J. Rhice, Owner/Operator, assisted me with today’s visit. Your program currently operates with a three-star license, earning 5 points in the education component, 2 points in the program standards component and 1 quality point for serving no more than two infants under age one. One child was observed in care today. The child was observed completing hand washing routines, engaged in free choice play, completing a teacher-directed activity, and interacting with the caregiver. Breakfast consisted of eggs, oranges, and milk. The last annual compliance visit was conducted March 19, 2024. The last fire inspection was conducted January 13, 2025, and your facility was approved for day and night time care. The following violation was documented today. Violation Number Comment Rule 911 Copy of each child's immunization record, including the operator's own preschool child(ren), was not on file. An immunization report was not on file for one school-age child enrolled. GS 110-91(1); .1721(a)(2) The violation documented must be corrected immediately. FIRE INSPECTION REPORT: You gave me the original fire inspection report today. You were informed the fire inspection reports should be sent to me within one week from the date of the inspection. You stated you would ensure the fire inspection is emailed to me as required moving forward. WRITTEN PLAN OF CARE: The written plan of care forms in children files did not include whether you complete routine tasks or not during the times children are in care. I recommend you go through each file and select the appropriate option that applies to your program. You should ensure parents get a copy of the updated form. EMERGENCY PREPAREDNESS AND RESPONSE PLAN (EPR) Based on my review of the EPR plan it was found that the consultant’s information had not been updated. You stated when you reviewed the plan this year; you forgot to change the information for the consultant. I asked you to update the plan to reflect accurate information. Once updated print a copy of the updated pages to add to the plan. CRIMINAL BACKGROUND CHECK REQUIREMENTS: As stated in G.S. 110-90.2 & .2703(r) child care operators are to notify the Division of any new child care providers working who were hired or moved into the child care facility within five business days. The process of notifying the Division has changed and is now captured in ABCMS. This change has been in effect since February 2024. Effective immediately, you will need to obtain a Business NCID and complete Provider Portal training in Moodle at https://www.dcdee.moodle.nc.gov/course/view.php?id=119. No action is needed on your part if you have completed the reference training and are currently using the ABCMS Provider Portal to update information regarding new hires or residents. Once the training has been completed and access has been given, you must verify your facility roster to ensure current staff are noted on the roster. J. Rhice, Owner/Operator assisted with the visit. Two (2) children were observed in care today ranging from ages two to three years old. Children were completing an activity, interacting with the caregivers, completing toileting, and hand washing routines and eating lunch. Lunch consisted of hotdogs on a bun, baked beans, apple sauce and milk. Currently this program operates with a three-Star License earning five points in education, two points in program standards and one quality point for serving no more than two children under age one. The last fire inspection was completed on January 18, 2024. The last annual compliance visit was completed on March 19, 2024. The following violations were documented today. Violation Number Comment Rule 407 Operator was not the person on-site, providing care to children. The operator’s granddaughter (Nykirrah Ingraham) was providing care to children upon arrival. GS 110-91(8) 417 Individual providing care during unplanned absences of the operator, such as medical emergencies, was not at least 21 years of age. The caregiver reported her twenty year old granddaughter (Nykirrah Ingraham) was providing care to children in her absence upon arrival of the visit. 10A NCAC 09.1701(e) 519 Individuals who provide care for less than 5 hours a week, during planned absences of the operator, had not completed first aid and CPR as described in Rule .1702(b)(2). Documentation was not available to verify the individual providing care to children upon arrival completed first aid and CPR training. .1729(b) 1714 The written plan of care did not specify the names of individuals who will be responsible for the care of children when the operator attends to routine tasks. The written plan of care on file and signed by parents did not specify names of individuals who will be responsible for the care of children when the operator attends to routine tasks. .1712(e )(2) 1720 Operator did not give written notice of the written plan of care amendment to parents of all children enrolled, at least 30 days before the change was implemented. STAFF/CHILD INTERACTIONS: Upon entrance of the facility, you had given children an activity book with crayons to complete. You assisted the children periodically with the activity in the booklet. Children washed t heir hands for lunch and was served their meals. You sat at the table and talked with children while they ate. After eating lunch children cleaned up and were taken to the bathroom for toileting. ADDITIONAL CAREGIVER/CARE PROVIDED TO CHILDREN: Upon arrival, you were not home. You and a male arrived shortly after I exited the vehicle and began knocking on the door. You and the male entered the home through the door in the rear of the home. Upon entering the residence, I observed two children standing in the floor. You stated your twenty year old granddaughter was providing care to the children in your absence. You added your granddaughter sometimes care for the children when you must run out. You reported you left to go take someone to work who needed a ride. You shared you were only gone for a short period of time. You stated your granddaughter was an additional caregiver; however, later in the conversation you stated today was the first day she was left alone to care for children. You stated your granddaughter lives in the home with you. When asked, you stated your grandson on site did not live in the home. He went outside the home during the visit. Prior to the end of the visit, I asked that your granddaughter comes out to verify she was present. When the file was requested for your granddaughter, you only provided a criminal background check. You stated you were informed years ago the person left with children only needed the criminal background check qualification. I gave you a copy of the additional caregiver checklist and explained those items were required for an individual to work in the absence of the provider. I further explained that a file must be created and maintained for additional caregiver. You stated Luchina Artis was an assistant/director of your program. You shared she maintain your program’s paperwork. Although a file was provided for Ms. Artis, the criminal background check and CPR/First Aid cards on file were expired. I reminded you all required documentation must remain current and updated. You were advised to request Ms. Artis provide you with updated documentation for her file. WRITTEN PLAN OF CARE: During the visit, I reviewed the written plan of care signed by the parents of the two children present. The written plan of care indicated you would not complete routine tasks while children were in care. Also, no names were listed of individuals who would provide care in your absence. I informed you the written plan of care should be updated and given to parents when changes occur. I added parent should also be notified when someone other than the caregiver provides care to their children. I further explained the revised written plan of care must be given to parents 30 days prior to implementing. I advised you to have a conversation with you parents about the changes and discuss the revisions that will be made to your written plan of care. SAFE ENVIRONMENT: A large jug of hand sanitizer and the operator’s bag of was observed on a shelf accessible to children in the living room designated for child care. Hand washing soap with the label keep out of reach of children was on the sink accessible to children in the bathroom. I informed you items with warning labels should be stored appropriately when not in use. Potentially hazardous items must be inaccessible to children this include the operator’s personal bags/purses. It was suggested conducting periodic safety checks throughout the day to ensure no potentially hazardous items are in spaces where children can reach. You should also read labels to ensure proper storage of items in the child care facility. QUALITY RATING IMPROVEMENT SYSTEM: The Governor signed Senate Bill 425 (now Session Law 2024-34), Health and Human Services Omnibus Bill, which includes the Quality Rating Improvement System (QRIS) Modifications recommended to the Legislature by the NC Child Care Commission to update QRIS and create additional pathways for licensed child care facilities to earn star rated licenses. Hold Harmless provisions have been extended and star rated license assessments for licensed child care providers will be conducted by provider request only, until the QRIS rulemaking process has been completed. Star rated license assessments are still required for new child care programs. This legislation also provides a pathway for child care programs currently accredited through the approved accrediting bodies to move to a 3 or 5 star license if they are not already at this star level. Providers will need to submit a request to their licensing consultant and provide a copy of their accreditation award/certificate for processing: Accreditation Licensure Request Form QRIS UPDATE: GET READY for the 3’s Starting on February 1, 2025, the ECERS-3, ITERS-3, and FCCERS-3—also known as the "3s"—will be used for DCDEE environment rating scale assessments. The DCDEE and the North Carolina Rated License Assessment Project (NCRLAP) are collaboratively working on preparations for the transition to the third editions. These third editions come with a spiral binding at the top, replacing the current revised editions. Visit the NCRLAP’s website for more information about updated resources, credit hour trainings, and outreach assessment opportunities to help you become familiar with these tools. FACILITY PROFILE INFORMATION: You stated the mailing address, phone number and email address listed for your program are correct. STAFF/CHILD INTERACTIONS: Upon entrance of the facility, you had given children an activity book with crayons to complete. You assisted the children periodically with the activity in the booklet. Children washed t heir hands for lunch and was served their meals. You sat at the table and talked with children while they ate. After eating lunch children cleaned up and were taken to the bathroom for toileting. ADDITIONAL CAREGIVER/CARE PROVIDED TO CHILDREN: Upon arrival, you were not home. You and a male arrived shortly after I exited the vehicle and began knocking on the door. You and the male entered the home through the door in the rear of the home. Upon entering the residence, I observed two children standing in the floor. You stated your twenty year old granddaughter was providing care to the children in your absence. You added your granddaughter sometimes care for the children when you must run out. You reported you left to go take someone to work who needed a ride. You shared you were only gone for a short period of time. You stated your granddaughter was an additional caregiver; however, later in the conversation you stated today was the first day she was left alone to care for children. You stated your granddaughter lives in the home with you. When asked, you stated your grandson on site did not live in the home. He went outside the home during the visit. Prior to the end of the visit, I asked that your granddaughter comes out to verify she was present. When the file was requested for your granddaughter, you only provided a criminal background check. You stated you were informed years ago the person left with children only needed the criminal background check qualification. I gave you a copy of the additional caregiver checklist and explained those items were required for an individual to work in the absence of the provider. I further explained that a file must be created and maintained for additional caregiver. You stated Luchina Artis was an assistant/director of your program. You shared she maintain your program’s paperwork. Although a file was provided for Ms. Artis, the criminal background check and CPR/First Aid cards on file were expired. I reminded you all required documentation must remain current and updated. You were advised to request Ms. Artis provide you with updated documentation for her file. WRITTEN PLAN OF CARE: During the visit, I reviewed the written plan of care signed by the parents of the two children present. The written plan of care indicated you would not complete routine tasks while children were in care. Also, no names were listed of individuals who would provide care in your absence. I informed you the written plan of care should be updated and given to parents when changes occur. I added parent should also be notified when someone other than the caregiver provides care to their children. I further explained the revised written plan of care must be given to parents 30 days prior to implementing. I advised you to have a conversation with you parents about the changes and discuss the revisions that will be made to your written plan of care. SAFE ENVIRONMENT: A large jug of hand sanitizer and the operator’s bag of was observed on a shelf accessible to children in the living room designated for child care. Hand washing soap with the label keep out of reach of children was on the sink accessible to children in the bathroom. I informed you items with warning labels should be stored appropriately when not in use. Potentially hazardous items must be inaccessible to children this include the operator’s personal bags/purses. It was suggested conducting periodic safety checks throughout the day to ensure no potentially hazardous items are in spaces where children can reach. You should also read labels to ensure proper storage of items in the child care facility. QUALITY RATING IMPROVEMENT SYSTEM: The Governor signed Senate Bill 425 (now Session Law 2024-34), Health and Human Services Omnibus Bill, which includes the Quality Rating Improvement System (QRIS) Modifications recommended to the Legislature by the NC Child Care Commission to update QRIS and create additional pathways for licensed child care facilities to earn star rated licenses. Hold Harmless provisions have been extended and star rated license assessments for licensed child care providers will be conducted by provider request only, until the QRIS rulemaking process has been completed. Star rated license assessments are still required for new child care programs. This legislation also provides a pathway for child care programs currently accredited through the approved accrediting bodies to move to a 3 or 5 star license if they are not already at this star level. Providers will need to submit a request to their licensing consultant and provide a copy of their accreditation award/certificate for processing: Accreditation Licensure Request Form QRIS UPDATE: GET READY for the 3’s Starting on February 1, 2025, the ECERS-3, ITERS-3, and FCCERS-3—also known as the "3s"—will be used for DCDEE environment rating scale assessments. The DCDEE and the North Carolina Rated License Assessment Project (NCRLAP) are collaboratively working on preparations for the transition to the third editions. These third editions come with a spiral binding at the top, replacing the current revised editions. J. Rhice, owner and operator, was present and assisted with the visit. This family child care home currently operates with a Three-Star license issued on June 5, 2019, earning five (5) points in the Education Component, two (2) points in the Program Component and one (1) Quality point. The last annual compliance visit was conducted on April 4, 2023. The last fire inspection was completed on January 5, 2023. Children were observed napping, reading with their caregiver, and playing in activity centers. Interactions between the caregiver and children were caring and nurturing in nature. The following violations of child care requirements were documented. Violation Number Comment Rule 2055 An individual sleeping space for resting such as a bed, crib, play pen, cot, mat, or sleeping bag with individual linens was not provided for each pre-school age child who was in care for four hours or more, or for all children if overnight care is provided. There was no linen covering nap mats for two (2) children who were napping. 10A NCAC 09 .1718(a)(2) The violations documented above must be corrected immediately. A signed and dated letter of compliance can be mailed or emailed to me and must be received by December 13, 2023. If mailing, you must submit two (2) signed and dated copies. My mailing and email addresses are noted at the bottom. The letter of compliance must detail how the violations were corrected. Please be aware any written information you submit regarding the correction of the violation is legal documentation. STAFF/CHILD INTERACTION Children in care were observed napping. One (1) child was laying quietly but not sleeping. You asked if they would like to read a book and they said yes. You both sat at the table near the front door to read the book. You asked the child questions about the book and discussed drawing one of the pictures from the book, which they wanted to do. The child was then asked to pick a picture from the book and draw it. Another child woke from nap and after waking completely chose to play in block center as you talked with and monitored. I observed a variety of toys, books, and materials available for the children. There are currently no children enrolled who require medication on-site and you continue to not complete routine errands during operational hours. You confirmed that you and your granddaughter listed on the last "Verification for Operator" form. NAPPING & SLEEPING PRACTICES Two (2) of the three (3) children enrolled were napping on mats that did not have linen on them. Child Care Rules require that individual linen be used on mats enrolled children rest/sleep on. Linens must be changed when soiled or at least weekly. Use of clean linens helps decrease spread of some germs, infections and help keep the mat underneath clean. You confirmed that you do have linen for the mats. Ensure they are used at every nap time. RATED LICENSE ASSESSMENT We discussed your progress with the required Three-Month Self-Study which we discussed at the conclusion of your last annual compliance visit. You informed me that you have been working on the Self-Study, but it is not completed. You were reminded that this facility is in cohort two related to resuming the rated license assessment and environmental rating scales (ERS). This means that the preparation year for your facility begins July 1, 2024, through June 30, 2025. The assessment year begins July 1, 2025, through June 30, 2026, and the program must complete the rated license assessment process during that year. Please visit the North Carolina Rated License Assessment Project (NCRLAP) website for informational webinars related to the current process and infographics with information on activities to complete during the preparation year. Ensure that if you have taken additional classes that they are submitted to DCDEE WORKS for evaluation prior to completing the rated license assessment. You may also complete the rated license assessment process prior to your reassessment year as long as the required three (3) month self-study is completed to receive the two (2) points in program standards. TECHNICAL ASSISTANCE & REMINDERS Technical assistance discussed related to creating a schedule for children enrolled on your program’s second shift if you enroll children on that shift. Per the last “Verification for Operator and Additional Caregiver” form completed your second shift is from 3pm – 12am. Continue to ensure that if screen time is offered it must be for children who are three (3) years old or older and the screen time log must be completed. Children younger than three (3) years old must be given an alternate activity and not engage in any screen time. Licensing fee invoices will be emailed out December 1, 2023. Payment must be made online, on the Division website listed below, by December 31st. Please be reminded that failure to pay the license fee is a violation of General Statutes 110-90(1a) and will result in a penalty assessment, accrued interest, and issuance of an Administrative Action. The entire home is licensed for child care and must meet the applicable child care requirements. Although you designated space to be used for child care in one room or a section of the home, the license is issued for the entire location. Monitoring visits may include spaces other than those designated for care. Child care licensing requirements are established to ensure a safe and healthy child care environment. It is your responsibility to maintain compliance with all applicable laws and rules. The best way to do so is to periodically review the child care laws and rules. The current rule book dated July 1, 2023, is available at the DCDEE website listed above. There are also modules of the new Child Care Rules available on Moodle, which can be found on the Division website.
