This facility currently operates with a four (4) star rated license effective June 5, 2019. The facility currently serves first shift 5:00 pm or third shift. At arrival, I knocked on the door and was greeted by Ms. Kim Bennet. I stated the purpose of my visit, and proceeded with the monitoring visit assisted by Ms. Bennet. During todays visit one child was napping. The other child was observed playing in activity centers, and with small motor toys. INSPECTIONS: The last documented fire drill was conducted 4/15/-2026. The last documented shelter-in-place or lockdown drill The last Playground was conducted 2 -25 -2026. The last documented playground inspection was conducted 4-05-2026. The last Annual compliance visit was 4/26/2025 Compliance history prior to this visit:92% I monitored the following items today: Supervision, Staff/child ratio, health, transportation, safety, program and management. The attached checklist was used to note the requirements we monitored today. Staff and children’s records were reviewed today. During this visit, the provider stated that she may be retiring with in the next three years and will probably not choose a Pathway. If one is chosen, it will be pathway two. Violation Number Comment Rule 706 Corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, and products under pressure in an aerosol dispenser and any substance that may be hazardous to a child if ingested, inhaled, or handled were not kept in locked storage when children were in care. A container of colorox wipes were on the table. A closet in the bedroom and bathroom were unlocked with various items. .1719 (a)(7) 908 Health questionnaire was not completed annually. Last Health questionnaire was completed on 4/1/25. .1703(a)(1) 1101 Operator or other transportation provider did not have written permission from each child's parents or guardian to transport the child. Could not be determined because the forms were not signed by the parents. .1723(5) 1103 For each child being transported, the operator or other transportation provider did not have identifying information, including the child's name, photograph, emergency contact information, and a copy of the emergency medical care information form required by Rule .1721(a )(3) in the vehicle whenever children were transported. NC GS 110-90(4)(d) requires all child care facilities to maintain a compliance history score of at least 75% for the past 18 months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action. You shall correct the violation(s) immediately. Once completed, I would suggest keeping it somewhere in your vehicle, maybe with the fire extinguisher and or first aid kit. Please review the rules listed below to ensure that you are in compliance before transporting children. Transportation: 10A NCAC 09 .1712 WRITTEN PLAN OF CARE: (3) specify how the operator shall maintain compliance with transportation requirements specified in 10A NCAC 09 .1723 if children are transported; (4) specify how parents will be notified when children accompany the operator off premises for routine tasks not specified on the written schedule; (5) specify any other steps the operator shall take to ensure routine tasks will not interfere with the care of children; and (6) be provided and explained to parents of children in care on or before the first day the child attends the home. Parents shall sign a statement acknowledging the receipt and explanation of the plan. Parents shall also give written permission for their child to be transported by the operator for specific routine tasks that are included on the written schedule. The acknowledgment and written parental permission shall be retained in the child's record as long as the child is enrolled at the home and a copy of each document shall be maintained on file for review by the Division. If the operator amends the written plan, the operator shall give written notice of the amendment to parents of all enrolled children at least 30 days before the amended plan is implemented. Each parent shall sign a statement acknowledging the receipt and explanation of the amendment. The operator shall retain the acknowledgement in the child's records as long as the child is enrolled in the home and a copy shall be maintained on file for review by the Division. 10A NCAC 09 .1723 TRANSPORTATION REQUIREMENTS To assure the safety of children whenever they are transported, the operator, or any other transportation provider, shall: (1) ensure that vehicles used to transport children are free of hazards such as but not limited to, torn upholstery that allows children to remove the interior padding, broken windows, holes in the floor or roof, or tire treads of less than 2/32 of an inch; (2) ensure that vehicles used to transport children comply with all applicable State and federal laws and regulations; (3)ensure that vehicles are insured for liability as required by State laws governing transportation of passengers pursuant to G.S. 20-279.21; (4)ensure that vehicles used to transport children in snowy, icy, and other hazardous weather conditions are equipped with snow tires, or chains; (5)have written permission from a parent to transport his or her child and notify the parent when and where the child is to be transported, and the name of the transportation provider. Parents may give standing permission, valid for up to 12 months, for transport of children to and from the home; (6)ensure that all children are transferred to an individual who is indicated on the child's application for enrollment as specified in Rule .1721(a)(3) of this Section or as authorized by the parent; (7)load and unload children from curbside or in a safe, off-street area, out of the flow of traffic, so that they are protected from all traffic hazards; (8)ensure that all children regardless of age or location in the vehicle shall be restrained with an individual seat belt or child safety seat appropriate to the child's age or weight in accordance with G.S. 20-135.2A located at http://www.buckleupnc.org/occupant-restraint-laws/seat-belt-law- summary/. Only one person shall occupy each seat belt or child safety seat; (9)be at least 21 years old, and have a valid driver's license of the type required under the North Carolina Motor Vehicle Law for the vehicle being driven, or comparable license from the state in which the driver resides, and no convictions of Driving While Impaired (DWI), or any other impaired driving offense, within the last three years; (10)ensure that each child is seated in a manufacturer's designated area. No child shall ride in the load carrying area or floor of a vehicle; (11)have a First Aid kit and fire extinguisher located in the vehicle used to transport children; (12)never leave children in a vehicle unattended by an adult; (13)have identifying information in the vehicle about each child being transported, including the child's name, photograph, emergency contact information, and a copy of the emergency medical care information form required by Rule .1721(a)(3) of this Section; and (14)have a functioning cellular telephone or other functioning two-way voice communication device with them for use in an emergency. The transportation provider shall not use cellular telephones or other functioning two-way communication devices except in the case of an emergency and only when the vehicle is parked in a safe location; and (15)conduct off-premise activities as follows: (a)before the operator walks children off premises for play or outings, the parent of each child shall give written permission for the child to participate in such activities; (b)parents may provide a written statement giving standing permission which may be valid for up to 12 months for participation in off premise activities that occur on a regular basis; and (c)each time the children are taken off premises, the operator shall take identifying information about each child including the child's name, photograph, emergency contact information, a copy of the emergency medical care information form required by 10A NCAC 09 .1721(a)(3) of this Section. The options are Three Pathways to earn a 2-5 Star Rated License; Pathway #1 – Program Assessment using the Environment Rating Scales (ITERS-3, ECERS-3, FCCERS-3 and SACERSU). This pathway is similar to what you have done in the past. Pathway #2 – Classroom & Instructional Quality focusing on curriculum and child assessment for demonstration of quality practices: Approved curriculum and assessments must be purchased, used, and you must obtain training to achieve stars over three. Today’s visit was conducted with you, Kimberly Bennett. This facility currently operates with a four (4) star rated license effective June 5, 2019. When I initially arrived, The facility currently have 7 children enrolled and six (6) were present today. Provider now serves some children during first shift 5:00 pm or third shift The attached checklist was used to note the requirements we monitored today. Staff and children’s records were reviewed today. INSPECTIONS: The last documented fire drill was conducted 4/4/-2025. The last documented shelter-in-place or lockdown drill was conducted 4 -24 -2025. The last documented playground inspection was conducted 4 -23-2025. I monitored the following items today: Supervision, Staff/child ratio, health, transportation, safety, program and management. Rated License Summary: We discussed re-applying for Rated License reassessment and why the application was not processed due to new forms needing to be signed. She has conducted the three-month self-study. Which was received during the last routine unannounced. we went through the application and I assisted the provider with completing the form. We discussed the new star system and that the education points are different. If you are at risk of losing a star, per our conversation I will not proceed with the application. I will contact you once I finish processing your education. Program Standards: The Rated License Assessment Request Review Form and the Application for Assessment for a Two Component Star Rated License form was reviewed and signed by the administrator during today’s visit. Environment Rating Scale assessments will not be requested. I received her three month self- study. The facility will use their education and quality point. If your education does not meet the requirements to maintain your current star rating, you may need to have your environment assessed. Education Education points will be determined upon receipt of evaluation results of all staff that has submitted paperwork to WORKS. If the staff’s paperwork is not in WORKS I will use what is currently in the WORKS system. If the points do not allow you to maintain a four star rating, you stated that you wanted to wait and not process the application. Quality Option: The facility has earned a quality point by having enhanced ratio, policies that were approved by a pervious Child Care Consultant. Total points will be determined upon completion and receipt of evaluation results from the Workforce Unit. Due to education changes provider may be at risk of losing a Star rating. If this is the case you have agreed to remain hold harmless. Violation Number Comment Rule 540 The written schedule did not include a daily gross motor activity which may occur indoors or outdoors. I monitored Ms. Kim’s two vehicles for transportation, 2024 Nissan Kicks and 2012 Hyundai Accent, Driver license expires on September 1, 2032, Vehicle inspections and insurance (Allstate) are current. The vehicles have met reequirements and are approved for transportation. Before starting to utilize transportation, you must update your notebook with the current children’s application, picture, transportation form, emergency information. When I arrived at the front door the owner greeted me, and Ms. Kim Bennet and I conducted a walk-through of the facility. Two children were present today. Ms. Kim currently only has two children enrolled that arrive around 3:00pm. Children were observed playing in the block area and musical instruments. During the visit, Ms. Kim discussed wanting to start back providing transportation for children for routine errands and field trips. I monitored two vehicles for compliance. I conducted a walkthrough of the facility, and the following items were monitored: supervision, staff/child ratio, CPR/first aid, IT-SIDS, CBC qualification, Emergency Medical Care Plan, administration of medication, storage of hazardous products, storage of medication, general safety, discipline, adequate/approved space, program records, license posted, permit restrictions, safe arrival and departure, and all required posted documents. I monitored Ms. Kim’s two vehicles for transportation, 2024 Nissan Kicks and 2012 Hyundai Accent, Driver license expires on September 1, 2032, Vehicle inspections and insurance (Allstate) are current. The vehicles have met reequirements and are approved for transportation. Before starting to utilize transportation, you must update your notebook with the current children’s application, picture, transportation form, emergency information. We discussed purchasing firearms and the requirements for keeping them on the premises. Please see Technical assistance information for details on firearms, and transportation. Rated License: I received all requiired documentation and study to proceed with the reassesment of the facility Star rated liscense. This facility will remain a four star facility. Violation Number Comment Rule 811 Baby food, snack items, and meal items sent from home, for each individual child, were not dated and labeled with the child's name. Child's sippy cup was not labled. .1706(o) 1922 Plastic bags, toys, and toy parts small enough to be swallowed, including but not limited to materials that can be easily torn apart such as foam rubber and styrofoam, were accessible to children under the age of three. There was a plastic bag hanging from the cubbie. .1719(a)(18) Violations: Any Violations observed today were discussed with you and documented on the visit summary and left with you at the conclusion of this visit. The following violations of child care requirements were cited during today’s visit and must be corrected immediately. Technical assistance on how to maintain compliance with the violations cited today was provided. Comments: It is important for licensed providers to be knowledgeable of all the licensing requirements that apply to their type of program. Child care consultants can make unannounced visits at any time. It is the provider's responsibility to be in compliance with all the applicable laws and rules. Technical Assistance: Transportation: 10A NCAC 09 .1712 WRITTEN PLAN OF CARE: (3) specify how the operator shall maintain compliance with transportation requirements specified in 10A NCAC 09 .1723 if children are transported; (4) specify how parents will be notified when children accompany the operator off premises for routine tasks not specified on the written schedule; (5) specify any other steps the operator shall take to ensure routine tasks will not interfere with the care of children; and (6) be provided and explained to parents of children in care on or before the first day the child attends the home. Parents shall sign a statement acknowledging the receipt and explanation of the plan. Parents shall also give written permission for their child to be transported by the operator for specific routine tasks that are included on the written schedule. The acknowledgment and written parental permission shall be retained in the child's record as long as the child is enrolled at the home and a copy of each document shall be maintained on file for review by the Division. If the operator amends the written plan, the operator shall give written notice of the amendment to parents of all enrolled children at least 30 days before the amended plan is implemented. Each parent shall sign a statement acknowledging the receipt and explanation of the amendment. The operator shall retain the acknowledgement in the child's records as long as the child is enrolled in the home and a copy shall be maintained on file for review by the Division. 10A NCAC 09 .1723 TRANSPORTATION REQUIREMENTS To assure the safety of children whenever they are transported, the operator, or any other transportation provider, shall: (1) ensure that vehicles used to transport children are free of hazards such as but not limited to, torn upholstery that allows children to remove the interior padding, broken windows, holes in the floor or roof, or tire treads of less than 2/32 of an inch; (2) ensure that vehicles used to transport children comply with all applicable State and federal laws and regulations; (3)ensure that vehicles are insured for liability as required by State laws governing transportation of passengers pursuant to G.S. 20-279.21; (4)ensure that vehicles used to transport children in snowy, icy, and other hazardous weather conditions are equipped with snow tires, or chains; (5)have written permission from a parent to transport his or her child and notify the parent when and where the child is to be transported, and the name of the transportation provider.
