You, Donna Maldonado, Director, assisted me with the visit. Your program currently operates with a four-star license, issued August 18, 2022, earning 5 points in the education component, 6 points in the program standards and 1 quality point in the programmatic option. Your program was also monitored for compliance with implementing an approved curriculum as required for all four- and five-star licensed facilities where four-year-old children are enrolled. The last annual compliance visit was conducted on February 11, 2025. The last sanitation inspection was conducted on December 2, 2025, and the program received a supervisor classification. The last fire inspection was conducted on January 23, 2026 and the facility was approved for day time care only. The center's compliance history was reviewed with the operator. The program’s compliance history was ninety-three (93) percent as of February 3, 2026. The NC Secretary of State website was reviewed today, and Mustard Seed, LLC was listed as current- active. You visited each licensed space with me. Infants enrolled in space 1 and 2 participated in free play with age-appropriate materials and activities or ate breakfast in the high chairs. Infant feeding schedules were observed, and safe sleep charts were being maintained. Caregivers were on the floor with the infants as they explored their environment, played with toys, and had tummy time. Toddlers and children two year of age in spaces 3 and 4 engaged in free play. Preschool aged children were observed playing in the gymnasium due to active precipitation or engaged in free play in there classroom. Routine toileting and handwashing procedures were monitored, and requirements were met. Staff/child ratios were in compliance in all classrooms. All children were adequately supervised. Caregivers and children interacted in a positive and appropriate manner. Lunch scheduled for today consisted of cheeseburgers, whole grain buns, peaches, French fries, and milk. Staff and Training Worksheets- There were twenty (20) staff members employed at this facility. There were seven (7) new staff; all new staff and a percentage of veteran staff files were reviewed. Health & Safety Training – All staff members who have been employed for at least one year, have completed Health and Safety training as outlined in Child Care Rule 10A NCAC 09 .1102. New staff are in the process of completing these training courses. Health and safety trainings are required to be completed during the first year of employment and renewed every 5 years. Remember, the Recognizing and Responding to Suspicions of Child Maltreatment training must be taken at www.preventchildabusenc.org, within the first 90 days of employment. Completing, refreshing, and updating the required Heath and Safety Training increases your awareness and knowledge regarding child development and safety. Ensure this information in completed, recorded on the required form, and on file for review. The following violations were observed. Violation Number Comment Rule 542 The written feeding plan was not modified as the child's needs changed. An infant in space 1 was observed eating baby food; however, his feeding plan stated he only drinks formula. 10 NCAC 09 .0902(a) 858 Plastic bags, materials that could be torn apart and toy parts small enough to be swallowed were accessible to children under three years of age. Diapers covered in plastic were observed under the diaper changing table in space 4 and accessible to children. .0604(q) 1320 Children's records that include an application for enrollment, medical and immunization records, and permission to seek emergency medical care was not on file for each child. A child, two years of age, had a medical report on file; however, it was not signed by a medical professional. GS 110-91(1);.0302(d)(2); .0304(g) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violations documented may impact the compliance history score. The violations documented must be corrected immediately. On or before February 18, 2026, I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected. Please be aware any information submitted by you is legal documentation. If it is determined the information provided in the letter is not true, this may be considered falsification of information. The best way for you to make sure that you meet all requirements is to periodically review the child care law and rules. Technical Assistance: For the safety of the children, ensure any plastic bags used for storage are kept inaccessible to children under the age of three years old by keeping them at a minimum height of five feet off the floor. Today we discussed administration checking all cabinets for plastic bags at the start of each day. Today we discussed ensuring that the feeding schedules you are using are working for your facility. We discussed ensuring parents or guardians can discuss any changes within the feeding schedule with caregivers before they occur. Once the parents advise a caregiver that there will be changes to the feeding schedule, the feeding schedule will be updated by the parent. Today you stated that the caregivers are instructed to follow the wishes of the parents and that conversations will occur between the caregiver and the parents before there are any changes made to an infant’s feeding. It is important that the plan is updated as soon as the parent or guardian makes any changes. It is also important that the caregivers are following what the feeding schedule states. We also discussed the required information that must be written on the feeding schedule and the frequency that it must be updated. Today all your feeding schedules were up to date and contained all required information. However, we discussed that there will be some times when the schedule might not coincide with the daily request of the parents or guardians. For example, if the feeding schedule states that a child will eat at 8 am, 10 am and 2 pm however the parent or guardian comes in and states that the child just ate at 7:30 am and will not need a bottle for another one and a half hours, the feeding schedule would no longer be accurate. Today we suggested that you use the feeding schedule provided by DCDEE and that is available on the website. This form will ask parents or guardians for the frequency of the feeding instead of the exact time a feeding will be needed. Children's records consist of various documentation such as a child's medical and immunization history, emergency medical care information and parental permission to participate in specific activities. This information is the basis for meeting each child's physical, emotional, cognitive and social needs. Administration needs to ensure that the medical reports are singed by the parent and the health care professional that completed the exam. Reminders: Today we discussed the chipping paint on the walls throughout the facility in addition to the rubber baseboards in space 4 and 6 that has started to pull away from the walls. These concerns need to be addressed to avoid future violations. Other Information Criminal Background Check Information – This is a requirement and if it is not completed, it will be documented as a violation. DCDEE launched the Provider Portal for ABCMS on February 1, 2024. This access will allow providers to see applicants that associate themselves with their facility and allow them to “hire” the applicant to their roster, see the real-time background check status of staff/household members, and run a printable report of the staff roster to assist with compliance visits. You have completed the training and has entered staff. This information should be updated in ABCMS on an ongoing basis as staff members are hired and when their employment is terminated. This satisfies the requirement to notify the Division of new child care providers working who were hired or moved into the child care facility within five business days. The last annual compliance visit was conducted on February 11, 2025. The last sanitation inspection was conducted on December 2, 2025, and the program received a supervisor classification. The last fire inspection was conducted on January 23, 2026 and the facility was approved for day time care only. The center's compliance history was reviewed with the operator. The program’s compliance history was ninety-three (93) percent as of February 3, 2026. The NC Secretary of State website was reviewed today, and Mustard Seed, LLC was listed as current- active. You visited each licensed space with me. Infants enrolled in space 1 and 2 participated in free play with age-appropriate materials and activities or ate breakfast in the high chairs. Infant feeding schedules were observed, and safe sleep charts were being maintained. Caregivers were on the floor with the infants as they explored their environment, played with toys, and had tummy time. Toddlers and children two year of age in spaces 3 and 4 engaged in free play. Preschool aged children were observed playing in the gymnasium due to active precipitation or engaged in free play in there classroom. Routine toileting and handwashing procedures were monitored, and requirements were met. Staff/child ratios were in compliance in all classrooms. All children were adequately supervised. Caregivers and children interacted in a positive and appropriate manner. Lunch scheduled for today consisted of cheeseburgers, whole grain buns, peaches, French fries, and milk. Staff and Training Worksheets- There were twenty (20) staff members employed at this facility. There were seven (7) new staff; all new staff and a percentage of veteran staff files were reviewed. Health & Safety Training – All staff members who have been employed for at least one year, have completed Health and Safety training as outlined in Child Care Rule 10A NCAC 09 .1102. New staff are in the process of completing these training courses. Health and safety trainings are required to be completed during the first year of employment and renewed every 5 years. Remember, the Recognizing and Responding to Suspicions of Child Maltreatment training must be taken at www.preventchildabusenc.org, within the first 90 days of employment. Completing, refreshing, and updating the required Heath and Safety Training increases your awareness and knowledge regarding child development and safety. Ensure this information in completed, recorded on the required form, and on file for review. The following violations were observed. An infant in space 1 was observed eating baby food; however, his feeding plan stated he only drinks formula. 10 NCAC 09 .0902(a) 858 Plastic bags, materials that could be torn apart and toy parts small enough to be swallowed were accessible to children under three years of age. Diapers covered in plastic were observed under the diaper changing table in space 4 and accessible to children. .0604(q) 1320 Children's records that include an application for enrollment, medical and immunization records, and permission to seek emergency medical care was not on file for each child. A child, two years of age, had a medical report on file; however, it was not signed by a medical professional. GS 110-91(1);.0302(d)(2); .0304(g) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violations documented may impact the compliance history score. The violations documented must be corrected immediately. On or before February 18, 2026, I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected. The best way for you to make sure that you meet all requirements is to periodically review the child care law and rules. Technical Assistance: For the safety of the children, ensure any plastic bags used for storage are kept inaccessible to children under the age of three years old by keeping them at a minimum height of five feet off the floor. Today we discussed administration checking all cabinets for plastic bags at the start of each day. Today we discussed ensuring that the feeding schedules you are using are working for your facility. We discussed ensuring parents or guardians can discuss any changes within the feeding schedule with caregivers before they occur. Once the parents advise a caregiver that there will be changes to the feeding schedule, the feeding schedule will be updated by the parent. Today you stated that the caregivers are instructed to follow the wishes of the parents and that conversations will occur between the caregiver and the parents before there are any changes made to an infant’s feeding. It is important that the plan is updated as soon as the parent or guardian makes any changes. It is also important that the caregivers are following what the feeding schedule states. We also discussed the required information that must be written on the feeding schedule and the frequency that it must be updated. Today all your feeding schedules were up to date and contained all required information. However, we discussed that there will be some times when the schedule might not coincide with the daily request of the parents or guardians. For example, if the feeding schedule states that a child will eat at 8 am, 10 am and 2 pm however the parent or guardian comes in and states that the child just ate at 7:30 am and will not need a bottle for another one and a half hours, the feeding schedule would no longer be accurate. Today we suggested that you use the feeding schedule provided by DCDEE and that is available on the website. This form will ask parents or guardians for the frequency of the feeding instead of the exact time a feeding will be needed. Children's records consist of various documentation such as a child's medical and immunization history, emergency medical care information and parental permission to participate in specific activities. This information is the basis for meeting each child's physical, emotional, cognitive and social needs. Administration needs to ensure that the medical reports are singed by the parent and the health care professional that completed the exam. Reminders: Today we discussed the chipping paint on the walls throughout the facility in addition to the rubber baseboards in space 4 and 6 that has started to pull away from the walls. These concerns need to be addressed to avoid future violations. Other Information Criminal Background Check Information – This is a requirement and if it is not completed, it will be documented as a violation. DCDEE launched the Provider Portal for ABCMS on February 1, 2024. This access will allow providers to see applicants that associate themselves with their facility and allow them to “hire” the applicant to their roster, see the real-time background check status of staff/household members, and run a printable report of the staff roster to assist with compliance visits. You have completed the training and has entered staff. This information should be updated in ABCMS on an ongoing basis as staff members are hired and when their employment is terminated. This satisfies the requirement to notify the Division of new child care providers working who were hired or moved into the child care facility within five business days. The gum was also used for gross motor activities since it was raining outdoors. All activity plans were monitored. Proper hand washing techniques and diaper changing procedures were observed. Safe sleep charts and feeding schedules were monitored and found in compliance. Lunch for today was chicken nuggets, mashed potatoes, mac-n-cheese, oranges, and milk. The following violations were documented. Violation Number Comment Rule 106 Operator has not scheduled and obtained a fire inspection within 12 months of the previous inspection. Operator did not submit the original approved report to DCDEE within one week of the inspection visit on a form provided by the Division. The license was posted, and the restrictions were in compliance. A walk-through of the facility was completed today, all indoor and outdoor areas were monitored. I observed children in the indoor learning environments and found supervision and staff/child ratios to be in compliance. Children throughout the facility were participating in group time, free play in activity areas, transitions and personal care routines. Infants were engaged in tummy time, feedings, and diapering routines. Sleep checks were completed, recorded, and maintained as required. The caregivers were interacting and meeting the developmental needs for each of the children. All activity plans aligned with NC Early Childhood Foundations and the activities observed matched the activities listed on the activity plans. Files for new staff were reviewed. Rated license requirements were reviewed to ensure compliance was maintained with current program and education components as well as the quality point. Fire and sanitation inspections remain current. One violation was observed and corrected during the visit. Violation Number Comment Rule 849 Leftover medicines were not returned to the parent after the course of treatment was completed, after authorization was withdrawn or after authorization had expired and/or medication was not discarded within 72 hours of completion of treatment or withdrawal of authorization. Your program was also monitored for compliance with implementing an approved curriculum as required for all four- and five-star licensed facilities where four-year-old children are enrolled. The last annual compliance visit was conducted March 02, 2023. The sanitation inspection was completed June 30, 2023, with a “Superior” classification. The last fire inspection was conducted January 13, 2023, and your facility was approved for daytime care only. On June 12, 2023, a staff member picked up a two-year-old child abruptly and forced the child to sit down on the floor. You visited each indoor and outdoor space with me. Children were enrolled in all licensed indoor spaces. Daily schedules were available for children. Infants in spaces 1 and 2 received care based on individual needs, including diapering, napping, and eating routines. Infants not engaged in routine care were observed moving about the room, playing freely. Feeding schedules and safe sleep checks were monitored and found to be in compliance. One year old children space 3 participated in group time reading books and singing songs. Two-year-old enrolled in space 4 were observed on their playground in free play with ride on toys and slides. Children ages 3-5 in spaces 6 and 7 were observed in their classrooms participating in free play with age-appropriate materials and activities that coincide with their activity plans and aligned with NC Early Childhood Foundations such as modeling doh, puzzles, pretending to cook, and stringing puzzles. Positive interactions and adequate supervision were observed. Lunch planned for today consist of chicken nuggets, green beans, peaches, bread, and milk. There was one violation observed today and must be corrected immediately: Violation Number Comment Rule 849 Leftover medicines were not returned to the parent after the course of treatment was completed, after authorization was withdrawn or after authorization had expired and/or medication was not discarded within 72 hours of completion of treatment or withdrawal of authorization. Technical Assistance: Today technical assistance was given regarding child safety locks. I suggested you review child care rules regarding storage and accessibility of potentially hazardous items as these locks on your bottom cabinets in your classrooms, are not considered locked storage. Items labeled “Keep out of reach of children” with no other warnings must be stored at a minimum of five feet off the floor. Hazardous cleaning supplies, including those kept under pressure in an aerosol can, as well as medications must be kept in locked storage. The definition of locked storage requires that the lock be unlocked with some type of device such as a key or combination. Regular childproofing locks do not meet this requirement. You will need to ensure any items inside these cabinets are not potentially hazardous for children. Rated License Reassessment Information: Your facility’s three-year rated license reassessment is due to be completed in August 2025. As discussed today, reassessments will not become mandatory again until July 1, 2024, and your facility has been placed into “Cohort 3.” Placement in this cohort means you will have from July 1, 2025, to June 30, 2026, to plan and prepare for your reassessment, with your reassessment being due between July 1, 2026, and June 30, 2027.
