In addition, a rated license assessment was also completed to transition your license under the new rated license rules that were effective 7-1-25. I monitored the indoor and outdoor environments for compliance with child care requirements. Staff/child ratios, supervision, use of space and capacity were monitored for compliance. The permit, sanitation, evacuation, safe arrival and departure procedures, first aid chart, menus, activity plan, daily schedule, staff/child ratios, emergency medical care plan, emergency telephone numbers and a summary of NC Child Care Law were all posted at the time of the visit. The storage of medication and hazardous products was also monitored for compliance. No new staff members were hired since the 12-11-25 routine unannounced visit. A sample of existing staff files were reviewed and the information on the Staff and Training worksheets was verified. A sample of children's records were reviewed and the worksheet was completed. The last fire drill was documented as conducted on 4-9-26 at 8:25 am with an evacuation time of six seconds. The last outdoor inspection was documented as conducted on 4-2-26. A shelter in place drill was conduct on 2-24-26 at 7:45 am. An approved fire inspection was completed on 1-13-26. A sanitation inspection was last completed on 3-3-26 with four demerits and a superior classification. The incorporation status of Lil' Ones Child Development Center, LLC was verified as current and active following the visit using the Secretary of State's website. During the visit, the children were observed playing outside and eating lunch, which consisted of ham sandwiches, carrots, peaches, and milk. A rated license assessment was completed during the visit to transition your license. A three star license will be issued based on the following: Continuous Quality Improvement - Individual forms were observed during the visit. You submitted the completed forms for the facility with your rated license application. Family and Community Engagement - I verified that you are meeting all of the standards at the two star level, as well as one additional standard under Engagement and Leadership Options to meet the three star level. Staff Education - Based on the information available in the WORKS Education System, the staff meet the four star level for education. However, you stated that you are not interested in increasing to a four star at this time. Curriculum - You stated that all classrooms are using the Complete Curriculum. Under the new requirements, at the three star level in the Classroom and Instruction Quality Pathway, you must conduct observations of all children in care and share the information with their parent(s) at least once per year. In addition you, as the administrator, must complete five training hours in addition to your on-going training requirement. Please ensure that these requirements are met each year as these two items will be monitored during your annual compliance visits. Upon receipt of your compliance letter, a three star license will be issued and mailed to you. Violation Number Comment Rule 452 Separate outdoor play areas or time schedules were not provided for children under two when 15 or more children were in care. All children, infants to five years of age, were observed on the playground at the same time; sixteen children were present. .0605(c) 1756 Enhanced staff/child ratios and group sizes were not met. Ten children, ages two to five years of age, were present with one staff member on the playground. 10A NCAC 09 .2818 At the time of my arrival for the visit, all of the children were present on one playground. Based on child care rules, when more than fifteen children are present, the children under two must play in a separate area or at a different time. While the children were still outside, you brought one child from space 1 back inside with you, leaving ten children ages two to five outside with one staff member. Based on the enhanced staff/child ratios you agreed to meet, you must maintain a ratio of 1 to 9 when children two years of age are present. You asked if this was a part of the new rated license and I explained that you agreed to meet these ratios when your rated license was initially issued. You also asked if there was not a provision for meeting minimum staff/child ratio requirements when needed and I explained that this was not permitted under child care requirements. If you choose to meet enhanced ratios as a portion of your rated license, you must meet these requirements at all times. When you returned back in the building later in the visit, you brought two children in with you, leaving nine outside with one staff member. Therefore, this item was marked as corrected during the visit. ****Child care licensing requirements are established to ensure a safe and healthy child care environment. Therefore, it is important for you to be knowledgeable of all of the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with all of the applicable laws and rules at all times. Based on information provided and observations made during the visit you continue to meet the requirements previously met to obtain such a license. An email was recently sent to you regarding a return to rated license reassessments. Based on the date of your last assessment, your facility is in cohort 2 of the rated license reassessment process. A planning year has been established beginning July 1, 2024 through June 30, 2025 to allow time for submission of new education information to the WORKS Education Unit and to prepare for Environment Rating Scale assessments should you choose to request that assessments be completed. Your rated license will be reassessed during your reassessment year, which is July 1, 2025 through June 30, 2026. You are not required to wait until this time for a reassessment and can request that your rated license be reassessed at any time. Veggie Straw chips were served as the vegetable for lunch and were planned as the vegetable for Wednesday, June 19. .0901(i) 528 Food substitution was not of comparable food value or recorded on the menu prior to the meal or snack being served. The menu indicated that bologna would be served for lunch; instead ham was served. As we discussed during today's visit, infants and one year old children can only be combined with children one year older unless it is during the first or last operating hour of the day. During your last annual compliance visit, a violation was documented as a three year old child was present with one year old children in this space. You stated that after that visit, it was your understanding that children three years and older could not be placed in that room. However, at the time that visit, there were not children less than one year of age on roll, thus two year old children could be present in the space with the one year old children. Please refer to .0713(a)(5)& (6) for additional information on grouping of infants and toddlers with older children. As we discussed during the visit, these requirements are in place to ensure a safe environment for the youngest children in care and to ensure that all children's needs are met. At the time of the visit, you were present in space 2 with five children ages two and three. Based on the capacity of the space (eleven children) and on enhanced staff child ratios for two year old children (1:9), these two children in space 3 could be moved to space 2 while still maintaining compliance. You did not have an extra staff member to assist with moving the children. Therefore, I explained to the staff member in space 3 that the two children needed to be moved to space 2, stood in the hallway when the children moved while you stood a the door to space 2 and assisted by moving their lunch, mats and diapers from space 3 to space 2. After reviewing your current enrollment, moving these two children to space 2 as required will result in a total of ten children, which is more children than allowable if all children are present based on the 1:9 ratio for two year old children. You currently have the maximum number of children enrolled in space 1 based on capacity of the space (eleven children). As we discussed, you will need to monitor the number of children present in each of these classrooms on a daily basis to ensure that staff child ratios for the youngest child is met and that neither classroom have more than eleven children present at any one time. Please refer to 10A NCAC 09 .0713(f) for additional information on staff/child ratios when combining multiple ages in a child care centers. If you would like to meet these ratios and thus be able to group one and three year old children together, you must submit a written, signed request to do so. A new license would be printed with a restriction indicating your choice to meet these ratios and group children according to the rule. When I inquired about the vegetable component for the meal, you indicated that Veggie Straws would be served. I observed Veggie Straws listed on the lunch menu for today and for Wednesday. Veggie Straws, while made with other vegetables, are no different than potato chips and offer no nutritional value to the children. Two violations pertaining to serving these as a lunch component were documented, including serving items with little or no nutritional value and for not meeting Meal Pattern requirements for lunch as these cannot be served as a vegetable. In addition, a violation was documented as ham was served for lunch rather than bologna as listed on the menu for June 17. Lastly, I observed the staff member in space 1 serving whole milk to the children. Children two years of age and older must be served 1% or skim milk. Whole milk can only be served to children twelve to twenty four months of age. Your rated license will be reassessed during your reassessment year, which is July 1, 2025 through June 30, 2026. Violation Number Comment Rule 106 Operator has not scheduled and obtained a fire inspection within 12 months of the previous inspection. Operator did not submit the original approved report to DCDEE within one week of the inspection visit on a form provided by the Division. A new fire inspection was completed on 1-10-24. Based on the date of the previous inspection, a new inspection was due by 1-5-24. 10A NCAC 09 .0304(a) 316 Children under one year of age were not kept separate from children two years and older. Two two year old children were present in space 3 with three children less than one year of age. 10A NCAC 09 .0713(a)(5) 501 Meals/snacks did not comply with the Meal Patterns for Children in Child Care Programs. Lunch, which was served during the visit, did not contain all of the required components as a vegetable was not served. 10A NCAC 09 .0901(a) 511 Foods and beverages with little or no nutritional value were available often and not just for special occasions. Veggie Straw chips were served as the vegetable for lunch and were planned as the vegetable for Wednesday, June 19. .0901(i) 528 Food substitution was not of comparable food value or recorded on the menu prior to the meal or snack being served. The menu indicated that bologna would be served for lunch; instead ham was served. This substitution was not noted on the menu. 10A NCAC 09 .0901(b) 1791 The child care provider did not provide the required beverage(s). Whole milk was served to four and five year old children, rather than 1% or skim milk as required. .0901(e)(1-7) A violation was documented during the visit as two two year old children were present in space 3 with three children less than one year of age. As we discussed during today's visit, infants and one year old children can only be combined with children one year older unless it is during the first or last operating hour of the day. During your last annual compliance visit, a violation was documented as a three year old child was present with one year old children in this space. You stated that after that visit, it was your understanding that children three years and older could not be placed in that room. However, at the time that visit, there were not children less than one year of age on roll, thus two year old children could be present in the space with the one year old children. Please refer to .0713(a)(5)& (6) for additional information on grouping of infants and toddlers with older children. As we discussed during the visit, these requirements are in place to ensure a safe environment for the youngest children in care and to ensure that all children's needs are met. At the time of the visit, you were present in space 2 with five children ages two and three. Based on the capacity of the space (eleven children) and on enhanced staff child ratios for two year old children (1:9), these two children in space 3 could be moved to space 2 while still maintaining compliance. You did not have an extra staff member to assist with moving the children. Therefore, I explained to the staff member in space 3 that the two children needed to be moved to space 2, stood in the hallway when the children moved while you stood a the door to space 2 and assisted by moving their lunch, mats and diapers from space 3 to space 2. After reviewing your current enrollment, moving these two children to space 2 as required will result in a total of ten children, which is more children than allowable if all children are present based on the 1:9 ratio for two year old children. You currently have the maximum number of children enrolled in space 1 based on capacity of the space (eleven children). As we discussed, you will need to monitor the number of children present in each of these classrooms on a daily basis to ensure that staff child ratios for the youngest child is met and that neither classroom have more than eleven children present at any one time. Please refer to 10A NCAC 09 .0713(f) for additional information on staff/child ratios when combining multiple ages in a child care centers. If you would like to meet these ratios and thus be able to group one and three year old children together, you must submit a written, signed request to do so. A new license would be printed with a restriction indicating your choice to meet these ratios and group children according to the rule. Please note that these ratios are lower than the enhanced staff/child ratios you currently meet. Please contact me if you have questions pertaining to the violation or this child care requirement. Your last fire inspection was completed on 1-5-23; a new inspection was not completed until 1-10-24. A violation was documented for not obtaining an approved fire inspection annually. Please ensure that you contact the inspections office to request that an inspection be completed prior to 1-10-25 to maintain compliance with child care requirements. In addition, please ensure that your inspection is submitted to me by email within seven days of completion. While I was in space 2, you were serving lunch to the children. When I inquired about the vegetable component for the meal, you indicated that Veggie Straws would be served. I observed Veggie Straws listed on the lunch menu for today and for Wednesday. Veggie Straws, while made with other vegetables, are no different than potato chips and offer no nutritional value to the children. Two violations pertaining to serving these as a lunch component were documented, including serving items with little or no nutritional value and for not meeting Meal Pattern requirements for lunch as these cannot be served as a vegetable. In addition, a violation was documented as ham was served for lunch rather than bologna as listed on the menu for June 17. Lastly, I observed the staff member in space 1 serving whole milk to the children. Children two years of age and older must be served 1% or skim milk. Whole milk can only be served to children twelve to twenty four months of age. A follow up visit may be conducted in the near future to monitor compliance with child care requirements. ****Child care licensing requirements are established to ensure a safe and healthy child care environment. I monitored the indoor and outdoor environments for compliance with child care requirements. Staff/child ratios, supervision, use of space and capacity were monitored for compliance. The permit, sanitation, evacuation, safe arrival and departure procedures, first aid chart, menus, activity plan, daily schedule, staff/child ratios, emergency medical care plan, emergency telephone numbers and a summary of NC Child Care Law were all posted at the time of the visit. The storage of medication and hazardous products was also monitored for compliance. No new staff members were hired since the 3-28-23 routine unannounced visit. A sample of existing staff files were reviewed and the information on the Staff and Training worksheets was verified. A sample of children's records were reviewed and the worksheet was completed. The last fire drill was documented as conducted on 7-11-23 at 8:30 am with an evacuation time of twenty one seconds. The last outdoor inspection was documented as conducted on 7-5-23. A lockdown drill was conduct on 5-12-23 at 9:22 am. An approved fire inspection was completed on 1-5-23. A sanitation inspection was last completed on 2-3-23 with zero demerits and a superior classification. The incorporation status of Lil' Ones Child Development Center, LLC was verified as current and active following the visit using the Secretary of State's website. During the visit, the children were observed during naptime. A meal or snack was not observed during the visit. A three star child care center with four points in education, two points in program standards and one quality point was issued on 11-12-19. Based on information provided and observations made during the visit you continue to meet the requirements previously met to obtain such a license.
