Upon arrival I was greeted by Ms. C. Walker, Administrator of the facility, and accompanied me on the walk-through and assisted with today’s visit. The group size, supervision, ratio, capacity and approved space were in compliance. The restrictions, license and emergency care plan were posted. First Aid/CPR, storage of hazardous materials and the NC Child Care Summary of the Law was posted. I monitored the program requirements, furnishings and equipment, outdoor area, and medications. The preschool children were observed playing in their classrooms. You stated you had combined total of six infants in space 6 with two staff members since you had low enrollment today. This is reflected on the children’s enrollment worksheet. The school-aged children were not present during the time of the visit. During the visit you stated you had hired four new staff members since my last visit. The staff and training worksheet was completed for the four new staff members and they were in compliance. Today you updated your legal designee form. The lunch menu meets the meal pattern requirements. This program currently operates with a Letter of Compliance issued 8/14/09. Your last fire drill was completed 1/23/26. Your last documented monthly outdoor playground inspection was dated 11/24/25 and a violation was documented. Your last EPR drill was a lockdown completed 11/29/25. I reminded you that an EPR drill must be completed every three months. Please keep all documentation on file for review. Your last fire inspection was dated 1/2/26 and prior to the visit I received the copy. Your last sanitation inspection was completed on 11/05/25 with a superior rating and 0 demerits. Please contact Environmental Health and your local fire inspector within 30 days of the due date to request an inspection to be completed. Once your inspections have been completed, mail or email them to me. I recommend that you place your due dates on a calendar or spreadsheet to help you maintain compliance. The following violations were documented and corrected during the visit. Violation Number Comment Rule 115 A summary of the NC Child Care Law was not posted in a prominent place in the center. The most recent updated copy of the NC Child Care Law was not posted. G.S. 110-102 533 Human milk, formula and other bottled beverages including sippy cups, sent from child's home were not fully prepared, dated, and labeled for the appropriate child. One infant's bottle in the refrigerator was not labeled or dated. 15A NCAC 18A .2804(d) 859 Monthly playground inspections were not completed and/or they were not completed by an individual trained in playground safety requirements. The last monthly playground documented on file was dated 11/24/25. .0605(q) Childcare licensing requirements are established to ensure a safe and healthy childcare environment. Therefore, it is important for you to be knowledgeable of all of the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with all of the applicable laws and rules at all times. During today’s visit I completed a walk-through of the facility with the Administrator C. Walker. The group size, supervision, ratio, capacity, and approved space were in compliance. The restrictions, Notice of Compliance and emergency care plan were posted. First Aid/CPR, storage of hazardous materials and the NC Child Care Summary of the Law were posted. I monitored the program requirements, furnishings, equipment and medications. The preschool children were observed playing outside and in activity areas in their classrooms. The school aged children were observed playing board games in their classroom. The infants were observed during tummy time with 2 staff members. The theme was art activities for Father’s Day. The lunch menu consisted of barbecue chicken, potatoes, cooked apples, rolls, and milk. This program currently operates with a Letter of Compliance issued 8/14/09. CBC Provider Portal Technical Assistance & Notification to the Division of New Hires or Residents Technical Assistance Guidance As stated in G.S. 110-90.2 & .2703(r) child care operators are to notify the Division of any new child care providers working who were hired or moved into the child care facility within five business days. The process of notifying the Division has changed and is now captured in ABCMS. This change has been in effect since February 2024. Effective immediately, you will need to obtain a Business NCID and complete Provider Portal training in Moodle at https://www.dcdee.moodle.nc.gov/course/view.php?id=119. No action is needed on your part if you have completed the reference training and are currently using the ABCMS Provider Portal to update information regarding new hires or residents. Once the training has been completed and access has been given, you must verify your facility roster to ensure current staff are noted on the roster. This information should be updated in ABCMS in an ongoing basis as staff members are hired and when their employment is terminated. Name of Operation: DAY CARE AT PINHOOK Facility ID: 31000173 Consultant: TERAESA LEAK Operation Type: Center Case Number: 0325-042L Visit Date: 3/10/2025 Number Present: 50 Completed Date: 3/10/2025 Age: From 0 To 5 Total Minutes: 330 Time In: 10:00 AM Time Out: 03:30 PM Time In: Time Out: List to Use: Center Type Of Visit: Complaint Visit Announced/Unannounced: Unannounced The purpose of today's unannounced visit was to investigate a complaint report received by the Division of Child Development and Early Education (DCDEE) received on March 4, 2025 alleging violations of the child care requirements. Tanya Herring, Licensing Consultant, accompanied me during today’s visit. Upon our arrival, we were greeted by the administrator, Ms. C. Walker. We were accompanied as we completed a general walk-through of the indoor and outdoor environment. There were a total of fifty (50) children present. Children were observed during free play, teacher directed activities, and completing routine tasks. Limited monitoring of the child care requirements occurred during today’s visit. The Notice of Compliance was posted. The allegations are as follows: -A concern that children were cared for in an unsafe environment -A concern that a staff member falsified records During today’s visit, the allegations were shared with Ms. Walker and she was given an opportunity to share her perspective surrounding the allegations. In addition, we interviewed six (6) staff members who may have knowledge surrounding the allegations. We monitored a total of two (2) staff files, two (2) children’s records and a sample of program records. The information obtained during today’s visit is as follows: On the morning of February 27, 2025, two caregivers working in the classroom designated for infants were involved in a verbal dispute regarding scheduling and the completion of paperwork in the classroom, such as attendance records. Following the dispute, witnesses observed one caregiver in the hallway just outside of the classroom designated for infants, crying and visibly upset, making statements that the other teacher “assaulted” her. Witnesses state that no one observed what occurred in the classroom prior to the exchange that occurred in the hallway, but that the exchange in the hallway was loud and in the presence of children. The infants were heard crying shortly after the exchange. Witnesses state that following the incident, the caregiver that made the allegation was not seen for the rest of the day and not again until noon the following day. According to Ms. Walker, the caregiver inquired about what disciplinary actions would follow after her allegations. When Ms. Walker explained that she was not prepared to make a decision, the caregiver submitted her two week notice. Ms. Walker stated that she did not return to work at the facility. There was no evidence of any falsified records observed during today’s visit. Therefore, based on observations and statements made by staff, the allegation regarding children being cared for in an unsafe environment is SUBSTANTIATED. However, the allegation regarding a staff member falsifying records is UNSUBSTANTATIATED. The following violations were cited during today’s visit: Violation Number Comment Rule 428 A current activity plan was not posted for each group of children for reference. A current activity plan was not posted in space 6 and space 8. GS 110-91(12); .0508(a) 526 Menus for all meals and snacks were not current or posted where easily seen by parents and cook. Current menus were not posted in spaces 4, 6 and 7. 10A NCAC 09 .0901(b) 608 Children did not wash their hands upon arrival at the center, after each visit to the toilet, before eating, before and after water activity play, after outside play, and after handling animals or animal cages. A child's hands were not washed prior to being placed in a high chair and given a snack. 15A NCAC 18A .2803(c) 807 A safe indoor and outdoor environment was not provided for the children. On February 27, 2025, two staff members were involved in verbal dispute that included yelling and screaming. The dispute occurred in the presence of children. 10A NCAC 09 .0601(a) 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. In space 6, a container of saline solution dispensed from an aerosol can was stored in an unlocked medicine box. In space 7, a can of Lysol air freshener, Clorox wipes and Spic & Span all purpose cleaner were stored in an unlocked cabinet. .2820(b) 871 Center staff did not comply with the safe sleep policy. An infant under the age of 12 months was left in a swing to sleep. 10A NCAC 09 .0606(a) 887 Caregivers did not document compliance with visually checking on sleeping infants aged 12 months or younger and/or the documents were not maintained for a minimum of one month. Documentation with visually checking on sleeping infants aged 12 months or younger was not completed for one child. .0606(g) 892 The center's safe sleep policy was not posted in a prominent place in the infant room where parents and caregivers were able to view daily. The center's adopted safe sleep policy was not posted in the classroom designated for infants as required by the rule. .0606(b) 1045 New staff, who had contact with children, did not receive at least 16 hrs. orientation within first 6 weeks. An employee with a hire date of January 8, 2025 did not receive 16 hours of orientation as required by the rule. .1101(a) 1301 Center did not maintain a record of daily attendance. Daily attendance was not completed in the space designated for infants. GS 110-91(9) 9999 A violation was found for which there is no item number. In space 4, an open bag of animal crackers were not stored in an air tight container. In order to comply with the NC Laws and Rules, any violations cited today must be corrected immediately. A compliance letter must be sent to me by March 24, 2025. The letter must address each violation explain how it has been corrected and how compliance will be maintained in the future. If the letter is not received by the date listed a return visit will be made to the child care center. Please send this to Teraesa.leak@dhhs.nc.gov and include the following: *Facility name *Facility ID number *Each item number The allegations and subsequent violations are serious in nature as they directly impact the health and safety of children. As a result, the DCDEE may take an Administrative Action against the facility. You will receive written notification should this occur. In addition, routine monitoring visits may occur to ensure ongoing compliance with the child care requirements. TECHNICAL ASSISTANCE: All medications, personal items such as purses and bookbags, and products that are hazardous to children must be locked. This includes any product dispensed from an aerosol can. I informed staff during today’s visit that only locks requiring a combination, key or magnet meet the requirements for locked storage. Please remember that leaving the key in the lock does not meet the requirements. Orientation for new staff is crucial to the success of the child care program. It should include all the required trainings, a thorough review of policies and procedures, and the completion of all necessary paperwork. This ensures that new employees are well-prepared, informed, and equipped to contribute effectively to the program. A copy of the adopted safe sleep policy is not posted in the classroom designated for infants as required by the rule. Prior to the enrollment of infants under 12 months of age, please ensure that the policy addresses each of the questions asked, has an effective date and is reviewed with each family prior to placing in the children’s file. Safe sleep logs are required to be completed every fifteen (15) minutes and documented on the individual child’s safe sleep log. Infants under 12 months of age are prohibited from sleeping in sitting devices, including car safety seats, strollers, swings, and infant carriers. Infants that fall asleep in sitting devices shall be moved to a crib, bassinet, play pen, mat, or cot. Upon our arrival to the facility, we were accompanied to the infant room where we observed an infant asleep in a swing. The caregiver was instructed to move the child to her crib. A violation was noted and technical assistance was offered. However, prior to the conclusion of today’s visit, all five (5) children in the classroom designated for infants were observed sound asleep in bouncy seats and/or swings. Four (4) of the children are under 12 months old. We again reminded the caregiver, I. Sholar, that the infants that fall asleep in a sitting device must be moved to their assigned cribs. We were accompanied as we completed a general walk-through of the indoor and outdoor environment. There were a total of fifty (50) children present. Children were observed during free play, teacher directed activities, and completing routine tasks. Limited monitoring of the child care requirements occurred during today’s visit. The Notice of Compliance was posted. The allegations are as follows: -A concern that children were cared for in an unsafe environment -A concern that a staff member falsified records During today’s visit, the allegations were shared with Ms. Walker and she was given an opportunity to share her perspective surrounding the allegations. In addition, we interviewed six (6) staff members who may have knowledge surrounding the allegations. We monitored a total of two (2) staff files, two (2) children’s records and a sample of program records. The information obtained during today’s visit is as follows: On the morning of February 27, 2025, two caregivers working in the classroom designated for infants were involved in a verbal dispute regarding scheduling and the completion of paperwork in the classroom, such as attendance records. Following the dispute, witnesses observed one caregiver in the hallway just outside of the classroom designated for infants, crying and visibly upset, making statements that the other teacher “assaulted” her. Witnesses state that no one observed what occurred in the classroom prior to the exchange that occurred in the hallway, but that the exchange in the hallway was loud and in the presence of children. The infants were heard crying shortly after the exchange. Witnesses state that following the incident, the caregiver that made the allegation was not seen for the rest of the day and not again until noon the following day. According to Ms. Walker, the caregiver inquired about what disciplinary actions would follow after her allegations. When Ms. Walker explained that she was not prepared to make a decision, the caregiver submitted her two week notice. Ms. Walker stated that she did not return to work at the facility. There was no evidence of any falsified records observed during today’s visit. Therefore, based on observations and statements made by staff, the allegation regarding children being cared for in an unsafe environment is SUBSTANTIATED. However, the allegation regarding a staff member falsifying records is UNSUBSTANTATIATED. Please remember that leaving the key in the lock does not meet the requirements. Orientation for new staff is crucial to the success of the child care program. It should include all the required trainings, a thorough review of policies and procedures, and the completion of all necessary paperwork. This ensures that new employees are well-prepared, informed, and equipped to contribute effectively to the program. A copy of the adopted safe sleep policy is not posted in the classroom designated for infants as required by the rule. Prior to the enrollment of infants under 12 months of age, please ensure that the policy addresses each of the questions asked, has an effective date and is reviewed with each family prior to placing in the children’s file. Safe sleep logs are required to be completed every fifteen (15) minutes and documented on the individual child’s safe sleep log. Infants under 12 months of age are prohibited from sleeping in sitting devices, including car safety seats, strollers, swings, and infant carriers. Infants that fall asleep in sitting devices shall be moved to a crib, bassinet, play pen, mat, or cot. Upon our arrival to the facility, we were accompanied to the infant room where we observed an infant asleep in a swing. The caregiver was instructed to move the child to her crib. A violation was noted and technical assistance was offered. However, prior to the conclusion of today’s visit, all five (5) children in the classroom designated for infants were observed sound asleep in bouncy seats and/or swings. Four (4) of the children are under 12 months old. We again reminded the caregiver, I. Sholar, that the infants that fall asleep in a sitting device must be moved to their assigned cribs. Upon arrival I was greeted by Ms. Runyon, the teacher for school-aged children, who stated she would contact the Administrator, Ms. Walker and let her know I was present. Ms. Runyon stated the Administrator; Ms. Walker was on her way to the facility. The Administrator arrived shortly and accompanied me on the walk-through and assisted with today’s visit. The group size, supervision, ratio, capacity and approved space were in compliance. The restrictions, license and emergency care plan were posted. First Aid/CPR, storage of hazardous materials and the NC Child Care Summary of the Law was posted. I monitored the program requirements, furnishings and equipment, outdoor area, and medications. One infant was observed sleeping in a crib on its back and one infant was being held and fed by a staff member. The other infants were observed playing with toys on the soft cushion area with a staff member. The two groups of toddlers were observed playing in activity areas inside their classrooms. The two- year- old children were observed during morning group time. There are two classrooms of preschool children one was observed playing in activity areas, while the other preschool group was observed during morning group time. The school-aged children were not present during the time of the visit. The lunch menu for today consisted of macaroni with cheese, ham, string beans, mandarin oranges or pineapple, and milk. This program currently operates with a Letter of Compliance issued 8/14/09. Your last fire drill was completed, 1/31/25 and your last monthly outdoor playground inspection was dated 1/31/25. Your last EPR drill was a lockdown completed 11/27/24. You stated you have another EPR drill scheduled for February 2025. I reminded you that an EPR drill must be completed every three months. Please keep all documentation on file for review. Your last fire inspection was dated 1/3/25 and prior to the visit I had received the copy. Your last sanitation inspection was completed 12/10/24 with a superior rating and 0 demerits. Please contact Environmental Health and your local fire inspector within 30 days of the due date to request an inspection to be completed. Once your inspections have been completed, mail or email them to me. I recommend that you place your due dates on a calendar or spreadsheet to help you maintain compliance. Two bottles in the infant room refrigerator were labled with a date of 2/11/25 and they were removed. 15A NCAC 18A .2804(d) Childcare licensing requirements are established to ensure a safe and healthy childcare environment. Therefore, it is important for you to be knowledgeable of all of the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with all of the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the childcare law and rules. Technical assistance regarding the following items were reviewed with you today. All flexibilities expired, except for the flexibilities related to the star rated license. During today's visit we reviewed the importance of staff checking to make sure the infants bottles brought from home are labeled and dated daily. You stated the parents prepare and date the bottles and you will remind your staff to double check the bottles each morning for labeling and correct dates. I reminded you the health and safety trainings have been relocated from Pro-Solutions to Moodle on the DCDEE website and they are free of charge. I discussed various other training resources, including those online and in-person. Remember continuing professional development training provides you and your staff with the knowledge and skills needed to provide a quality child care program. Please be reminded the health and safety training courses are required to be completed every five years. CBC Provider Portal Technical Assistance & Notification to the Division of New Hires or Residents Technical Assistance Guidance As stated in G.S. 110-90.2 & .2703(r) child care operators are to notify the Division of any new child care providers working who were hired or moved into the child care facility within five business days. The process of notifying the Division has changed and is now captured in ABCMS. This change has been in effect since February 2024. Effective immediately, you will need to obtain a Business NCID and complete Provider Portal training in Moodle at https://www.dcdee.moodle.nc.gov/course/view.php?id=119. No action is needed on your part if you have completed the reference training and are currently using the ABCMS Provider Portal to update information regarding new hires or residents. Once the training has been completed and access has been given, you must verify your facility roster to ensure current staff are noted on the roster. This information should be updated in ABCMS in an ongoing basis as staff members are hired and when their employment is terminated. This satisfies the requirement to notify the Division of new child care providers working who were hired or moved into the child care facility within five business days.
