The Annual Compliance Monitoring Checklist for Child Care Centers was used today to note requirements that were monitored. Mrs. Shonda Richardson, Owner/Operator, was present during the visit. The program currently operates with a 4-star rated license issued February 21, 2020, earning 7 points for education standards, 2 points for program standards, and 1 point for Quality for complying with an educational option. License restrictions include: Daytime and 2nd shift, meets enhanced space and meets enhanced ratios. During today's visit all areas used by the children were monitored. Staff/child ratios, group size, capacity, use of space, and supervision were observed. I observed forty-six (46) children participating in various activities throughout the center, including teacher-lead activities, free play and outdoor play. Developmentally age-appropriate materials were accessible and I observed positive and nurturing communication as teachers interacted with the children. A sanitation inspection was completed on November 26, 2024 with 14 demerits and a superior rating. A fires inspection was completed on January 9, 2025. The Emergency Drill Log & Report was reviewed during today's visit. Prior to today's visit the staff and training worksheet was obtained. A review of the information was completed. One staff file was reviewed during today's visit. Six children records were monitored and the children's records form was completed during the visit. One violation of child care requirements was observed. In space #2 (classroom used by three and four year old children), the storage cabinet was unlocked. The small, padlock, was left unlocked in the cabinet door) and a container of Beta Food was in the cabinet. This was corrected during the visit when the padlock was safely locked. A letter of compliance is not required. Violation Number Comment Rule 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. A container of Beta Food was in the unlocked storage cabinet in space #2. This was corrected during the visit when the padlock was safely locked. .2820(b) You are required to maintain compliance with all applicable child care rules and regulations at all times. NC GS 110-90(4)(d) requires all child care facilities to maintain a compliance history score of at least 75% for the past 18 months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action. Your compliance history score for 7/2/2023 to 1/1/2025 is 99%. Child care licensing requirements were established to ensure a safe and healthy child care environment. Reminder, this must be completed every 3 years. You were given information regarding the CBC Provider Portal during today's visit. You must complete the Provider Portal training in MOOODLE and complete the ABCMS Provider Portal to update your facility roster to ensure current staff are noted on the roster. This information should be updated in ABCMS in an ongoing basis as staff members are hired or when their employment is terminated. The compliance of this rule (G.S. 110-90.2 & .2703(r), will be monitored during your next visit. Rated License: The Governor signed Senate Bill 425 (now Session Law 2024-34), Health and Human Services Omnibus Bill, which includes the Quality Rating Improvement System (QRIS) Modifications recommended to the Legislature by the NC Child Care Commission to update QRIS and create additional pathways for licensed child care facilities to earn star rated licenses. The Child Care Commission is currently in the process of drafting proposed child care rule language to begin the rulemaking process for implementing the new requirements. The rulemaking process will include publishing proposed revised rules as well as a public hearing and public comment period. Hold Harmless provisions have been extended and star rated license assessments for licensed child care providers will be conducted by provider request only, until the QRIS rulemaking process has been completed. The Annual Compliance Monitoring Checklist for Child care Centers was used today to note requirements that were monitored. Mrs. Shonda Richardson, Owner/Operator, was present during the visit. Today's lunch consisted of turkey sliders, corn, potatoes and milk. Applicable food allergies were posted in the classrooms as well as the food service area. A sanitation inspection was completed on November 30, 2023 with 6 demerits and a Superior rating. A fire inspection was completed on January 26, 2024. The Emergency Drill log was reviewed during today’s visit. Prior to today’s visit the staff and training worksheet was obtained. A review of the information was completed. Upon reviewing a new staff record, I verified through the ABCMS system the staff member does not have a criminal background check in place. Mrs. Richardson and Q. Jackson (cook) were immediately informed that Ms. Jackson cannot work until she receives a qualification letter from DCDEE and provides a copy to Mrs. Richardson to be on file at the child care facility. Ms. Jackson's hours at the facility are 7:30 am- 12:00 pm. Ms. Jackson left the center upon acknowledgement of the violation. During today’s visit, seven children records were reviewed. The children’s records form was completed during the visit. Two violations of child care requirements were observed and documented. Computer-generated report was printed at the conclusion of today's visit. Violation Number Comment Rule 1041 Prior to employment a Criminal Background Check was not completed. One staff did not complete the Criminal Background check prior to employment. G.S. 110-90.2(b) 1757 A valid qualification letter was not on file and available to review at the facility. The Emergency Drill log was reviewed during today’s visit. Prior to today’s visit the staff and training worksheet was obtained. A review of the information was completed. Three staff files were reviewed during today’s visit. A violation was cited. Upon reviewing a new staff record, I verified through the ABCMS system the staff member does not have a criminal background check in place. Mrs. Richardson and Q. Jackson (cook) were immediately informed that Ms. Jackson cannot work until she receives a qualification letter from DCDEE and provides a copy to Mrs. Richardson to be on file at the child care facility. Ms. Jackson's hours at the facility are 7:30 am- 12:00 pm. Ms. Jackson left the center upon acknowledgement of the violation. During today’s visit, seven children records were reviewed. The children’s records form was completed during the visit. Two violations of child care requirements were observed and documented. Computer-generated report was printed at the conclusion of today's visit. Violation Number Comment Rule 1041 Prior to employment a Criminal Background Check was not completed. One staff did not complete the Criminal Background check prior to employment. G.S. 110-90.2(b) 1757 A valid qualification letter was not on file and available to review at the facility. One staff did not have a qualification letter on file for review. G.S. 110-90.2(b) & (d) & .2703(e) The above violations must be corrected immediately. You must provide a signed and dated statement that explains how the violations were corrected. Send the statement to me no later than March 7, 2024. NC GS 110- 90(4)(d) requires all child care facilities to maintain a compliance history score of at least 75% for the past 18 months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action. Child care licensing requirements were established to ensure a safe and healthy child care environment. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with all the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the child care law and rules. I explained that you have access to the on-line version of the Child Care Rule Book, as well as a hard copy of the rules. I recommend that you visit the Division of Child Development's website (www.ncchildcare.nc.gov) on a regular basis to find out what's new in childcare. You could also find any needed Child Care forms by going on the web site and clicking on the "Provider" tab and then clicking on the "Provider Documents" tab. Health and Safety Trainings: Health and Safety training requirements were monitored. All staff have completed the required Health and Safety Trainings. Technical Assistance with Criminal Background checks were provided today. North Carolina General Statue 110-90.2 and Child Care Rule 10A NCAC 09 .2703 defines a Child Care Provider is any person who *is employed or seeks to be employed in a child care center, including temporary or permanent substitute employee, *owns, operates or seeks to own or operate a child care center, center in a residence, or family child care home, *is over 15 years old and a member of the household in a family child care home or center located in a residence; *an "uncompensated provider" as any person who works in a child care facility and is counted in the staff/child ratio or has unsupervised contact with children, and who is not monetarily compensated by the facility. Child Care Providers include the following employees who have contact with the children in a child care program: (a) facility directors; (b)child care administrative staff; (c)teachers; (d)teacher aides; (e)substitute providers; (f)uncompensated providers; (g)cooks; (h)maintenance personnel; and (i)drivers. Volunteer: means a person who works in a child care facility and is not counted in staff/child ratio, does not have unsupervised contact with children, and is not monetarily compensated by the facility. The volunteer must be least 13 years of age and must be supervised by and works with a staff person who is at least 21 years of age and meets staff qualification requirements. Star Rated License: Rated License: The Division of Child Development and Early Education is starting the Rated License Assessment back to get programs current with their Rated License. You are in Cohort 2. Therefore, your Prep year will begin July 1, 2024 and end June 30, 2025. During this time, you need to make sure all teaching staff have completed the NCECC and their information in WORKS is updated. This means submitting any certificates or an original transcript showing EDU coursework completed is in WORKS. If staff have completed any EDU coursework since your last rated license, make sure an original transcript is mailed to the WORKS unit of DCDEE. If you are wanting the Environment Rating scales completed to earn more points in Program Standards, please take advantage of all the trainings they have on their website: ncrlap.org. Your Assessment year will begin July 1, 2025, and you must complete the Rated License Assessment by June 30, 2026.
