The purpose was to monitor Annual Compliance with child care requirements. The last Annual Compliance visit occurred on September 6, 2024. The facility operates with a Five (5)-Star license which was issued on November 27, 2023. This program has one EC-PreK classroom. Upon arrival, I reported to the school office, where I introduced myself, stated the purpose of my visit, signed in and proceeded to the classroom. The new Lead Teacher, Ms. Alejandra Rodriguez greeted me and assisted me during the visit. I conducted the walkthrough of learning space. INSPECTIONS: The last Fire Inspection was conducted on December 16, 2024. The facility was approved for daytime use only. The last Sanitation Inspection was conducted on March 4, 2025. The facility received a superior classification. You have stated that a fire drill was conducted at the facility on August 26, 2025. Although, there were no students present for the drill. A full compliance assessment was conducted on this date, which included a review of all applicable program requirements. The facility’s current license and permit were visibly posted, and all operational restrictions were appropriately maintained. Required program postings, including the Summary of Child Care Laws and Emergency Care Plan Information, were reviewed to evaluate overall compliance and safety practices. Today is the first day of school for the staff of the EC program. The first day for the children is tomorrow, August 28, 2025. A Follow-up visit will be conducted, at a later dated, to monitor compliance with staff/child interactions, discipline practices and overall care of the children. During the assessment, the following violation(s) were observed, cited, and technical assistance was provided at the time of the visit to support immediate corrective action. Violation Number Comment Rule 124 The center did not maintain records as required in rule, and/or were not made available to the Division for review. G.S. 110-91(9); .0304(g); .2318 The above item(s) must be corrected immediately. Please prepare and submit a formal letter detailing how each item of noncompliance has been addressed and/or corrected. The letter must: -Be submitted on your facility’s official letterhead -Include an electronic signature -List and respond to each cited item of noncompliance -Be submitted to my office on or before 5:00 pm, September 10, 2025. Failure to submit the corrective action letter by the stated deadline may result in a return visit to verify compliance, which may lead to additional regulatory requirements. During the visit, you were provided with the opportunity to ask questions related to child care regulations. We discussed each area(s) of noncompliance in detail to ensure clarity and understanding moving forward. TECHNICAL ASSISTANCE: Remember, each staff member must complete the required number of in-service training hours annually as required by the Division of Child Development, based on their number of years of service, level of education, and hours worked at the facility. You have up to twelve months to complete your required in-service training hours. You may access Health and Safety trainings on the DCDEE website at https://ncchildcare.ncdhhs.gov. Hoover over the provider tab, using the drop-down window, scroll down to MOODLE trainings, sign in using your NCID user name and password. Go to My Courses and use the search window to type in REGULATORY, there you will begin to see the training options of 2025. All new staff members have up to a year to complete the Health and Safety Trainings. Also, any staff who took the training in 2020 are required to renew the training by the end of 2025. You must complete Recognizing and Responding Suspicions of Child Maltreatment by October 1, 2025, (within three (3) months of hire date.) You must complete the in-person CPR/FA training by October 1, 2025 (within three (3) months of your hire date). Playground safety inspections must be completed monthly by a trained staff member. You or someone in your facility must complete playground safety training. As the new lead teacher, you must complete playground safety within six (6) months of your hire date. Based on your hire date, you should complete the training by February 1, 2026. However, best practice is that you complete the training as soon as you can locate it. This is so you meet the requirement of monthly outdoor inspections by a trained professional. Please remember that fire drills should be conducted monthly, regardless of whether the school conducts one or not. You are responsible to ensure that all emergency drills are practiced and documented for your EC classroom. Lockdown drills must be practice quarterly. Once again, regardless of whether the school conducts one or not. You are responsible to ensure that all emergency drills are practiced and documented for your EC classroom. I recommend that you train the children and staff to recognize both alerts in order to effectively ensure that everyone understands the importance of the alerts used to communicate possible emergencies. As your school year begins, please ensure that all therapists who are scheduled to come into your classroom and who may be left alone with children, must have an approved Child Care Criminal Background (qualifying) letter on file in the classroom and available for Division Representative review. As we prepare for the Pathways to the Stars Assessment, please ensure that all staff have their most recent transcript(s) uploaded to WORKS for evaluation. This is important, as paperwork for the assessment will not be processed until all required information is received by the consultant. This visit was conducted by Turkessha Casterlow, Childcare Consultant with Kadie Cheek, Lead Teacher Assistant and Dawn Courson, Principal. Your program currently operates with a Five Star license effective November 27, 2023. The program’s compliance history was 100% prior to today’s visit. All programs are required to maintain at least 75% compliance. Today, the following items were monitored: • Supervision • Staff / Child Ratio • CPR / First Aid • Special Training • CBC Qualification • Emergency Medical Care Plan • Administration of Medication • Storage of Hazardous Products • Storage of Medication • General Safety • Discipline • Adequate / Approved Space • Program Records • License Posted • Permit Restrictions The license was observed, and the restrictions were found in compliance. A walk-through of the facility was completed today. Indoor and outdoor areas were observed. Staff/child ratio and space capacity were monitored as indicated on the attached worksheet. Supervision was adequate during the visit. I observed staff/child interactions today. I observed children participating in free play and routine care. No new staff were reported at this program. Limited monitoring of staff files was conducted for the purpose of reviewing training regarding CPR/First Aid, EPR, Playground Safety, Special Training including Health and Safety Training and Criminal Background Checks. No medications were observed nor reported. Storage hazardous items were monitored today. A playground inspection was recorded on March 26, 2025. A fire drill was recorded April 30, 2025. A shelter in place drill for the facility was recorded on March 10, 2025 The most recent fire inspection was on April 30, 2025. I observed a sanitation inspection was last conducted on March 10, 2025 earning a Superior classification. The following violations were cited during today’s visit: Violation Number Comment Rule 859 Monthly playground inspections were not completed and/or they were not completed by an individual trained in playground safety requirements. The last documented monthly playground inspection was completed on March 26, 2025. .0605(q) 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file. One staff member responsible for care of children First Aid expired March 31, 2025. .1102(c) 1049 All staff did not successfully complete certification in CPR training appropriate to the age of the children in care. This facility is currently on a Probationary License that was issued on May 26, 2023. The last Fire Inspection was conducted on March 13, 2023, and the facility was approved for daytime care only. This facility is currently under a “Provisional” classification with Sanitation due to an unresolved lead problem. Upon arrival, I was greeted by the principal, Ms. Dawn Courson, I stated the purpose of my visit and was assisted on a walk-through of the classroom, where attendance was documented, and observations made. The children were observed playing outside. As of today’s date, corrections for the September 8, 2023, visit have not been corrected. The principle did not obtain a criminal background check prior to accepting responsibility to oversee this classroom. G.S. 110-90.2(b) Technical Assistance: Today you stated that the Health Department and a person from Raleigh came yesterday (10/17/23) and gave you a visual pass on the remediation of the places that had been corrected in the school. They did take several more samples to be tested so you are waiting for those results. This process could take up to four to six weeks long. We did discuss that you may need to ask for an extension until the test results come back from Raleigh to correct violation number 104. On 09/15/23, a staff member handled a four-year-old child in a forceful and inappropriate manner while moving them to another location. The last Annual Compliance visit was conducted on September 27, 2022. The facility currently operates with a Provisional License that was issued on July 6, 2023 and will expire on November 26, 2023. Upon arrival to the facility, I checked in at the front office and proceeded to the classroom. I was greeted by the new lead teacher Ms. Lauren Lewis. I stated the purpose of my visit and was assisted by the staff in the classroom. Attendance was taken and observations were made. The children were observed participating in teacher directed circle time, indoor free play, routines, and lunch. A fire drill was conducted during today’s visit. The center's last Fire Inspection was conducted on March 13, 2023 and was approved for day time care only. The center's last documented Sanitation Inspection was conducted on March 31, 2022 and a 'Provisional' classification was received with twelve (18) demerits. During today's visit I monitored all requirements regarding this licensed facility. The license was posted, and restrictions maintained. I monitored program records, children’s records and staff files. I monitored supervision, staff/child ratio and general safety. The following violations were observed, cited, and technical assistance was provided. Violation Number Comment Rule 104 Center has not passed required sanitation inspection and received an approved or superior rating. The most recent documented sanitation inspection available was dated March 31, 2022 and was classified as a Provisional. 10A NCAC 09 .0304(b) 114 A summary of the NC Child Care Law was not given to a parent of every child enrolled in the center. One child's file did not contained this required document. GS 110-102 526 Menus for all meals and snacks were not current or posted where easily seen by parents and cook. Menus were not posted in the classroom. 10A NCAC 09 .0901(b) 830 A First Aid information sheet was not posted in a place for referral and/or the information sheet did not include all the required information. A First Aid sheet was not observed posted in the classroom. .0802(h) 1908 A child's file did not have a statement with parent signature acknowledging receipt and explanation of the Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy and/or the acknowledgement did not have all the required information. One child's file did not contained this required document. .0608(b)(1-6) 1914 The person identified as the person or alternate person responsible for carrying out the emergency medical care plan was not on the premises at all times and/or did not accompany children for off premise activities. The persons identified as the responsible party and the alternate party are no longer employed at this facility. .0802(b)(1-2) The above violations must be corrected immediately. A compliance letter must be drafted describing how and when the violations were corrected. The letter should also include the item number of each of the violations cited. You must include the name and identification number of your program, as well as your electronic signature. The letter must be received by my office on or before September 18, 2023. You may email the letter to my supervisor, kaye.adkins@dhhs.nc.gov and please “CC” me at anita.c.graham@dhhs.nc.gov. If I do not receive your letter by September 18, 2023, a return visit to your program may be necessary to ensure the violations have been adequately corrected. Additional violations may be documented if the violations have not been corrected or addressed. You were provided an opportunity to ask questions regarding Child Care Requirements. We discussed each of the violations cited this date. Please remember, a current Emergency Medical Care Plan shall be posted in two areas of the classroom. The plan shall have names of the current staff responsible for responding in the case of an emergency. See rule: 10A NCAC 09 .0802 EMERGENCY MEDICAL CARE: (a) Each child care center shall have a written plan that sets forth the steps to follow in the event of a child medical emergency. The plan shall be reviewed with all staff annually and whenever the plan is revised. This plan shall give the procedures to be followed to ensure that any child who becomes ill or is injured and requires medical attention while in care at the center receives appropriate medical attention. The following information shall be included in the center's emergency medical care plan: (1) The name of the person and at least one alternate, responsible for carrying out that plan of action, ensuring that appropriate medical care is given, and determining which of the following is needed: (A) first aid given at the center for an injury or illness needing only minimal attention; and (B) calling 911 in accordance with CPR or First Aid training recommendations. (2) The name of the person and one alternate, at the center responsible for: (A) ensuring that the signed authorization described in Paragraph (d) of this Rule is taken with the ill or injured child to the medical facility; (B) accompanying the ill or injured child to the medical facility; (h) A First Aid information sheet shall be posted in a place for referral. The information sheet shall include first aid guidance regarding burns, scalds, fractures, sprains, head injuries, poisons, skin wounds, stings and bites. An information sheet may be requested free of charge from the North Carolina Child Care Health and Safety Resource Center at 1-800-367-2229. 10A NCAC 09 .0901 GENERAL NUTRITION REQUIREMENTS: (b) When food is prepared by or provided by the center, menus for nutritious meals and snacks shall be planned at least one week in advance. At least one dated copy of the current week's menu shall be posted where it can be seen by parents and food preparation staff when food is prepared or provided by the center. A variety of food shall be included in meals and snacks. Any substitution shall be of comparable food value and shall be recorded on the menu prior to the meal or snack being served. You have stated that the menu is on-line, however, it must be printed and posted. 10A NCAC 09 .0304 ON-GOING REQUIREMENTS FOR A LICENSE: (b) Each center shall be inspected annually by an Environmental Health Specialist and receive an approved or superior rating in accordance with applicable sanitation requirements adopted by the Commission for Public Health as described in 15A NCAC 18A .2800. The last documented sanitation inspection was conducted March 31, 2022 and the program achieved a Provisional classification. As required by G.S. 110-102; all children’s file must contain documentation that a copy of the summary of the NC Child Care Law was given to a parent of every child enrolled in the center. Rule # 0608(b)(1-6) states that a child's file have a statement with parent signature, acknowledging receipt and explanation of the Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy. Comments: Rated License Assessments. All programs continue to be in a “hold harmless” status until February 2024. However, RESOURCES -Child care programs can order free posters from the NC Child Care Health and Safety Resource Center at https://healthychildcare.unc.edu/ -The Health and Safety Trainings are now being offered on the DCDEE website https://ncchildcare.ncdhhs.gov/ free of charge. Look for the ‘DCDEE Moodle’ tab under the ‘Services’ tab on the website. Health and Safety Trainings should be renewed every five (5) years. Thank you for your assistance during today’s visit. See rule: 10A NCAC 09 .0802 EMERGENCY MEDICAL CARE: (a) Each child care center shall have a written plan that sets forth the steps to follow in the event of a child medical emergency. The plan shall be reviewed with all staff annually and whenever the plan is revised. This plan shall give the procedures to be followed to ensure that any child who becomes ill or is injured and requires medical attention while in care at the center receives appropriate medical attention. The following information shall be included in the center's emergency medical care plan: (1) The name of the person and at least one alternate, responsible for carrying out that plan of action, ensuring that appropriate medical care is given, and determining which of the following is needed: (A) first aid given at the center for an injury or illness needing only minimal attention; and (B) calling 911 in accordance with CPR or First Aid training recommendations. (2) The name of the person and one alternate, at the center responsible for: (A) ensuring that the signed authorization described in Paragraph (d) of this Rule is taken with the ill or injured child to the medical facility; (B) accompanying the ill or injured child to the medical facility; (h) A First Aid information sheet shall be posted in a place for referral. The information sheet shall include first aid guidance regarding burns, scalds, fractures, sprains, head injuries, poisons, skin wounds, stings and bites. An information sheet may be requested free of charge from the North Carolina Child Care Health and Safety Resource Center at 1-800-367-2229. 10A NCAC 09 .0901 GENERAL NUTRITION REQUIREMENTS: (b) When food is prepared by or provided by the center, menus for nutritious meals and snacks shall be planned at least one week in advance. At least one dated copy of the current week's menu shall be posted where it can be seen by parents and food preparation staff when food is prepared or provided by the center. A variety of food shall be included in meals and snacks. Any substitution shall be of comparable food value and shall be recorded on the menu prior to the meal or snack being served. You have stated that the menu is on-line, however, it must be printed and posted. 10A NCAC 09 .0304 ON-GOING REQUIREMENTS FOR A LICENSE: (b) Each center shall be inspected annually by an Environmental Health Specialist and receive an approved or superior rating in accordance with applicable sanitation requirements adopted by the Commission for Public Health as described in 15A NCAC 18A .2800. The last documented sanitation inspection was conducted March 31, 2022 and the program achieved a Provisional classification. As required by G.S. 110-102; all children’s file must contain documentation that a copy of the summary of the NC Child Care Law was given to a parent of every child enrolled in the center. Rule # 0608(b)(1-6) states that a child's file have a statement with parent signature, acknowledging receipt and explanation of the Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy. Comments: Rated License Assessments. All programs continue to be in a “hold harmless” status until February 2024. However, RESOURCES -Child care programs can order free posters from the NC Child Care Health and Safety Resource Center at https://healthychildcare.unc.edu/ -The Health and Safety Trainings are now being offered on the DCDEE website https://ncchildcare.ncdhhs.gov/ free of charge.
