A checklist was used to note the requirements I monitored today. The visit was completed with you, C. Ward, assistant administrator, and D. Barrett, Administrator. You were notified of the purpose of the visit. You were available for consultation at the conclusion of the visit. The staff/training worksheet were not available during the visit; however, I monitored staff files for compliance. I requested the staff/training worksheets be completed and emailed by close of business on 11/14/2025. Your facility currently collaborates with Greene Lamp Early Head Start and operates with a Developmental Day Program. You have a five-star license, earning 7 points in the education component, 6 points in the program standards component (meeting enhanced space and reduced ratios) and 1 quality point for the administrator having completed a business training course of at least 30 clock hours. There is also a restriction on the permit indicating this is a certified developmental day program. The sanitation inspection was completed on March 31, 2025, with a “Superior” classification. The last fire inspection was completed January 10, 2025, and the facility was approved for day time care only. CORPORATION STATUS: Tender Love Child Care Center, Inc. is listed as the current owner of this center. I reminded you the corporation status for your program must always remain Current and Active. Failure to comply may affect your child care license. Prior to today’s visit, the program’s compliance history was 89% over the current 18- month period. A copy of your compliance history report was left with you. You verified the location address, telephone, and email on file with DCDEE is accurate. Children were observed during morning group activities, free play in centers, completing transitions, and completing routines such as handwashing and toileting. I used the Annual Compliance Monitoring Checklist for Child Care and the Child Care Center Item Number Listing (DCD 0357) as a basic monitoring tool to assess compliance with all applicable child care requirements. The computer-generated visit summary was reviewed with you and a copy was provided to you at the conclusion of the visit. The following child care violations were documented: Violation Number Comment Rule 1044 Prior to the expiration date of the qualification letter, the child care provider did not complete and submit required forms to complete a criminal background check (a qualification letter is valid for a maximum of five years for the date of issuance). It is your responsibility to maintain compliance with the applicable laws and rules; always whether they have been monitored or specifically discussed with you in the past. The best way for you to ensure that you are meeting all requirements is to periodically review the child care laws and rules on the Division of Child Development and Early Education’s website. DCDEE WORKS: Please continue to keep your Staff and Training worksheets up to date. Update the worksheets when changes are made, such as hiring new staff, additional coursework, and completed training. We discussed that you have several staff members that are not in WORKS. If the education information is not in the “WORKS” system when the star-rated license is reassessed it could affect the points in Education Standards. QRIS – PATHWAY TO THE STARS: The Division of Child Development and Early Education (DCDEE) is excited to share information about the July 2025 child care rule changes. The Child Care Commission adopted rules to support QRIS modernization. The new section, .3200, provides the standards for earning a two-though five-star-rated license. There are three pathways: program assessment, classroom and instructional quality, and accreditation and head start. To support the QRIS changes, additional rules were amended within the following sections: definitions, developmental day services, and NC Pre-Kindergarten services. We will assist as you begin to review the changes, but please note some of the rule changes may not impact your facility. DCDEE has provided a summary of the changes, but for specific details regarding these changes, please ensure you are using the updated July 1, 2025, rule book, and view information in the DCDEE Moodle. We reviewed your staffing and where they may be in the education standards. We reviewed the Continuous Quality Improvement Plan and Professional Development Plan for the facility and for the staff, and the Family and Community Engagement Standards document. I provided you with copies for you to review and complete. We discussed that I would be available for a technical assistance visit, or you can contact me to review or discuss these documents and the process. We reviewed the requirements for using a curriculum for all ages, conducting child observations and coaching and training for administrators. ANNUAL LICENSE FEES: Invoices for the annual license fees were emailed to facilities subject to license fees on November 3, 2025. Payment Information: Payments are due by December 3, 2025. Doris Barrett, the administrator, assisted with the visit. Twenty-four (24) children were observed in care today ranging from one (1) to three (3) years old. Children were engaged in free choice play with developmentally age-appropriate materials, outdoor play, completing toileting, diapering, and hand washing routines, interacting with the caregivers and eating breakfast. Breakfast consisted of cheerios cereal, pears and milk. Currently this program operates with a five-star license earning seven points in staff education, six points program standards, and one quality point for the administrator completing a 30-hour business training course. The sanitation inspection was completed on March 31, 2025, earning a superior classification. The last fire inspection was completed on January 10, 2025, and the center was approved for daytime care only. The last annual compliance visit was completed on November 9, 2024. The following violations were documented today. Violation Number Comment Rule 125 Daily records of arrival and departure times for children at the center were not maintained as children arrive and depart and/or were not made available for review. Staff were actively engaged with children, initiating conversations about the foods they were eating and sitting next to them. Once children finished breakfast, they independently cleaned their areas and proceeded to free choice play in various activity areas. Children were also observed engaged in outdoor play utilizing gross motor equipment such as bikes, cars, slides and climbing of large play structures. STAFFING CHANGES: Review of staff records revealed two new employees were hired since your program’s last visit on November 9, 2024. Based on my review of staff records, all documentation and regulatory requirements for recordkeeping were found in compliance. SAFETY REMINDERS: We discussed the importance of ensuring that diaper wipes and toothpaste used for brushing teeth are stored appropriately and in spaces inaccessible to children. Upon review of the packaging, safety warnings were noted, and it was determined that storing the wipes and toothpaste in areas accessible to children creates a safety concern and does not meet compliance. It has been identified that the plastic packaging for diaper wipes and toothpaste used with children include important safety warnings, such as “keep out of reach of children, babies and pets” and “warning of the risk of suffocation”. These warnings highlight the importance of proper storage to ensure safety of children in your care. You removed the toothpaste from the shelf during the visit, placed it up high on a shelf and stated you would install a shelf to store the toothpaste. The teacher stated she was going to change the children’s diapers in the bathroom; therefore, the wipes would be removed when finished. Please make sure all such items are stored safely and in compliance with child care and sanitation regulations. You indicated you received the email notification regarding proper storage of diaper wipes sent out to programs on June 6, 2025. You added you and staff were beginning to work on storing the wipes appropriately. I encouraged you to ensure ant piles were removed from the playground prior to children having access to it. You shared pest control sprays the playground monthly; however, the ants continue to resurface. I explained if the children were to encounter ant piles, injuries could be sustained from being bitten. During the visit, you notified the staff to refrain from using the areas where ant piles were observed during outside play. You stated the area would be blocked off to keep children from gaining access until the ant piles could be removed. ARRIVAL/DEPARTURE TIMES: Sign in/out logs showed departure times were not documented for multiple children between the dates of May 5, 2025, to June 10, 2025. I encouraged you to talk to staff about monitoring sign in/out logs periodically throughout the day to ensure parents are documenting the times. If parents do not record times for arrival or departure, staff could write it in along with their initials to reflect who provided the information. Maintaining accurate records is vital to operating a successful program. AUTOMATED CRIMINAL BACKGROUND CHECK MANAGEMENT SYSTEM (ABCMS) PORTAL: You stated the ABCMS training had been completed for your program; however, staff have not linked themselves to the programs yet. You shared technical assistance and guidance would be needed. I advised you to contact the criminal background check unit for further assistance. QRIS SURVEY COMPLETION REMINDER: While the new QRIS rules are not yet effective, the Division is preparing for a gradual transition to the new requirements. Doris Barrett, Administrator, assisted me with today’s visit. Your program currently operates as a Greene Lamp Early Head Start Program and a Developmental Day Program. Children were observed eating breakfast and lunch, completing hand washing routines, engaged in free choice play, outdoor play, interacting with teachers and napping. Breakfast consisted of eggs, oranges, and milk. Lunch consisted on hamburger with gravy, field beans, mashed potatoes, bread and milk. The last annual compliance visit was conducted December 18, 2023. The sanitation inspection was completed January 10, 2024, with a “Superior” classification. The last fire inspection was conducted January 11, 2024, and your facility was approved for daytime care only. The following violations were documented today. Violation Number Comment Rule 618 Diaper changing surfaces were not kept free of storage. Toys were on the diaper changing table in Space #2. 15A NCAC 18A .2819(b) 807 A safe indoor and outdoor environment was not provided for the children. Two bolts were protruding above the flush of the black barrier enclosing the surfacing around the play structure on the playground at the back of the building on the right side. A tube of sanitizer attached to keys was in a basket top of a cubby less than 5ft. in Space #5. A red picnic table was cracked exposing sharp edges on the side on playground #1 in front of the building. Tubes of toothpaste labeled “keep out of reach of children” were sitting on the sink counter below 5ft. from the finished floor in Spaces #3 and 4. An asthma inhaler was on top of the printer below 5ft. from the floor and accessible to children in Space #2. The lattice has detached from the rails on the ramp leading outside from Space #4 exposing sharp points from staples. 10A NCAC 09 .0601(a) 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. Febreze air freshener in an aerosol dispensed container was on top a cubby in Space #2. A container of white out was in a basket next to the computer in Space #3. The items were accessible to children. .2820(b) 1302 Individual applications were not on file for each child. An application was not on file for one child enrolled on August 1, 2024. 10A NCAC 09 .0801(a) 1321 Medical exam or health assessment record was not on file before or within 30 days after admission. A medical exam was not on file for one child enrolled on August 1, 2024. GS110-91(1) 1323 Each child was not immunized as per Article 6 of Chapter 130A and an immunization record was not on file before or within 30 days after admission. An immunization report was not on file for one child enrolled on August 1, 2024. 10A NCAC 09 .0302(d)(2) 1756 Enhanced staff/child ratios and group sizes were not met. You were notified the space was out of compliance with staff/child ratio after monitoring for that space was finished. You stated you were not aware the teacher had seven children. You added two children must have arrived without knowledge. You said the second teacher in that class was currently working in the kitchen. Doris Barrett, Administrator, assisted me with today’s visit. Your program currently operates as a Greene Lamp Early Head Start Program and a Developmental Day Program. You have a five-star license, earning 7 points in the education component, 6 points in the program standards component (meeting enhanced space and reduced ratios) and 1 quality point for the administrator having completed a business training course of at least 30 clock hours. There is also a restriction on the permit indicating this is a certified developmental day program. Forty-seven children were observed in care today. Children were observed eating breakfast and lunch, completing hand washing routines, engaged in free choice play, outdoor play, interacting with teachers and napping. Breakfast consisted of eggs, oranges, and milk. Lunch consisted on hamburger with gravy, field beans, mashed potatoes, bread and milk. The last annual compliance visit was conducted December 18, 2023. The sanitation inspection was completed January 10, 2024, with a “Superior” classification. The last fire inspection was conducted January 11, 2024, and your facility was approved for daytime care only. The following violations were documented today. Violation Number Comment Rule 618 Diaper changing surfaces were not kept free of storage. Toys were on the diaper changing table in Space #2. 15A NCAC 18A .2819(b) 807 A safe indoor and outdoor environment was not provided for the children. Two bolts were protruding above the flush of the black barrier enclosing the surfacing around the play structure on the playground at the back of the building on the right side. A tube of sanitizer attached to keys was in a basket top of a cubby less than 5ft. in Space #5. A red picnic table was cracked exposing sharp edges on the side on playground #1 in front of the building. Tubes of toothpaste labeled “keep out of reach of children” were sitting on the sink counter below 5ft. from the finished floor in Spaces #3 and 4. An asthma inhaler was on top of the printer below 5ft. from the floor and accessible to children in Space #2. The lattice has detached from the rails on the ramp leading outside from Space #4 exposing sharp points from staples. 10A NCAC 09 .0601(a) 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. Febreze air freshener in an aerosol dispensed container was on top a cubby in Space #2. A container of white out was in a basket next to the computer in Space #3. The items were accessible to children. .2820(b) 1302 Individual applications were not on file for each child. An application was not on file for one child enrolled on August 1, 2024. 10A NCAC 09 .0801(a) 1321 Medical exam or health assessment record was not on file before or within 30 days after admission. A medical exam was not on file for one child enrolled on August 1, 2024. GS110-91(1) 1323 Each child was not immunized as per Article 6 of Chapter 130A and an immunization record was not on file before or within 30 days after admission. An immunization report was not on file for one child enrolled on August 1, 2024. 10A NCAC 09 .0302(d)(2) 1756 Enhanced staff/child ratios and group sizes were not met. Enhanced staff/child ratio was not maintained when one teacher was providing care to seven children ranging from ages one to two years old in Space#1from 8:36am-8:44am. 10A NCAC 09 .2818 The violations documented must be corrected immediately. The center’s compliance history score was reviewed with the operator. The program’s compliance history was 95% as of November 18, 2024. STAFF/CHILD RATIO: Upon arrival a staff member left the kitchen and went around counting the number of children in each classroom. The same staff member was also observed transitioning children from one classroom to another. When I entered Space #1, one teacher was providing care to seven children ranging form ages one to two years old. You were notified the space was out of compliance with staff/child ratio after monitoring for that space was finished. You stated you were not aware the teacher had seven children. You added two children must have arrived without knowledge. You said the second teacher in that class was currently working in the kitchen. The individual observed working in the kitchen was asked to go into Space #1 and assist with care. I informed you staff/child ratio must always be maintained. I explained staff should only provide care for the number or children allowed to meet staff/child ratio. We talked about changes in staffing. You reported the program is short staffed. During nap time the teacher in Space #1 left the classroom to warm her lunch in the break area behind the office. This left one person providing care to seven children ranging from ages one to two years old. I notified you staff/child ratio must be maintained even during nap time for children under the age of three. You asked all the staff to remain in their classrooms until someone was available to release them. I suggested recruiting and hiring additional staff to ensure adequate staffing is available to provide care to the number for children enrolled and present daily. You and staff could monitor arrival times of children and make transition adjustments within compliance as needed to ensure staff/child ratio is not compromised. It was also suggested if feasible networking with local colleagues to share substitutes and part time staff. Be reminded you must always maintain compliance with all applicable child care requirement including but not limited to staff/child ratio and grouping of children. You shared the cook usually release staff for breaks; however, she was in the classroom today. I reminded you steps must be implemented to ensure staff/child ratio is always maintained even when short staffed. Research indicates that group size and staff/child ratios are strong indicators of the quality of child care. Sufficient staff should be available to provide children with supervision, frequent personal contact, meaningful learning activities, and immediate care as needed. Smaller groups and lower staff to child ratios are related to positive outcomes for children, An unannounced follow-up visit will be conducted to monitor staff/child ratio requirements. SAFE ENVIRONMENT: We talked about the potential hazards identified during the observation. It was suggested periodically conducting safety checks to identify and remove potential hazards accessible to children. Potential hazards could also be monitored during outdoor play inspections. Staff could also check their classrooms each morning prior to children arriving to ensure items such as white out, sanitizer and aerosol cans are stored appropriately. Medication (rescue medications) should be put in a space inaccessible to children at least 5ft. from the finished floor when received from a parent. The teacher stated she had just received medication from a parent. I explained to the teacher medication should always be stored in a safe space and out of reach of children. The medication was removed and placed in a higher location. HEALTH RECORDS: A health assessment and immunization report were not on file for one child enrolled on August 1, 2024. You stated the documents are retrieved by early head start and are typically sent when the child comes to the facility. You stated you would contact the office of head start and request the documentation. I recommended you and staff review the files of children when enrolled to ensure all required information is included. If it is identified information is missing, contact should be made to retrieve the documentation prior to the due dates. LICENSE FEES: Keep an eye on your inbox for the 2024 annual license fee invoice. Invoices will be emailed to the facility addresses on file by November 30, 2024. Online payments will be due by December 31, 2024. In accordance with North Carolina General Statute § 110-90(1a), licensed child care facilities are assessed an annual license fee. I also informed you that I sent an email to you on March 5, 2024, with the following information included. I also attached to that email three (3) flyers that discuss the process for testing, for lead in the water, lead in paint, and asbestos. According to the Clean Water for Us Kids website you tested your water for lead on April 7, 2024, and the analysis is complete. You have also started enrollment in the lead paint and asbestos testing. Please continue to review the Clean Water for Us Kids website for updates. The Clean Water for Carolina Kids program is expanding to the Clean Classrooms for Carolina Kids program. This is a legislatively mandated effort to address lead and asbestos hazards in North Carolina public schools, licensed child care centers, and licensed family child care homes. Participation allows facilities to meet all rule requirements for identified lead and asbestos hazards, as required by law. Rules 10A NCAC 41C .1001 through .1007 require all programs to be free of lead and asbestos hazards. RTI is coordinating all the lead in water, paint and asbestos testing and remediation.
