The allegations are as follows: There are concerns that children are not being provided with adequate supervision. Enrollment: Space #4 Staff: A. Rouse, J. Reid, K. Thompson, S. Chavez Sixteen children, two years of age enrolled; sixteen children, two years of age present One child, three years of age enrolled; zero children, three years of age present Staff/child ratio, group size, supervision, use of licensed space, space capacity, license restrictions, and the outdoor environment were monitored. Children were observed in the indoor and outdoor environment. Children in the indoor space were transitioning from indoor free play to story time. Children put learning materials away and met the teacher on the carpet to listen to a story, identifying items on the pages of the book. In the outdoor space, children moved freely about the space engaging with the portable climbing structures, balls, and ride on toys. Staff were observed moving about the space and talking with the children. Based on information provided, on April 29, 2026, a child, three years of age, was left unattended on the playground when the group transitioned into the indoor space. I interviewed the director, assistance director, and two caregivers present on the date of the alleged incident. Video footage for April 29, 2026, was reviewed. It was reported that one staff member transitioned the group from outdoor space #2, they passed through outdoor space #1, when children let go of the walking rope and began playing on in outdoor space #1. A second staff member came to assist getting children gathered at the building entrance and transitioned to the classroom. At that time, they were not aware one child was unaccounted for. It was brought to the staff’s attention at pick-up time. Video footage showed the group of six children and one staff member moving from outdoor space #2 to outdoor space #1 at 4:39 pm, at which time, children let go of the walking rope and several children began to walk around space #1, one child hides under the portable climbing structure. At 4:40 pm, a second staff member entered outdoor space #1 and assist with gathering children that were exploring the playground area. At 4:41 pm, the two staff exit the outdoor space with five children and enters the building. At 4:47 pm the staff member returns to outdoor space #1 to look for the child. At 4:49 pm another staff member located the child under the portable structure. Based on information received from interviewed staff and the video footage, the finding regarding the allegation that children were not adequality supervised at all times was confirmed. The following violation was documented. Violation Number Comment Rule 303 Children were not adequately supervised at all times. On April 29, 2026, a child, three years of age, was left unattended on outdoor space #2 for approximately eight minutes. .1801(a)(1-5) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. The violation(s) documented must be corrected immediately. On or before May 27, 2026, I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected. Please be aware any information submitted by you is considered legal documentation. If it is determined the information provided in the letter is not true, this may be considered falsification of information. An example is: Jane Doe, Administrator AAA Child Care ID # 12345678 Technical Assistance: Supervision-Active supervision is a critical factor for the health and safety of children, allowing staff to ensure a safe environment, be knowledgeable of where children are and what they are doing, and respond immediately to hazards or emergencies. Effective supervision includes knowing where children are at all times, scanning the environment, counting children, strategic positioning, and active engagement with the children, including during transitions. On April 29, 2026, a child three years of age was unattended on the playground for approximately eight minutes. You shared that you have a “Spot Check” policy in place that requires staff to do a name-to-face check, using the ProCare app, during transitioned to and from the indoor and outdoor spaces. It was shared that the policy was not followed on the date of the incident and an iPad was not with the staff in the outdoor space. Since the incident occurred, a second iPad has been purchased and is used by staff, especially when splitting the group into two to allow both staff members access to ProCare. You have counseled the staff involved in the incident on April 30, 2026, concerning supervision at all times, transitions, and reviewed the Spot Check policy. You have added additional staff to the space to assist especially during transitions. An assigned staff member does daily transition checks to ensure staff are following the Spot Check policy. Internal disciplinary actions have been taken. Today, I observer adequate supervision. Staff were observed moving about the indoor and outdoor spaces, scanning for children. The group was splint into two groups; group #1 two staff present with seven children and group #2, two staff present with nine children. When transitioning to and from the indoor and outdoor space, children held on to the walking rope. Staff completed "Spot Check"(name-to-face checks), using the iPad or cell phone, upon lining up a the exterior building door, at the gate between outdoor space #1 and #2, and once in the indoor or outdoor space. We discussed strengthening the facility’s supervision practices, including reviewing section .1801 Supervision in Child Care Centers of the child care rules with all staff and having staff to complete training on supervision and transition management. A training is offered through Southwestern Child Development Commission, www.swcdcinc.org, entitled Active Supervision Counts for Home-Based and Center-Based Facilities. Please be reminded that confirmed complaints may result in the issuance of administrative actions. A follow-up visit may be conducted in the near future to monitor compliance with child care requirements. M. Fornes, assistant director, assisted me with today’s visit. Your program currently operates a Notice of Compliance, issued 9/10/21. The center's compliance history was reviewed with the operator. The program’s compliance history was ninety three percent as of 10/3/25. The NC Secretary of State website was reviewed on 10/3/25 and Opendoor CDC, LLC was listed as current- active. The license was posted, and the restrictions were in compliance. I completed a walk-through of the facility, monitoring all indoor and outdoor spaces. Supervision and staff child ratios were observed and found to be in compliance. Children enrolled in spaces #1 and #2 received care according to their individual needs, including bottle feeding, napping, and indoor free play. Children enrolled in spaces #3 and #4 play in the outdoor learning environment with ride on toys, the sand box and portable climbing structures. Children enrolled in spaces #5 and #6 engaged in indoor free play in centers, including dramatic play, manipulatives, and blocks. Staff were observed interacting with children through conversation and play as they moved about the spaces. Files for new staff were reviewed. Fire and sanitation inspections remain current. The following violation was observed. Violation Number Comment Rule 9995 A violation was found for which there is no item number. Paint on and around the windowsills of spaces #3 and #4 had chipped and peeling paint. The is a violation of a sanitation requirement in 15A NCAC 18A .2825(a). Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Today, I observed chipped and peeling paint on the around the windowsills of spaces #3 and #4. You stated that the walls were repaired a few months ago but had begun to peel again. During the visit, you put in a workorder for repairs and moved furniture to cover the peeling paint and make it inaccessible to the children until repairs can be made. Technical assistance was provided to develop a system for classroom staff to inform administration about any safety concerns in the classroom. Additionally, staff need to do a walkthrough of the classroom spaces to check for safety concerns prior to providing care for the children. Pathways to the Stars- During the visit an overview of section .3200 of the child care rules was provided. Each of the following pathway options were discussed: Program Assessment Pathway, Classroom and Instructional Quality Pathway, and Accreditation and Head Start Pathway. Education requirements were also reviewed. Your program is currently operating with a Notice of Compliance, issued 9/10/21. At the time, you stated that the program wishes to continue to operate under the Notice of Compliance. Additional information: Outdoor Environment-Today, we discussed you adding turf to outdoor space #1. There is currently no stationary structures in this area. We discussed the requirements of surfacing for stationary equipment. For surfacing, ensure that all loose surfacing measures at least six inches in depth and is free of any grass or weeds that may affect its resiliency. During outdoor inspections be sure to check the depth of the mulch and fluff when necessary and to look out for mold, mildew, and rust on the equipment. If either of those things are observed, clean or remove them immediately. Medication- Today, you shared how you have continued to work your monitoring of medications and authorization forms. Your current process of monitoring at least monthly seems to be working well for you. Continue to monitor them, observing the expiration dates of the medications, authorization forms and that the forms are documented and completed correctly. Encourage your classroom staff to check them at least biweekly, as an extra step of checks and balances. Infant Feeding Plans- During the review of Infant Feeding Plans we discussed the documentation of what children are eating at the time and when they transition from purees to whole food. Upon enrollment, parents should document what the child is eating at the moment and notify you when there are changes. An example was given for a child that is in the middle of transitioning from purees and has only tried a selection of whole foods. For this example, we discussed listing both purees and a list of items the child is allowed to have, and later documenting when the child has fully transitioned to full table foods, that are provided by the center or the family. The center's compliance history was reviewed with the operator. The program’s compliance history was ninety five percent as of 5/16/25. The NC Secretary of State website was reviewed on 5/16/25 and Opendoor CDC, LLC was listed as current- active. We reviewed your facility contact information listed on the Division of Child Development and Early Education (DCDEE) website and the facility email address was updated. You visited each indoor and outdoor space with me. Six groups of children were observed in the indoor and outdoor environments. Children enrolled in spaces #1 received care according to individual needs including tummy time, diapering, napping and bottle feeding. Safe sleep checks were completed and recorded as required. Children throughout the facility engaged in group time, indoor and outdoor free play, and transitions. Proper diapering procedures and handwashing techniques were observed. Children enrolled in space #5 and #6 discussed camping and listed items they would need to go camping. A new shade structure has been added to outdoor space #3. Lunch was observed and consisted of chicken nuggets, corn, oranges, and milk. The following violation was documented. We discussed the training provided and the training materials used for the training. Today, we discussed creating lists of medications brought in by parents which include children’s names, types of medications, expiration dates of medications, and expiration dates of authorization forms. This will allow staff members to easily see when medications or authorization forms are about to expire so they can return them to parents or get new authorization forms within 72 hours as required. Additional Comments: New Outdoor Space-Today you shared with me that you wish to add a new outdoor space for infant children. Review rules 10A NCAC 09 .0605 and 10A NCAC 09 .1402. When you have the new area fenced off, contact me to arrange inspection and approval prior to use. R. Ashburn, Director, assisted me with today’s visit. Your program currently operates a Notice of Compliance, issued 9/10/21. The center's compliance history was reviewed with the operator. The program’s compliance history was ninety six percent as of 1/7/25. The NC Secretary of State website was reviewed on 1/7/25 and Opendoor CDC, LLC was listed as current- active. The license was posted, and the restrictions were in compliance. A walk-through of the facility was completed today, all indoor and outdoor areas were monitored. I observed children in both the indoor and outdoor learning environments and found supervision and staff/child ratios to be in compliance. Children in space #1 were receiving care according to their individual needs including bottle feeding and nap time. Children in space #2, #4, #5, and #6 were engaging in indoor free play including Legos, magnet tiles, and dramatic play materials. Teachers were observed sitting with the children engaging in play and conversation with them. Proper handwashing techniques were observed. Files for new staff were reviewed. Fire and sanitation inspections remain current. The following violation was observed. Violation Number Comment Rule 842 A drug or medication was administered without written authorization and/or instructions from a child's parent or authorized health professional. In space #3, the authorization from for one tube of Desitin Diaper Rash Cream had an expiration date of 10/9/24. 10A NCAC 09 .0803(1)(a & b) Compliance Verification: The violation was corrected during the visit. No further action is required at this time. Technical Assistance: Medication-Completing regular checks of medication and authorization forms ensures that staff are fully aware of how and when to apply medications and that expired medications are not given. Today I observed one tube of Desitin, with an authorization form that expired on 10/9/24. You shared that the parent recently brought in a new diaper rash cream, and you are waiting to bring it into the classroom until the parent signs the form. The cream and form were removed from the classroom during the visit. Conduct monthly or bi-weekly checks of medications and authorization forms to ensure the items are within date. Additional information: Bottle Labels- When food, bottles, and sippy cups are brought to the center, they must be labeled with the child’s name, the date received at the center, and the content of the container. Today there were bottles that did not have today’s date on them. Thank you for labeling them during the visit. When you are gathering bottles and food from the parent, look at the labels before putting them in the refrigerator to ensure they are properly labeled. R. Ashburn, director, assisted me with the visit. Your program currently operates with a Notice of Compliance, issued 9/10/21. The last annual compliance visit was conducted 6/21/24. The sanitation inspection was completed 4/29/24 with a “Superior” classification. The last fire inspection was conducted 7/7/23 and your facility was approved for daytime care only. The center's compliance history was reviewed with the operator. The program’s compliance history was ninety seven percent as of 6/4/24. The NC Secretary of State website was reviewed on 6/4/24and Opendoor CDC, LLC was listed as current- active. We reviewed your facility contact information listed on the Division of Child Development and Early Education (DCDEE) website and the facility mailing address was updated. You greeted me at the door and visited each indoor and outdoor space with me. Six groups of children were observed in the indoor and outdoor environments. Children enrolled in spaces #1 and #2 received care according to individual needs including tummy time, diapering, and bottle feeding. Safe sleep checks were completed and recorded as required. Children throughout the facility engaged in group time, indoor and outdoor free play, and transitions. Teachers interacted with children using calm voice tones as they talk to, redirected, and play with the children in care. Proper diapering procedures and handwashing techniques were observed. Lunch was observed and consisted of corn dogs, baked beans, apples sauce, and milk. The following violation was documented. Violation Number Comment Rule 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file. Staff employed on 10/10/22 did not have documentation of First Aid certification on file for review. .1102(c) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. The violation(s) documented must be corrected immediately. On or before 6/20/24, I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected. Children in space #4 engaged in music and movement before transitioning to outdoor free play. Children enrolled in spaces #5 and #6 participated in indoor free play activities with dramatic play materials, art materials, Legos, linking toys, and blocks. The outdoor space provided stationary and portable climbing structures, balls, playhouses, and ride on toys to encourage vigorous gross motor play. Teacher moved about the indoor and outdoor spaces, assisting children, and engaging in play and conversation with them. Files for new staff were reviewed. Fire and sanitation inspections have remain current. The following violation was observed. All staff must sign a statement acknowledging that the policy has been reviewed with them prior to caring for children and the statements must be kept on file. Today, I observed five staff files with the statement of acknowledgement dated beyond the first day of employment. You reported the staff did work in the classroom with children prior to signing the policy, but a copy of the policy was provided to the staff prior to the first day of employment. We discussed your onboarding process for new staff and you reported you will make reviewing of the Prevention of Shaken Baby and Abusive Head Trauma policy a first day priority. Ensuring all staff are aware of policies prior to providing care to children allows employees to have basic organizational information and preparation for their new role within the facility. Consultation: Problem Solving Strategies- During the visit I observed children have disagreements. The staff respond by saying “I don’t like it” and “Stop, I don’t like it when you through things,” but no redirection was given. Teachers may provide solutions for children during some of their disagreements, give better options and reinforce the classroom rules and expectations. Staff and assist children by helping them work through their issues by talking and showing empathy. In older children can involved by with coming up with a solution, teachers may ask them what they think could solve the problem, what would help them solve the problem, and what is the outcome they would like to have. You may also introduce a variety of problem-solving strategies to the class that children can focus on when a conflict arises. You may also invite Chantale Sherman, the Healthy Behavior Specialist, from Martin-Pitt Partnership for Children to work with you on helping children resolve conflicts. Additional information: Be knowledgeable of the child care laws and rules and environmental health rules; review them with your staff and assist them with understanding and implementing them to maintain compliance and keep children safe and healthy.
