On November 21, 2025, the Raleigh office received a report of alleged non-compliance with childcare requirements. Upon arrival at the facility, I was greeted by Sonja Eley-Ghee, Program Director, who assisted me on the walkthrough of the facility. There are twenty-eight (28) children present this date, ranging in age from infants to five (5) years old. ALLEGATION: There are allegations of violations of child care requirements regarding nurture and care. OBSERVATIONS: Today, I discussed the concerns with the Program Director, Ms. Eley-Ghee who confirmed the allegations based on her internal review of the situation. She also provided a written statement. The staff member named in the allegation has been terminated. CONCLUSION: Based on my interview with the Program Director the allegation regarding violations of child care requirements is SUBSTANTIATED. The following violation was substantiated, cited and technical assistance was provided. Violation Number Comment Rule 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. In a classroom of children who are three years old, a staff member had a pattern of speaking to the children in a non-nurturing manner and failed to respond to the children based on their developmental needs. G.S. 110-91(10) You were provided with an opportunity to ask questions regarding childcare requirements. We discussed the violation cited. TECHNICAL ASSISTANCE: Staff/child interactions must remain positive. Staff must always offer positive guidance encouragement to children in their care. The last annual compliance visit was conducted on July 25 , 2023. The center currently operates with a Five-Star License, which was issued on January 8, 2021. Upon arriving to the facility, I was greeted by Mr. Donnie Casterlow, Administrator. I stated the purpose of our visit and was accompanied on a walkthrough of the facility. Attendance was taken, and observations made, the children were observed participating in indoor and outdoor free play, and routines. The last fire inspection was conducted on February 23, 2024 and was approved for daytime care only. The last sanitation inspection was conducted on July 28, 2023 and a superior classification was assigned. During today's visit a full assessment of applicable childcare requirements was conducted. I monitored supervision, staff/child ratio, permit posting, restrictions maintained. I monitored program records, children’s records and staff files. The following violations were observed, cited, and technical assistance and resource links were provided. Violation Number Comment Rule 415 A current schedule was not posted for each group of children for reference. The posted activity plan was not current. It contained dates from July 1-5, 2024. GS 110-91(12);.0508(a) 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. A cabinet containing cleaning products was observed stored in an unlocked cabinet. .2820(b) 849 Leftover medicines were not returned to the parent after the course of treatment was completed, after authorization was withdrawn or after authorization had expired and/or medication was not discarded within 72 hours of completion of treatment or withdrawal of authorization. The permission to administer prescription medication was observed to be expired. .0803(12) The above violations must be corrected immediately and a compliance letter stating how and when the violations were corrected. The letter should reach my office by August 7, 2024 you may e-mail the letter to anita.c.graham@ddhhs.nc.gov. If the letter does not reach my office by August 7, 2024 a return visit may be necessary to ensure compliance with childcare requirements. Childcare licensing rules and regulations are established to ensure a safe and healthy environment for children in care. TECHNICAL ASSISTANCE: 5.2 Quality Of The Outdoor And Indoor Environment 5.2.9 Prevention And Management Of Toxic Substances 5.2.9.1: USE AND STORAGE OF TOXIC SUBSTANCES: Early care and education programs should store any potentially toxic substances behind doors/cabinets with child-resistant locks/latches. A locked cabinet or room that children cannot open or enter is best, but it must be locked all the time. Upon arrival to the facility, I was greeted by the Donnie Casterlow, Administrator. I stated the purpose of my visit and we conducted a walkthrough of the facility. Attendance was taken and observations made. The children were observed in indoor free play, teacher directed activities, watching movies and routines. Limited monitoring was conducted during today's visit, permit posted, restrictions maintained, supervision, staff/child ratio, adequate approved space. ALLEGATION #1: Developmentally Appropriate Environment. OBSERVATION: During the walkthrough of the facility I observed a projector screen erected in a classroom with children who are one and two years old. Although, today the projector is displaying a holiday scene, there is movement in the backdrop of the screen. I observed boxes in various spaces in the classrooms. The provider stated that some of the materials in each of the classrooms have been packed up in preparation of floors in the entire school being replaced. CONCLUSION: Based on observation of the classroom, this allegation is SUBSTANTIATED. The following violations were observed, cited and technical assistance was offered. Violation Number Comment Rule 432 The center did not have developmentally appropriate equipment and materials accessible daily. sufficient materials were not available for in a classroom with children who are one and two years old. GS 110-91(12);10A NCAC 09 .0509(1) 524 When children 3 years and older were in care, screen time was not used to stimulate a developmental domain; was not limited to 30 minutes a day and no more than a total of two and a half hours per week, per child; and/or was not documented on a cumulative log or the activity plan that is available for review. Children were observed participating in screen time in two classrooms which did not have appropriated documented log. One classroom had no documentation since June 2023 the other classroom did not have a documentation available for Division Representative review. Both classrooms were participating in a screen time activity during the visit. .0510(d)(2)(A-C) 544 Screen time was offered to children under three years of age. in a classroom with children who are one and two years old there is a projector screen erected. Upon arrival to the facility, I was greeted by the Donnie Casterlow, Administrator. I stated the purpose of my visit and we conducted a walkthrough of the facility. Attendance was taken and observations made. The children were observed in indoor free play, teacher directed activities, watching movies and routines. Limited monitoring was conducted during today's visit, permit posted, restrictions maintained, supervision, staff/child ratio, adequate approved space. ALLEGATION #1: Developmentally Appropriate Environment. OBSERVATION: During the walkthrough of the facility I observed a projector screen erected in a classroom with children who are one and two years old. Although, today the projector is displaying a holiday scene, there is movement in the backdrop of the screen. I observed boxes in various spaces in the classrooms. The provider stated that some of the materials in each of the classrooms have been packed up in preparation of floors in the entire school being replaced. CONCLUSION: Based on observation of the classroom, this allegation is SUBSTANTIATED. The following violations were observed, cited and technical assistance was offered. Children were observed participating in screen time in two classrooms which did not have appropriated documented log. One classroom had no documentation since June 2023 the other classroom did not have a documentation available for Division Representative review. Both classrooms were participating in a screen time activity during the visit. .0510(d)(2)(A-C) 544 Screen time was offered to children under three years of age. in a classroom with children who are one and two years old there is a projector screen erected. The screen displayed a Holiday scene and there was movement in the background of the scene. .0510(f) 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. In a classroom with children who are two and three years old, shaving scream was observed stored on a shelf and the storage cabinet was unlocked which contained cleaning products. The door to the kitchen was observed unsecured. .2820(b) The above violations must be corrected immediately, and a letter must be sent to me no later than December 25, 2023, stating how each item was corrected. The area for fall zones is as follows: (1) for stationary outdoor equipment used by children under two years of age, the protective surfacing shall extend beyond the external limits of the equipment for a minimum of three feet, except that protective surfacing shall be required at all points of entrance and exit for any structure that has a protective barrier. 10A NCAC 09 .1106 DOCUMENTATION OF ON-GOING TRAINING AND PROFESSIONAL DEVELOPMENT (a) Each center shall have a record of training activities in which each staff member participates, including copies of training certificates or official documentation provided by the trainer. That record shall include the subject matter, topic area in G.S. 110-91(11), training provider, date provided, hours, and name of staff who completed the training. This documentation shall be on file and current. (4) Completion of the training required by Subparagraph (a)(2) of this Rule shall count toward meeting one year's annual on-going training requirements in 10A NCAC 09 .1103.
