Sandra Gunter, administrator/owner, assisted me with the visit. Currently this program operates with a Three-Star License, issued March 3, 2020, earning four in points in the education component, two points in the program component and one quality point for complying with the programmatic option. License restrictions include first shift and meets enhanced space. The last annual compliance visit was conducted April 16, 2025. The last sanitation inspection was conducted on December 18. 2025. The last fire inspection was conducted on September 22, 2025. The program compliance history was eight-nine (89) percent as of 4/16/2025 and was reviewed with Mrs. Gunter. I visited each indoor and outdoor space. Children enrolled were observed in free play in the centers, outdoor play, participating in teacher directed activities and personal care routines. Infants enrolled were observed during tummy time, personal care routines, free play and teacher directed activities. Teachers were interacting with the children and attending to their needs. Breakfast consisted of cinnamon raisin bread, blueberries and milk. The following violation was observed during the visit: Violation Number Comment Rule 542 The written feeding plan was not modified as the child's needs changed. The teacher in the space used by the infants reported that a child whose date of birth was 5/3/2025 was fed baby food from the jar but the schedule was not updated. 10 NCAC 09 .0902(a) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. The violation(s) documented must be corrected immediately. On or before March 25, 2026, I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected. Updating feeding schedules in childcare is essential for optimal growth, developmental milestones, and emotional security, as children's nutritional needs change rapidly. Regular updates ensure proper digestion, prevent over/underfeeding, foster healthy eating habits, and reduce behavioral issues caused by hunger or disruption. During this visit we discussed the QRIS Modernization Pathways to the Stars. Mrs. Gunter has decided to follow the option #2 Program Assessment for Child Care Centers and Centers Located in a Residence (CLIAR). This pathway includes the following: • Enhanced Ratio(required) and/or Enhanced Space (optional) • 50% of all Lead Teachers and 50% other educators meet 5 Star Education Standards • Family and Community Engagement Foundational Practices AND 3 additional choices • CQI Plan for Facility and Individuals • Approved curriculum for all ages served • Child Observations and assessments • Coaching/training options for administrators and lead teachers. • NCRLAP Self Study I also left copies of the Continuous Quality Improvement and Professional Development Plan, work experience form, Pathway #2 -Classroom and Instructional Quality for Child Care Centers and Centers Located in a Residence (keep those copies and continue working on completing them prior to your next visit.) You stated that you will review the approved curricula and assessment tools at a later date and decide if you are going to continue using your current curriculum or go with another option. Mrs. Gunter stated that they have already begun reviewing on the Facility CQI plan for both the center and the staff. She will also provide her staff with the link for the QRIS modernization page as well as NCRLAP so that they will familiarize themselves with the new process. I conducted a walk-through of the facility unaccompanied. During the visit, I discussed the allegations with two staff members. Limited monitoring of child care requirements occurred during today’s visit. Violation Number Comment Rule 303 Children were not adequately supervised at all times. On January 28, 2025, staff members failed to provide adequate supervision when a three-year-old child exited the facility and the fenced area unknown to staff. Also, on January 28, 2025, all staff members exited the facility after the child, leaving the children in the building unsupervised. .1801(a)(1-5) 325 Staff did not interact with children in positive ways by helping them feel welcome and comfortable, treating them with respect, listening to what they say, responding to them with acceptance and appreciation, and/or participating in activities with the children. During today's visit, the staff member caring for one-year-old children was observed consistently telling the children "no", "stop", and "sit down". .1802 451 For children under three years of age, an open area that allows freedom of movement was not available, both indoors or outdoors. During today's visit, two one-year-old children were seated in highchairs for fifty minutes and were not eating. .0510(e)(4) 807 A safe indoor and outdoor environment was not provided for the children. On January 28, 2024, staff members failed to provide a safe environment when due to their lack of supervision, a three-year-old child exited the facility and the fenced area. 10A NCAC 09 .0601(a) 904 Child was handled roughly. During today's visit, a staff member was observed roughly grabbing two one-year-old children by their faces. .1803(a)(1) 1810 There was a substantiation of child maltreatment. I reviewed the allegation with the administrator/owner, Annette Gunter and she was given the opportunity to respond. The allegations are as follows: There is a concern that the operator did not notify DCDEE of a pending charge within 5 business days. Staff/child ratio, group size, supervision, use of licensed space, space capacity, license restrictions, the license and emergency care plan were posted. Fire drills, medication administration, and storage of hazardous products were also monitored. No new staff have been employed since my last visit. I observed the indoor and outdoor spaces used by the children, A total of nineteen children were present. I observed the educators and children in the spaces used by the infants, toddlers and preschoolers in personal care routines such as handwashing and diapering and toileting and transitioning to naptime. Based on information provided on May 2, 2024, I interviewed the administrator, Annette Gunter. During my interview with her, she stated that she received charge for driving under the influence on March 23, 2023. She also stated that she wasn’t aware that she was required to inform the Division of the charge and that she also reviewed the DCDEE rulebook and did not see anything stating otherwise. She also stated that she had spoken to her lawyer who informed her that since she had not been convicted and it was only a pending charge that she may not have to notify the Criminal Background Check (CBC) unit at that time. Mrs. Gunter stated that the first contact that she received from the CBC unit was in the form of an email on May 2, 2024. She also stated that she has an upcoming court date on May 9, 2024. Although the program is licensed for transportation, Mrs. Gunter stated that the program does not provide transportation and has not since it has been in operation. Based on the above information, this allegation was substantiated. The following violation was observed during today’s visit: Violation Number Comment Rule 1802 The child care provider and/or household member who incurred pending charges, indictments, or convictions since their last qualification letter was issued by the Division, did not notify the operator of these charges within five business days or before returning to work. The operator did not notify the Division of these pending charges, indictments, or convictions within one business day of being notified by the child care provider or household member. The administrator did not notify the Division of a pending driving under the influence charge they received on 3/23/2023. I reviewed the allegation with the administrator/owner, Annette Gunter and she was given the opportunity to respond. The allegations are as follows: There is a concern that the operator did not notify DCDEE of a pending charge within 5 business days. Staff/child ratio, group size, supervision, use of licensed space, space capacity, license restrictions, the license and emergency care plan were posted. Fire drills, medication administration, and storage of hazardous products were also monitored. No new staff have been employed since my last visit. I observed the indoor and outdoor spaces used by the children, A total of nineteen children were present. I observed the educators and children in the spaces used by the infants, toddlers and preschoolers in personal care routines such as handwashing and diapering and toileting and transitioning to naptime. Based on information provided on May 2, 2024, I interviewed the administrator, Annette Gunter. During my interview with her, she stated that she received charge for driving under the influence on March 23, 2023. She also stated that she wasn’t aware that she was required to inform the Division of the charge and that she also reviewed the DCDEE rulebook and did not see anything stating otherwise. She also stated that she had spoken to her lawyer who informed her that since she had not been convicted and it was only a pending charge that she may not have to notify the Criminal Background Check (CBC) unit at that time. Mrs. Gunter stated that the first contact that she received from the CBC unit was in the form of an email on May 2, 2024. She also stated that she has an upcoming court date on May 9, 2024. Although the program is licensed for transportation, Mrs. Gunter stated that the program does not provide transportation and has not since it has been in operation. Based on the above information, this allegation was substantiated. The following violation was observed during today’s visit: Violation Number Comment Rule 1802 The child care provider and/or household member who incurred pending charges, indictments, or convictions since their last qualification letter was issued by the Division, did not notify the operator of these charges within five business days or before returning to work. The operator did not notify the Division of these pending charges, indictments, or convictions within one business day of being notified by the child care provider or household member. The administrator did not notify the Division of a pending driving under the influence charge they received on 3/23/2023. G.S. 110-90.2 & .2703(m) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. Your compliance history was ninety-seven (97) prior to today’s visit. The violation(s) documented must be corrected immediately. On or before May 23, 2024, I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected. Jennifer Brownlee, preschool educator, assisted me with the visit prior to the administrator, Sandra Gunter, arriving for the day. Currently this program operates with a Three-Star License, issued March 3, 2020, earning four in points in the education component, two points in the program component and one quality point for complying with the programmatic option of having an administrator that has at least ten years of administrative experience in licensed child care. License restrictions include first shift and meets enhanced space. The last sanitation inspection was conducted on August 16, 2023 earning a superior rating. The last fire inspection was conducted on October 4, 2023. The program compliance history was ninety-seven (97) percent as of 1/23/2024. The license was posted, and the restrictions were in compliance. A walk-through of the facility was completed today, all indoor and outdoor areas were monitored. I observed children in both the indoor and outdoor learning environments and found supervision and staff/child ratios to be in compliance. Children throughout the facility were participating in group time, free play in activity areas, transitions and personal care routines. Infants were engaged in tummy time, napping, and diapering routines. Sleep checks were completed, recorded, and maintained as required. The caregivers were interacting and meeting the developmental needs for each of the children. A staff file for one new employee was reviewed and no violations were found in that file. Lunch was observed and consisted of fish sticks, green beans and corn, applesauce, wheat bread and milk. For instance, if the weekly/monthly theme is winter, you could add materials in dramatic play to turn it into a coffee shop. You could also add camping items into the other centers. By incorporating the themes and adding materials throughout the space and into the centers, the children can experience what you want them to learn and are teaching on a deeper and more personal level. Pinterest is a great source for ideas on how to add themes. Just search topics such as winter themes in dramatic play, winter themes in the science or block areas. You can also get input from the children on what they would like to see in the space that is related to the themes. Technical assistance was also provided on working with children on conflict resolution and providing reasoning and thinking skills to work through interactions with other children. Have conversations with children on why certain behaviors may result in taking time away from certain activities. By giving them other options and opportunities with other activities you may reduce the chance of certain activities taking place. Once children begin to exhibit a disinterest in an activity that may be the time to redirect and offer them other activities to participate in. Teacher directed activities are allowed but be sure to allow the children more opportunities to express individuality in their own activities We discussed requesting Environment Rating Scale (ERS) assessments in an effort to maintain the program's star rating. Resources such as Child Care Resource and Referral and Smart Start can be valuable when preparing for the ERS. “All about ECERS-R” and the NCRLAP website (www.ncrlap.org) can also be helpful as staff prepare for the ERS. On the NCRLAP website, there are training videos, sample questions and clarifying information regarding the assessments you may find helpful. As a reminder, L. Davis does not have a current CPR/First Aid training and will need to complete it. Since they are a substitute, they will need to complete IT-SIDS training if they are to work with the infants at any time they are at the facility. I reviewed the allegations the assistant director, Susan Baker and she was given the opportunity to respond. The allegations are as follows: There are concerns of nurture and care and inappropriate interactions between a provider and a child. There are concerns of sanitation and health as it pertains to a provider vaping in the presence of children. Staff/child ratio, group size, supervision, use of licensed space, space capacity, license restriction were monitored and in compliance. The license and emergency care plan were posted. Fire drills, medication administration, and storage of hazardous products were also monitored. One new staff has been hired since the last review of staff records and that file was reviewed. Additionally, I observed the indoor and outdoor spaces used by the children. A total of sixteen children were present. I observed the educators and children in the classrooms used by the toddlers, preschoolers and school-agers participating in free play and routines such as handwashing and diapering and toileting as well as eating lunch. Based on information provided on July 20, 2023, there are concerns regarding nurture and care and inappropriate interactions between a provider and a child. I interviewed four staff individually. During each interview they stated that they have not seen any staff member interact inappropriately with any child at any time. They each stated that they follow the center’s behavior management policy when behavior concerns arise in the classrooms. They also stated that they make the director aware of any ongoing issues and follow her guidance on how to proceed. Also based on the information provided there were also concerns of sanitation and health as it pertains to a provider vaping in the presence of children. During my individual interviews with the four staff members, they each stated that they have not seen any other staff member vaping, smoking or using any substance on the premises. They also stated that no smoking is allowed on the premises and that the director ensures that they comply. During the visit, I reviewed three children’s files that represented ten percent of the children enrolled. In addition to reviewing the no smoking statements in the children’s files, I also observed the “no smoking signage” at the entrance of the building. I also reviewed the parent handbook and personnel operational policies which includes a behavior management policy, a discipline policy and a safety policy. Based on the information provided that there are concerns of nurture and care and inappropriate interactions between a provider and a child and there are concerns of sanitation and health as it pertains to a provider vaping in the presence of children, the allegations were unsubstantiated. The following violations were observed: Violation Number Comment Rule 1034 All staff, including the director, did not have an annual health questionnaire on file following the initial medical statement. One employee who began employment on 7/24/2023 did not have a health questionnaire on file. .0701(a) 1035 Child care providers, including the director, uncompensated providers, substitute providers, and volunteers did not have the required Emergency Information Form on file on or before the first day of work, which included all the required information and/or the information on the form was not updated as changes occur and at least annually. One employee who began employment on 7/24/2023 did not have an emergency information form on file. .0701(a) 1874 The Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy was not reviewed with new staff prior to providing care with children and/or a signed acknowledgement with all the required information was not maintained in the staff person's file. One employee who began employment on 7/24/2023 did not have the statement on file. .0608(d)(1-4) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent.
