A checklist was used to note the requirements monitored today. Upon arrival I was greeted by Nessy Denis-Lynch, the Director. You assisted me with today’s visit. There was a total of eight-four (84) children present, aging in range from infant to five old. The children were observed playing in centers, painting, doing a group activity, participating in circle time, eating lunch, napping, and completing routine tasks. LICENSE STATUS Currently, this Child Care Center operates with a Five (5) star license issued August 23, 2023, earning seven (7) points in education, six (6) points in program standards and one (1) quality point. I reviewed the NC Secretary of State’s website and observed the owner of the facility ES North Carolina, LLC listed as current/active. INSPECTIONS *The last fire drill was conducted 1/13/25. *The last emergency drill was conducted 12/6/24. *The last playground inspection was completed 1/13/25. *The last sanitation was completed on 12/11/24 with a ‘Superior’ classification. *The last fire inspection was conducted on 3/20/24. MONITORING During today’s visit, a full assessment was conducted, monitoring all space occupied by the children, including the outdoor play environment. New staff CPR/FA, qualification letters and newly enrolled children files were reviewed. All spaces were monitored for supervision, staff/child ratios, materials, equipment and required postings. The program records were reviewed for current inspections. Transportation is provided; therefore, these requirements were monitored and found in compliance. The following violations were observed and documented during today’s visit. Violation Number Comment Rule 428 A current activity plan was not posted for each group of children for reference. A current activity plan was not posted for the Two's classroom during today's visit. GS 110-91(12); .0508(a) 604 Lavatories were not kept clean, in good repair and kept free of storage. The walls in all three bathrooms in the Pre-K classroom was observed with chipping paint. The walls in the Three's bathroom was observed with chipping paint. 15A NCAC 18A .2818(a) 841 Medications including prescription and non-prescription items were not stored in a locked cabinet or other locked container. Diaper creams were observed stored in an unlocked cabinet in an unlocked container in the Two's classroom 15A NCAC 18A .2820(d) To comply with the NC Laws and Rules any violations cited today MUST be corrected immediately. A compliance letter must be received on or before February 26, 2025, letter must address each violation, explain how it has been corrected and how the violation will maintain compliance in the future. According to NC General Statue 110-90(4)(d) requires all child care facilities to maintain a compliance history score of at least 75% for the past eighteen months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action. TECHNICAL ASSISTANCE The following items were discussed during today’s visit to help you maintain quality within your program and to prevent further violations. STORAGE OF NON-PRESCRIPTION/PRESCRIPTION MEDICATION In the Two’s classroom diaper cream was not locked in a locked storage. I would recommend going over the policy for non-prescription and prescription medication storage with all teachers. I would recommend having a member of management check weekly to ensure that all required items are locked. LESSON PLAN The lesson plan was not complete for the Two’s 2 classroom. The Director stated that the teacher for the classroom notified her on Wednesday morning that she would not be returning. The teacher that is in the classroom is a floater. I would recommend going over how to complete lesson plans with all staff in the event a teacher is no longer able to complete the lesson plans. SANITATION/BATHROOM WALLS During today’s visit I observed three bathrooms in the Pre-K classroom with chipping paint on the walls. I also observed in the Three’s classroom bathroom chipping paint. The director stated that the walls were painted over the summer. I would recommend that you review Chapter 5 (Facilities, Supplies, Equipment and Environmental Health) with Caring For Our Kids at https://nrckids.org. It is very important to make sure the bathroom walls are always in good repair. CONSULTATION AND REMINDERS The following items were discussed during today’s visit to improve the quality of your program. HEALTH AND SAFETY TRAINING Health and Safety training is now available through Moodle on the DCDEE website. This training is provided free of charge. You should use your NCID username and password to access the Moodle portal. The Health and Safety trainings must be renewed at least every five (5) years. If you completed the training in 2020, you should begin to retake the training now. CRIMINAL BACKGROUND As of July 11, 2022, criminal record checks are now to be renewed every five (5) years instead of three (3) years. Please make arrangements to complete your 5-year re-qualification before the expiration date. ONGOING TRAINING HOURS Training hours were monitored for 2/22/24 to 2/12/25 and was found in compliance. Upon arrival I was greeted by Kaitlyn Friot, the Administrative Assistant. Nessy Denise-Lynch, the Director assisted me with the visit. I completed a general walk-through of the center. At the time of the visit, there were a total of 92 children present, ranging in age from infant to ten (10) years old. The children were observed playing outside, playing with materials, interacting with the teachers, and completing routine tasks. LICENSE STATUS Currently, this Child Care Center operates with a Five (5) star license issued August 23, 2023, earning seven (7) points in education, six (6) points in program standards and one (1) quality point. I reviewed the NC Secretary of State’s website and observed the owner of the facility ES North Carolina, LLC listed as current/active. INSPECTIONS *The last fire drill was conducted 7/5/24. *The last emergency drill was conducted 6/28/24. *The last playground inspection was completed 7/9/24. *The last sanitation was completed on 3/28/24 with a “Superior ‘’ classification. *The fire inspection was completed on 3/20/24 and the facility is approved for daytime care only. MONITORING During today’s visit, a partial assessment of Child Care Requirements was conducted for all classrooms. The monitoring included CPR/First Aid, criminal background checks and special training requirements of newly hired staff. The monitoring also included License and permit restrictions, staff/child ratios, supervision, storage of hazardous items, medication, materials/equipment, and all space occupied by the children including outdoor play environment. The following violations were observed and documented during today’s visit: Violation Number Comment Rule 428 A current activity plan was not posted for each group of children for reference. During today's visit a lesson plan was observed with a date of 8/5 - 8/9 in thee Two's classroom and no lesson plan observed in the older two's classroom. MEDICATION/NON-PRESCRIPTION During today’s visit I observed Aquaphor and Vaseline in a child’s cubby in reach of children. The Director stated that the parent must have placed it in the cubby upon drop off. I would recommend sending a memo out to the parents reminding them to complete a medical/non-prescription form and give forms and medication to the teacher. LESSON PLAN I observed an old and lesson plan in the young two's classroom and no lesson plan posted in the older two's classroom. In the Two’s classroom the lesson plan posted was dated 8/5 – 8/9. I would recommend having the staff posting their lesson plans on Friday to ensure that they are up to date for the next week. REFRIGERATOR I observed the refrigerator in the Toddler 2 classroom maintaining a temperature of 52 degrees Fahrenheit. I would recommend using a log to document the temperature of all refrigerators daily. Having a person designated to check the refrigerator daily to ensure that 45 degrees Fahrenheit is being maintained will prevent bacteria and spoilage. CONSULTATION AND REMINDERS The following items were discussed during today’s visit to improve the quality of your program. HEALTH AND SAFETY TRAINING Health and Safety trainings are now available through Moodle on the DCDEE website. These trainings are provided free of charge. This program is an expansion of Clean Water for Carolina Kids. Facilities are now required to meet rule requirements NC 10A NCAC 41C. 1001-1007, NC 154A NCAC 18A .2816. Clean Classrooms for Carolina Kids is designed to ensure facilities meet all requirements, receive direct support throughout the participation process, and have access to communication resources. The program is free, and the first step is to watch the pre-enrollment webinar, which is available at www.cleanwaterforUSkids.org/carolina. You have until 11/1/24 to register. The center currently operates with a 5-star license, operating at 30 sq. ft. inside, & ratios at .2818 (b). My visit was conducted with you, Ms. Nessy Dennis-Lynch, Director. A checklist was used to note the requirements monitored. The children were observed playing outside, participating in teacher directed & eating lunch. VERIFICATION OF RECORDS: *Last fire inspection=1-25-24 and the fire inspector will return on 2-21-24 for a final inspection. (send me your 2024 inspection within 5 days of completion) *Sanitation inspection=10-16-23 (send me your 2024 inspection) *EPR plan was updated on 10-11-23. EPR training was completed by Nessy on 12-2-15. *The center has three (3) mini-buses and currently uses one (2006 Chevy). *The last playground inspection was on 1-25-24 by Nessy. Nessy completed Playground Safety Training on 4-25-15. *I reviewed the NC Secretary of State’s website and observed the owner of the facility (ES North Carolina, LLC) listed as current-active. Technical Assistance was offered on how to correct the violations cited and how to maintain compliance. To maintain compliance with NC laws and rules regarding childcare operation, the following violations must be corrected immediately. Email a corrective action letter BY 3-6-24 to michelle.ezzell@dhhs.nc.gov Violation Number Comment Rule 325 Staff did not interact with children in positive ways by helping them feel welcome and comfortable, treating them with respect, listening to what they say, responding to them with acceptance and appreciation, and/or participating in activities with the children. On 2-15-24, an employee that worked in the toddler room, placed her hands under the toddler’s armpits and quickly sat the child on the floor in a disrespectful way. .1802 721 All equipment and furnishings were not in good repair. The turf grass located near the shade structure on the playground for toddlers is coming loose around the edges, which may cause a tripping hazard. G.S. 110-91(6); .0601(b) 847 Parent's medication authorization did not include required information. One child’s permission to administer medication form did not have an exact amount to be administered. 10A NCAC 09 .0803(4)(6-9) *****TECHNICAL ASSISTANCE/REMINDERS: ******* *All files were organized. Great Job! *Remember to complete a water lead test every three years and an Asbestos test on your building must be conducted with Clean Classrooms for Carolina Kids for questions and to enroll Go to www.cleanwaterforuskids.org or call 1-888-997-9290. *Remember to continue to update your Emergency Preparedness and Response (EPR) Plan every year and print out the cover page showing the current date. Also, print the pages you made changes to. Failure to log onto the website may result in losing your entire EPR plan. We discussed all diaper creams must have an amount of cream needed documented on the permission slip (example: pea size, quarter size, etc.). All medication at the center must accompany a completed permission slip. *The turf grass located on the playground used for toddlers, near the shade structure is coming loose around the edges, which could cause a tripping hazard. *********SELF-REPORT OF AN INCIDENT********* During the visit, Ms. Lynch, made a self-report by showing me a video clip of an incident that happened on 2-15-24, around 4:20, a parent walked into space 4 (toddlers) to pick up her child. She witnessed the teacher not treating a child in a positive way with respect and appreciation. The parent immediately reported this to the administrative staff. The employee was immediately replaced by administrative staff and put on administrative leave and sent home for the rest of the day. On 2-16-24, the next morning, Admin. Staff contacted the employee, by phone to terminate her employment. Nessy explained, the employee was employed for seven days and the week before she received five days of classroom training in another classroom of the same age group. She also received five hours of the required orientation training within her 1st week and three additional hours on 2-15-24. This was her 2nd day in a classroom. The ratios are 1:6, the teacher had 6 toddlers. The toddlers were playing in the housekeeping center and block center; the teacher was interacting with them. The teacher walked up behind the standing toddler and placed her hands under the toddler’s armpits and quickly sat the child on the floor in a disrespectful manner. Administrative staff stated the child was not harmed and did not have any marks. The teacher immediately got on the child’s level and began rubbing the child’s back and caressing the child. *Due to this self-report; the teacher not interacting with the child in a positive way and not treating the child with respect, appreciation, and acceptance this is a violation of NC childcare rule, and a violation will be cited. ****Rated License Reminders***** *The center’s license is in COHORT 1, which means your license must be reassessed between July 1, 2024, and June 30, 2025. Today, you stated NCRLAP is currently completing a mock observation. I gave you the permission to order scales form. Please scan it to me when you’re ready for me to order your scales. *Remember to have staff’s education information on file with DCDEE/Workforce and their information must be current in WORKS database. *PROGRAM ASTANDARDS: For trainings on environment rating scales go to www.ncrlap@uncg.edu and/or contact Wake County Smart Start or Childcare Services Association. ****Early Educator Certificate (EEC) **** The EEC certificate is optional for staff. Although, it may increase staff’s education points and may help keep or increase the number of STARS the facility has. EPR training was completed by Nessy on 12-2-15. *The center has three (3) mini-buses and currently uses one (2006 Chevy). *The last playground inspection was on 1-25-24 by Nessy. Nessy completed Playground Safety Training on 4-25-15. *I reviewed the NC Secretary of State’s website and observed the owner of the facility (ES North Carolina, LLC) listed as current-active. Technical Assistance was offered on how to correct the violations cited and how to maintain compliance. To maintain compliance with NC laws and rules regarding childcare operation, the following violations must be corrected immediately. We discussed all diaper creams must have an amount of cream needed documented on the permission slip (example: pea size, quarter size, etc.). All medication at the center must accompany a completed permission slip. *The turf grass located on the playground used for toddlers, near the shade structure is coming loose around the edges, which could cause a tripping hazard. *********SELF-REPORT OF AN INCIDENT********* During the visit, Ms. Lynch, made a self-report by showing me a video clip of an incident that happened on 2-15-24, around 4:20, a parent walked into space 4 (toddlers) to pick up her child. She witnessed the teacher not treating a child in a positive way with respect and appreciation. The parent immediately reported this to the administrative staff. The employee was immediately replaced by administrative staff and put on administrative leave and sent home for the rest of the day. On 2-16-24, the next morning, Admin. Staff contacted the employee, by phone to terminate her employment. Nessy explained, the employee was employed for seven days and the week before she received five days of classroom training in another classroom of the same age group. She also received five hours of the required orientation training within her 1st week and three additional hours on 2-15-24. This was her 2nd day in a classroom. The ratios are 1:6, the teacher had 6 toddlers. The toddlers were playing in the housekeeping center and block center; the teacher was interacting with them. The teacher walked up behind the standing toddler and placed her hands under the toddler’s armpits and quickly sat the child on the floor in a disrespectful manner. Administrative staff stated the child was not harmed and did not have any marks. The teacher immediately got on the child’s level and began rubbing the child’s back and caressing the child. *Due to this self-report; the teacher not interacting with the child in a positive way and not treating the child with respect, appreciation, and acceptance this is a violation of NC childcare rule, and a violation will be cited. ****Rated License Reminders***** *The center’s license is in COHORT 1, which means your license must be reassessed between July 1, 2024, and June 30, 2025. Today, you stated NCRLAP is currently completing a mock observation. I gave you the permission to order scales form. Today’s report was reviewed with Nessy, the Director. You assisted me during my observation and my walk-through. Today’s visit was in conjunction with a routine unannounced visit. ALLEGATIONS There is a concern of inadequate supervision in the classroom for three-year-old children. There is a concern that incident reports were not written for a child who was injured while in care. There is a concern that a child in care does not have the required enrollment paperwork. MONITORING Nine classrooms were monitored today for staff/child ratios, supervision, medications, and safety issues (space 5, 9 & 12 are currently closed and space 13 is the cafeteria). Children were observed playing outside, eating lunch, and preparing for nap. I spoke with the director concerning the supervision and incident report allegations. She stated that a parent complained to her that her child in space eight (8), the classroom for three-year old children was not supervised (this child is no longer enrolled). On 9-15-23, the parent sent the director a picture of her child and indicated it was a bite mark on the child’s left shoulder. I observed this picture and there was a mark on the child’s shoulder, although the mark was so light, it could not be determined if it was a bite mark; according to staff, there have not been any biting issues in this classroom. The center operates at ratios in rule .2828 (b) and the ratios are 1:9 or 2:18 in space eight. There are currently eight (8) children enrolled and up to today, two staff are present in this classroom and when available, floaters are sent in this classroom to assist staff. You stated one child pinched two different children on the same day and this was observed by the teacher. I observed the incident reports & logs on file, and this was indicated on the reports and signed by staff and parents. The incident report dated 9-22-23 did indicate a child was pinched on the child’s arm (not shoulder blade) and was witnessed by the teacher (the teacher and parent signed the incident form). Based on my observations and your report, there are no concerns with supervision. Although, a child did get pinched, it was observed by a teacher and the proper procedures were taken; the 1st and 2nd allegations are unsubstantiated. We discussed the 3rd allegation concerning a child in care does not have the required enrollment paperwork. You stated one of the 3-year-old children mentioned in the report enrolled at the center on 9-5-23 and has a sibling that has been enrolled at the center since 11-7-22. You stated when the child started on 9-5-23, the enrollment paperwork was given to the parent and the paperwork has not been returned. You have requested the paperwork from the child’s parent and will request it again today. Based on my investigation and your report, this allegation is substantiated. Technical Assistance was offered on how to correct the violation cited and how to maintain compliance. To maintain compliance with NC laws and rules regarding childcare operation, the following violation must be corrected immediately.
