Your last Annual Compliance visit was conducted on May 19, 2026. Your facility’s compliance history score prior to today’s visit was 99%. You, Carmen Swindel, Operator, assisted me with today’s visit. This facility operates with a one-star license effective January 5, 2026, with a capacity of eight children on first shift ages 0-12 years of age. The following restrictions are listed on the license: daytime care only; maximum of five preschool children at any time; and no firearms or ammunitions shall be on the premises during operating hours. I observed your License, Emergency Numbers, Emergency Medical Care Plan, tobacco free signage, and NC Summary of Law, posted as required. I used the “Annual Compliance Monitoring Visit Checklist for Family Child Care Homes” during today’s visit. Today children were adequately supervised, staff-child ratios maintained, adequate approved space used, and permit restrictions maintained during the visit. A walk-through of the indoor and outdoor spaces was completed. I observed the children participating in circle time and free choice activities indoors and outdoors. There were a variety of materials available to children. Materials and furnishings were found to be developmentally appropriate. You stated that no children currently enrolled have medications or Medical Action Plans. You stated your program does not provide transportation. Program records were monitored, including emergency drills, fire drills, monthly outdoor inspections, and incident logs. There have been two new children enrolled since the last visit. I monitored their files and the existing children’s files. I monitored your file during today’s visit. C. Swindel’s qualification letter expired February 12, 2026. This violation must be corrected within fifteen (15) days, and a copy of the qualification letter must be sent to me with the required compliance letter. I received an updated Verification of Required Information for Operator and Additional Caregivers Form. You stated that there are currently no additional caregivers or substitutes at this time. Household members were documented on the Verification Form. During today’s visit, we reviewed the Operator’s Statements of Responsibility, and I received an updated Statements of Responsibility form from you. Your signature on all forms served and will serve as verification that the information provided was accurate and complete. The following violation was observed and cited during today’s visit. The operator's health questionnaire was last completed on 1/1/2025. .1703(a)(1) 925 Signed and dated statement which attests that a copy of the discipline policy was given to and discussed with a parent/guardian of each child prior to enrollment was not on file in the home. The discipline policy was signed and dated on 8/25/2025 for a child enrolled on 8/22/2025. G.S.110-91(10); .1727(a)&(b) 930 Prior to the expiration date of the qualification letter, the child care provider did not complete and submit required forms to complete a criminal background check (a qualification letter is valid for a maximum of five years from the date of issuance). The child care provider's qualification letter expired on February 12, 2026. G.S. 110-90.2 & .2703(n) & (o) 1892 Application was not on file for each enrolled child, including his/her own preschool child(ren) who are not school-age. The application for a child enrolled on 8/22/2026 was completed on 8/25/2026. .1721(a)(3) 2031 Operator did not provide a copy of the shaken baby syndrome and abusive head trauma policy to parents at time of enrollment, and / or within fourteen days of a changes to the policy. A child enrolled on 8/22/2025 had the shaken baby syndrome and abusive head trauma policy reviewed and signed by the parent on 8/25/2025. .1726(b)&(c) Technical Assistance: • The operator’s health questionnaire must be updated annually. Today I suggested that you make a list of all expiration dates of forms and trainings and check it monthly. You corrected item #908 during today’s visit by updating the health questionnaire. • We discussed that a qualification letter must be renewed every five (5) years. Prior to the expiration date, you must complete and submit the required forms to complete a criminal background check. The shaken baby syndrome and abusive head trauma policy and discipline policy must also be reviewed with the parent/guardian of the child, and a signed acknowledgement must be obtained prior to caring for the child. Today we discussed using the Children’s File Checklist to ensure that all documentation is on file during enrollment. I provided you with a copy of this checklist during today’s visit. I marked item #s 932, 1892, and 2031 as corrected during visit as the guardian signed the documentation after enrollment. You stated that you will ensure all documentation is on file prior to allowing a child to enroll moving forward. Consultation: • Per NC General Statute 110-102, the current version of Summary of North Carolina Child Care Law should be posted in a prominent place in the facility and included in the enrollment packet to be given to parents prior to the child’s first day of attendance. The application for a child enrolled on 5/5/2025 did not include the name and phone number of the child's physician. 10A NCAC 09 .1721(a)(3)(G)(H) Technical Assistance: • When receiving enrollment paperwork from families enrolling their children, thoroughly review the application to ensure that all required information, including the name and phone number of the child's physician, is documented prior to the child’s first day of attendance. Consultation: • Bacteriologic analysis indicating that water is free of bacteria must be performed on the water used for children’s water supply every two years. Your last testing was completed on June 1, 2023. Please complete testing by the end of this month. • All health and safety trainings, including Child Maltreatment training, are due to be completed every five years. Your health and safety trainings were completed on August 5, 2020. You can access these training courses at www.dcdee.moodle.nc.gov. I printed the Health and Safety Training Record form for you today. • NEW QRIS MODERNIZATION PLAN: The new QRIS Modernization Plan known as “Pathways to Success” is being added to law which includes moving to the use of the updated Environmental Rating Scale (ERS-3 versions) for ITERS, ECERS, and FCCERS, effective February 1, 2025. DCDEE and the NC Child Care Commission will continue the rulemaking process to add the rule language to child care requirements. This process with take several months. Hold Harmless provisions have been extended. Star rated license reassessments are postponed until the QRIS rulemaking process has been completed. Star rated license assessments are still required for new child care programs. A pathway for child care programs currently accredited through the approved accrediting bodies may now move to a 3- or 5-star license if they are not already at this star level. Providers need to submit a request to their licensing consultant and provide a copy of their accreditation award/certificate for processing: Accreditation Licensure Request Form. Your last Annual Compliance visit was conducted on June 12, 2024. Your facility’s compliance history score prior to today’s visit was 96%. You, Carmen Swindel, Operator, assisted me with today’s visit. This facility operates with a three-star license effective January 8, 2018, with a capacity of eight children on first shift ages 0-12 years of age. The following restrictions are listed on the license: daytime care only; maximum of five preschool children at any time; no more than two infants under age one; and no firearms or ammunitions shall be on the premises during operating hours. I observed your Three-Star License, Emergency Numbers, Emergency Medical Care Plan, tobacco free signage, and NC Summary of Law, posted as required. I used the “Annual Compliance Monitoring Visit Checklist for Family Child Care Homes” during today’s visit. Today children were adequately supervised, staff-child ratios maintained, adequate approved space used, and permit restrictions maintained during the visit. A walk-through of the indoor and outdoor spaces was completed. I observed the children participating in circle time and free choice activities indoors and outdoors. There were a variety of materials available to children. Materials and furnishings were found to be developmentally appropriate. You stated that no children currently enrolled have medications or Medical Action Plans. You stated your program does not provide transportation. Program records were monitored, including emergency drills, fire drills, monthly outdoor inspections, and incident logs. There has been one new child enrolled since the last visit. I monitored their file and the existing children’s files. I received an updated Verification of Required Information for Operator and Additional Caregivers Form. You stated that there are currently no additional caregivers or substitutes at this time. Household members were documented on the Verification Form. During today’s visit, we reviewed the Operator’s Statements of Responsibility, and I received an updated Statements of Responsibility form from you. DCDEE and the NC Child Care Commission will continue the rulemaking process to add the rule language to child care requirements. This process with take several months.
