During today’s visit, I observed children in the indoor learning environments. Children were participating in general personal care routines and free play activities. The caregiver was seen walking around the room engaging with children during play. I found supervision, capacity, and interactions to be in compliance. The following were also inspected during today’s visit: program requirements, equipment, furnishings, capacity, supervision, medication, medication administration, outdoor learning environments, and program records including staff records and children records. The following was cited during today’s inspection. Violation Number Comment Rule 910 Copy of each child's health assessment, including the operator's own preschool child(ren), was not on file within 30 days of enrollment. Children's health assessment was not completed by a health professional. BENSON Operation Type: Family CC Home Case Number: Visit Date: 8/7/2025 Number Present: 5 Completed Date: 8/7/2025 Age: From 0 To 6 Total Minutes: 180 Time In: 09:00 AM Time Out: 12:00 PM Time In: Time Out: List to Use: Family CC Home Type Of Visit: Temp Time Period Announced/Unannounced: Unannounced The purpose of today's unannounced visit was to monitor compliance with applicable child care requirements pertinent to the second temporary time period visit for a FCCH. This program currently operates with a temporary license effective March 19, 2025, to September 19, 2025. Upon arrival you, Danna Brown, Operator, was present. Your daughter Mariyah Spruiell was also present and assisting you with child care. According to you she was only assisting you today because she was out of school for summer break. She turned sixteen (16) on June 25, 2025. She does not have a DCDEE CBC qualifying letter on file. According to you, her required information has not been submitted to the DCDEE CBC Unit. I discussed with you that because she has not been qualified you will need to close at the end of the day and be placed on “inactive status” until your daughter receives her qualifying letter. Once she has received her qualifying letter you should submit it to me immediately. If she is qualified, then you can be placed back on “active status”. I discussed with you that while on "inactive status" no children can be present at your FCCH. All indoor and outdoor areas approved for child care were monitored during today’s visit. Upon my arrival there were five (5) children present, ranging in age from birth to six (6) years old. During the visit, children were observed engaged in free play activities. Appropriate interactions between the children and the operator were also observed. During the visit the operator contacted all parents and explained to them that they would need to pick their children up and why. I observed children being picked up by their parents and the operator telling them that she would be closed until further notice. She will contact them when she is open. At approximately 10:25 am there were no children present at the FCCH except for the operator’s one (1) year old child. The following were also monitored during the visit: supervision; capacity; CPR/FA; ITS SIDS; hazardous product storage; adequate/approved space; program records; posted license; and permit restrictions. According to your menu you served the children pancakes, apple sauce, and milk for breakfast. You do patriciate in the food program. At the completion of the visit, the Visit Summary was reviewed with you, and you were also given a computerized copy for your records. Violation Number Comment Rule 1831 A valid qualification letter was not on file and available for review at the facility. This was not on file for M. Spruiell. G.S. 110-90.2 (b) & (d) & .2703(e) .1702(b)(1) 1846 An individual over the age of 15, who resides in a family child care home or a center located in a residence on a permanent or temporary basis, or those who had their 16th birthday after the initial licensing of a family child care home; did not complete and submit required forms within five business days. M. Spruiell did not submit required information for a CBC check upon turning sixteen years old. G.S. 110-90.2 & .2703(q) The two (2) violation/s documented above must be corrected immediately. A signed and dated letter of compliance must be mailed to me by August 21, 2025, stating that all violation/s have been corrected. The letter can be emailed to me at leisa.benson@dhhs.nc.gov. If you state in the compliance letter that corrections have been made when they have not, this will be considered falsification of information. If you cannot meet the requirements by August 21, 2025, you must contact me with a purposed timeline of the corrections. In some cases, this timeline may be extended. You are required to always maintain compliance with all applicable child care rules and regulations. NC GS 110-90(4)(d) requires all child care facilities to maintain a compliance history score of at least 75% for the past eighteen (18) months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action. Violations cited during today’s visit, may negatively affect your compliance score. As of today’s, visit your compliance history is 87%. You were also given a copy of your Compliance History Assessment. Rated License: I discussed with you that I can’t process your rated license application until I receive your compliance letter documenting that all violations have been corrected. Technical Assistance: I verified that you have created an account in the ABCMS portal, but you have not created a roster. Once you receive your star rated license you will need to log into your account and create a roster to include you and all household members over the age of fifteen (15). Failure to do so could result in a violation on your next visit. I provided technical assistance on how to create your roster: I discussed with you that a certificate will be issued upon successful completion of the test. Email the certificate along with your full name, position and Facility ID to DCDEE_ABCMS_Provider@dhhs.nc.gov to get access to the portal. They will grant your access within 2 business days. This program currently operates with a temporary license effective March 19, 2025, to September 19, 2025. Upon arrival you, Danna Brown, Operator, was present. Your daughter Mariyah Spruiell was also present and assisting you with child care. According to you she was only assisting you today because she was out of school for summer break. She turned sixteen (16) on June 25, 2025. She does not have a DCDEE CBC qualifying letter on file. According to you, her required information has not been submitted to the DCDEE CBC Unit. I discussed with you that because she has not been qualified you will need to close at the end of the day and be placed on “inactive status” until your daughter receives her qualifying letter. Once she has received her qualifying letter you should submit it to me immediately. If she is qualified, then you can be placed back on “active status”. I discussed with you that while on "inactive status" no children can be present at your FCCH. All indoor and outdoor areas approved for child care were monitored during today’s visit. Upon my arrival there were five (5) children present, ranging in age from birth to six (6) years old. During the visit, children were observed engaged in free play activities. Appropriate interactions between the children and the operator were also observed. During the visit the operator contacted all parents and explained to them that they would need to pick their children up and why. I observed children being picked up by their parents and the operator telling them that she would be closed until further notice. She will contact them when she is open. At approximately 10:25 am there were no children present at the FCCH except for the operator’s one (1) year old child. The following were also monitored during the visit: supervision; capacity; CPR/FA; ITS SIDS; hazardous product storage; adequate/approved space; program records; posted license; and permit restrictions. According to your menu you served the children pancakes, apple sauce, and milk for breakfast. You do patriciate in the food program. At the completion of the visit, the Visit Summary was reviewed with you, and you were also given a computerized copy for your records. Violation Number Comment Rule 1831 A valid qualification letter was not on file and available for review at the facility. This was not on file for M. Spruiell. G.S. 110-90.2 (b) & (d) & .2703(e) .1702(b)(1) 1846 An individual over the age of 15, who resides in a family child care home or a center located in a residence on a permanent or temporary basis, or those who had their 16th birthday after the initial licensing of a family child care home; did not complete and submit required forms within five business days. M. Spruiell did not submit required information for a CBC check upon turning sixteen years old. G.S. 110-90.2 & .2703(q) The two (2) violation/s documented above must be corrected immediately. A signed and dated letter of compliance must be mailed to me by August 21, 2025, stating that all violation/s have been corrected. The letter can be emailed to me at leisa.benson@dhhs.nc.gov. If you state in the compliance letter that corrections have been made when they have not, this will be considered falsification of information. If you cannot meet the requirements by August 21, 2025, you must contact me with a purposed timeline of the corrections. In some cases, this timeline may be extended. You are required to always maintain compliance with all applicable child care rules and regulations. NC GS 110-90(4)(d) requires all child care facilities to maintain a compliance history score of at least 75% for the past eighteen (18) months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action. Violations cited during today’s visit, may negatively affect your compliance score. As of today’s, visit your compliance history is 87%. You were also given a copy of your Compliance History Assessment. Rated License: I discussed with you that I can’t process your rated license application until I receive your compliance letter documenting that all violations have been corrected. Technical Assistance: I verified that you have created an account in the ABCMS portal, but you have not created a roster. Once you receive your star rated license you will need to log into your account and create a roster to include you and all household members over the age of fifteen (15). Failure to do so could result in a violation on your next visit. I provided technical assistance on how to create your roster: I discussed with you that a certificate will be issued upon successful completion of the test. Email the certificate along with your full name, position and Facility ID to DCDEE_ABCMS_Provider@dhhs.nc.gov to get access to the portal. They will grant your access within 2 business days.
