammy Childress, Lead Child Care Consultant. Currently this center operates with a Temporary License, issued on August 22, 2023, to operate first shift with a capacity of 90. The facility is licensed to provide care to children ages zero to five-years-old and is approved to operate six classrooms within the two connected buildings. Restrictions are daytime care only, children under 3 years old in rooms with direct exits, and no cooking allowed. The Secretary of State website was checked today, and the owner, 1472 Felicity Lane, LLC, is current on all required documents and active on the NC Business Registry. If any changes to the corporation need to be made or you decide to sale your business, then you must notify your consultant at least thirty days prior to any changes occurring. The license cannot be bought, sold, subleased, transferred to another person or location, or inherited. Three classrooms with children ages one to five years old were monitored during the visit. All program records, documents required to be posted, and a sampling of staff and children’s files were monitored. The outdoor learning environment was monitored today. The facility does not provide transportation. Meals are prepared at another child care facility and brought to the center. Children eat all food in the classrooms. During today’s visit children present were observed to be engaged in free choice activities, outdoor play, large group activities, handwashing/restroom, lunch and nap. Children had macaroni and cheese, green peas, mixed fruit and milk for lunch. The following violations were cited during today’s visit: Violation Number Comment Rule 125 Daily records of arrival and departure times for children enrolled at the center were not maintained as children arrive and depart and/or were not made available for review. A child present in Space 2 was not signed in with an arrival time for today. 10A NCAC 09 .0302(d)(4) 614 Bed, cribs, playpens, cots or mats were not placed at least 18" apart or separated by partitions when in use. Cots in spaces 1 and 2 were not at least 18" apart while children were napping, and there was limited space in the classroom to allow for the required spacing. 15A NCAC 18A .2821(e) 721 All equipment and furnishings were not in good repair. A CD/Cassette Player in the music center in Space 2 did not have batteries, was not operable, and a child in the center was attempting to listen to a CD in the player.
