Name of Operation: MARIAM BOYD ELEMENTARY PRE-K Facility ID: 93000104 Consultant: APRIL FLEMING Operation Type: Center Case Number: Visit Date: 11/19/2025 Number Present: 23 Completed Date: 11/19/2025 Age: From 4 To 5 Total Minutes: 195 Time In: 10:15 AM Time Out: 01:30 PM Time In: Time Out: List to Use: Center Type Of Visit: Annual Comp Full Announced/Unannounced: Unannounced The purpose of my unannounced annual compliance visit was to monitor this program for compliance with applicable child care requirements and to provide technical assistance on the QRIS Pathway to the Stars. Currently this facility operates with a Five-Star License, issued August 12, 2025. The last annual compliance visit was conducted on December 4, 2024. A checklist was used to note the requirements monitored during the visit. The last sanitation inspection was completed on November 6, 2025, earning a superior classification and three (3) demerits. The last satisfactory fire inspection was completed on September 16, 2025, and was approved for day care only. Nicole Baker, NC PreK Coordinator, and S. Tunstall, Lead Teacher, was present and available to assist. Twenty-three (23) children were present. Children were observed during free choice play, teacher directed activities and outdoor play. Staff interacted with children in a positive manner. Fire drills, lockdown/shelter in place and playground inspections were current. Offsite forms for staff and transportation were observed. This program is owned and operated by Warren County Public Schools The following violations of child care requirements were documented during the visit. Violation Number Comment Rule 125 Daily records of arrival and departure times for children at the center were not maintained as children arrive and depart and/or were not made available for review. Departure times for children were not maintained as they departed daily. 10A NCAC 09 .0302(d)(4) 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. A can of Lysol was not stored in a locked cabinet in space 110. .2820(b) 1035 Child care providers, including the director, uncompensated providers, substitute providers, and volunteers did not have the required Emergency Information Form on file on or before the first day of work, which included all the required information and/or the information on the form was not updated as changes occur and at least annually. Three staff, including a substitute provider did not have the required updated Emergency Information form on file for review. .0701(a) 1874 The Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy was not reviewed with new staff prior to providing care with children and/or a signed acknowledgement with all the required information was not maintained in the staff person's file. A signed acknowledgement was not maintained in two staff person's file. .0608(d)(1-4) The following violation must be corrected immediately. The letter must describe, in detail, specifically how each violation has been corrected and any supporting documents. Compliance History: Prior to today's visit, this facility maintained an 18-month compliance score of 97%. CONSULTATION/TECHNICAL ASSISTANCE CHILDREN AND STAFF RECORDS: Ten percent (10%) or more of children’s records were monitored. Children records reviewed, were in compliance. All staff files were monitored. Staff records reviewed were not in compliance. Two staff did not maintain a sign acknowledgement for Prevention of Shaken Baby Syndrome and Abusive head trauma. This was corrected during the visit when staff signed the form. Three staff, including a substitute, did not have the required emergency information form available for review. This was corrected during the visit when staff completed the form. ANNUAL LICENSE FEE: Keep an eye on your email inbox for the 2025 Annual License Fee invoice. Invoices will be emailed to the facility email address at the beginning of November. Since the invoice number changes each year, you will need to ensure the invoice number you are paying begins with 25. Online payments are due by December 3, 2025. License fees are paid online only, and paper checks are not accepted for payment. Licensed child care facilities are assessed as an annual license fee. The amount of your annual license fee is based on the licensed capacity printed on your license as of October 1, 2025, not the number of children enrolled at your facility. ARRIVAL AND DEPARTURE TIMES: As children arrive and depart, times in and out should be maintained. Children departure times were not observed for several children when monitoring records over the last month. HAZARDOUS ITEMS: A can of Lysol spray was observed in space 110 on a shelf out of reach of the children. However, any product which is under pressure in an aerosol dispenser should be stored in a locked room or cabinet. This was corrected during the visit when the teacher locked the Lysol in a locked cabinet. As a reference and guide, I would encourage each class to print and post the “hazardous items storage” form from our website under provider documents and forms. CRIMINAL BACKGROUND APPLICATIONS: A New feature links criminal background applications to facilities. The training has been completed, and staff were observed on the roster. Any staff that’s not on the roster should be linked immediately. CLEAN WATER FOR US KIDS: The Clean Water for Carolina Kids status is “section complete”. The lead base paint status is “waiting for onsite visit results” and status for asbestos is “survey review by RTI”. You should log into your account and or contact clean water to ensure all steps are completed and what needs to be done to have a completion status. This information was verified in the clean water for US kids facility data. STAR RATED LICENSE (SRL)/QRIS: During today’s visit an overview of section .3200 of the child care rules was provided to Mrs Baker. Each of the following pathway options were discussed: Program Assessment Pathway, Classroom and Instructional Quality Pathway, and Accreditation and Head Start Pathway. Mrs. Baker asked if we could continue our discussion at a later time. A copy of the conversation overview will be emailed to Mrs. Baker. The last sanitation inspection was completed on December 12, 2024, earning a superior classification and two (2) demerits. The last satisfactory fire inspection was completed on September 4, 2024. Children were observed during free choice play, daily routines, preparing for lunch and during outdoor play. Staff interacted with children in a positive manner. A safe outdoor environment was not provided for the children in care. A hornet's nest was beneath the playscape on the playground. 10A NCAC 09 .0601(a) 859 Monthly playground inspections were not completed and/or they were not completed by an individual trained in playground safety requirements. Monthly inspections were not available for review. .0605(q) 1811 Shelter-in-place or lockdown drills were not practiced every three months and/or drill record was incomplete. TECHNICAL ASSISTANCE/WHAT’S NEW/CONSULTATION A staff member hired December 14, 2024, record was reviewed and found in compliance. and ten percent (10%) of existing staff records were monitored. OUTDOOR ENVRIOMENT: The outdoor environment should be checked daily before the children go out. A hornet’s nest was under the play scape. This was corrected during the visit when the maintenance removed the nest. CRIMINIAL BACKGROUND APPLICATIONS: A New feature links criminal background applications to facilities. North Carolina child care administrators can now view and edit their facility’s staff roster in ABCMS, the DCDEE’s criminal background check system. This feature was observed being implemented. Staff that are not linked should be linked to the facility. A copy of the instructions was given to Nicole Baker, PreK Coordinator. CLEAN WATER FOR US KIDS: The Clean Water for Carolina Kids status for lead in water is “section complete”. For the lead base paint and asbestos, the status is “enrollment started”. N. Baker logged into the account and contacted Clean Water to receive clarification on what is needed for completion. This information was verified in the clean water for US kids facility data. STAR RATED LICENSE (SRL)/QRIS: Hold harmless has been extended until the new QRIS is implemented (SB 425). The center's last annual compliance visit was completed on January 11, 2023. The last sanitation inspection was completed on April 22, 2024 earning a “Superior” classification and “0” demerits. The last satisfactory fire inspection was completed on September 4, 2024 and was approved for day care. The administrator L. Davis was present onsite today during the visit. T. McEhinney Lead Teacher assisted during the visit. Currently this center operates with a Five Star License, issued August 2, 2019, earning 7 points in the Education Component, 7 points in the Program Component and 1 Quality point using the Education Option that 75% of all lead teachers have a AAS degree or higher in Early Childhood Education or Child Development. This program consists of two (2) NC Pre-K classrooms, located on a public -school campus owned and operated by the Warren County School System. I observed the children playing in activity centers, participating in routines in the classroom, preparing for lunch, and handwashing and toileting procedures. Lunch consisted of: Filet of chicken on bun, sweet potato waffles, fruit, and milk. Teachers were nurturing and warm and responded to the children’s needs. The following violations were documented today: Violation Number Comment Rule 106 Operator has not scheduled and obtained a fire inspection within 12 months of the previous inspection. Operator did not submit the original approved report to DCDEE within one week of the inspection visit on a form provided by the Division. NEW CRIMINAL BACKGROUND CHECK LEGISLATIVE CHANGES: The 2022-2023 Appropriations Bill (HB 103) signed by Governor Cooper on July 11, 2022, made two important changes to North Carolina General Statute 110-90-2 regarding child care Criminal Background Checks. • The period for background check qualification renewals was revised from three years to five years. • The provisional qualification period was reduced to forty-five days. The Division intends to implement these changes as soon as possible. An individual’s current Qualification Letter will be extended 2 years for the total of 5 years. New Qualification Letters will not be generated. Individuals with a Provisional Qualification Letter will receive a Qualification Letter on the 45th day. Letters are generated in the Criminal Background Check portal. HEALTH AND SAFETY TRAININGS: Health and safety trainings are due every five (5) years. If any staff completed trainings in 2017, trainings will be due this year, 2022. I encourage staff to be intentional and start completing trainings. Health and safety trainings are now on MOODLE. There are a couple of ways for a student to access the health and safety training. • The enrollment process and completion of course materials tend to work best with a windows laptop or desktop using Firefox, but other devices and Google Chrome should also work. • From the Moodle home page, students need to log-in with their NCID and password. The log-in is in the upper right corner of the screen. • After log-in, the student should scroll to the bottom of the page. In the ‘Search courses’ box, the student should type in the short name “Year 2023 CCDF” and then click go. The student should not register for prior year courses as they are no longer available. • After completing the course search for “Year 2023 CCDF”, the student should be able to register for the course. • Once registered, the student will then need to use the “ADDITIONAL DIRECTIONS” for step-by-step instructions. Should a student encounter an issue, we are requesting they report the CCDF 2023 course issue (i.e. they are unable to complete the course evaluation or receive a training certificate), to the North Carolina Child Care Health and Safety Resource Center using the following link https://healthychildcare.unc.edu/contact-us-form/. N.C. Exemptions North Carolina law provides for two types of exemptions from required immunizations. They are medical and religious. Medical Exemption G.S.130A-156. Medical exemption. The Commission for Public Health shall adopt by rule medical contraindications to immunizations required by G.S. 130A-152. If a physician licensed to practice medicine in this State certifies that a required immunization is or may be detrimental to a person's health due to the presence of one of the contraindications adopted by the Commission, the person is not required to receive the specified immunization as long as the contraindication persists. The State Health Director may, upon request by a physician licensed to practice medicine in this State, grant a medical exemption to a required immunization for a contraindication not on the list adopted by the Commission. Medical exemptions can only be requested by a physician licensed to practice medicine in North Carolina. Religious Exemption G.S.130A-157. Religious exemption If the bona fide religious beliefs of an adult or the parent, guardian or person in loco parentis of a child are contrary to the immunization requirements contained in this Part, the adult or the child shall be exempt from the requirements. Upon submission of a written statement of the bona fide religious beliefs and opposition to the immunization requirements, the person may attend the college, university, school or facility without presenting a certificate of immunization. There is no form for requesting religious exemptions in North Carolina. To claim a religious exemption, the parent or person requesting the exemption must write a statement of their religious objection to immunization, including the name and date of birth of the person for whom the exemption is being requested. This statement would then be provided to schools, child care programs, camps, etc. in place of an immunization record. If a family is requesting a religious exemption for more than one child, a separate statement should be prepared for each child. Statements of religious objection to immunization do not need to be notarized, signed by a religious leader, or prepared by an attorney. They do not need to be submitted to the state for review or approval. Personal Belief 10A NCAC 41A .0403 Non-Religious Personal Belief No Exemption: Except as provided in G.S. 130A-156 and G.S. 130A-157, and 10A NCAC 41A .0404 and .0405, no child shall be exempt from the requirements of 10A NCAC 41 .0401; there is no exception to these requirements for the case of a personal belief or philosophy of a parent or guardian not founded upon a religious belief.
