Your last Annual Compliance visit was conducted on October 30, 2024. Your facility’s compliance history score prior to today’s visit was 98%. You, Mozella “Denise” Lyerly, Owner and Operator, assisted me with the visit. I observed your Five-Star License, Emergency Numbers, Emergency Medical Care Plan, and NC Summary of Law posted as required. Child to staff ratios, group size, supervision, permit restrictions, and adequate and approved space were monitored. A walk-through of the indoor and outdoor spaces was completed. I observed the children participating in free choice activities indoors. You stated that no children currently enrolled have medications or Medical Action Plans. You stated your program does not provide transportation. Program records were monitored, including emergency drills, fire drills, monthly outdoor inspections, and incident logs. Criminal Background Checks, CPR and First Aid, Recognizing and Responding to Suspicions of Child Maltreatment, and ITS SIDS trainings were all valid and verified. There have been no new children enrolled since the last visit. Your signature on all forms served and will serve as verification that the information provided was accurate and complete. The following violation was observed and cited during today’s visit. Violation Number Comment Rule 801 Bacteriological analysis indicating the water is free of bacteria had not been performed on a sample of water from each well used for the children's water supply every two years. Results were not kept on file in the home. The last bacteriological analysis indicating the water is free of bacteria was completed on 4/20/2023. 10A NCAC 09 .1725(a)(1) Technical Assistance: • Bacteriological analysis indicating the water is free of bacteria must be completed every two years. You stated that you were aware that your testing needs to be completed and showed me the sample kit that you have obtained to complete the testing. You stated that you have had an issue submitting the sample due to the limited hours they are open to accept samples. Today we discussed different ways that you can schedule your sample drop off, such as closing early, or scheduling someone to drop off the sample for you. Consultation: • NEW QRIS MODERNIZATION PLAN: The new QRIS Modernization Plan known as “Pathways to Success” is being added to law which includes moving to the use of the updated Environmental Rating Scale (ERS-3 versions) for ITERS, ECERS, and FCCERS, effective February 1, 2025. DCDEE and the NC Child Care Commission will continue the rulemaking process to add the rule language to child care requirements. This process with take several months. Hold Harmless provisions have been extended. Star rated license reassessments are postponed until the QRIS rulemaking process has been completed. Star rated license assessments are still required for new child care programs. A pathway for child care programs currently accredited through the approved accrediting bodies may now move to a 3- or 5-star license if they are not already at this star level. The last annual compliance visit was conducted on January 5, 2022. This home operates with a five-star license and with an effective date of July 24, 2019. The following restrictions are listed on the license: daytime and overnight; maximum of five preschool children at any time; no more than two infants under age one and fireplace/woodstove not used during the operating hours. The 18-month compliance history is at 98%. Upon arrival, I was greeted by you, Ms. Mozzella (Ms. Denise) Lyerly. And I stated the reason for my visit. I observed the children during free choice activities indoors, hand-washing routines, eating lunch and preparing for nap time. I observed positive interactions between you and the children. I used the "Annual Compliance Monitoring Checklist for Family Child Care Homes". The outdoor play area was monitored. Outdoor inspections were monitored and complete. The emergency drill report was available for review and complies. The program files, your file and a portion of the children’s files were monitored. I completed the “VERFICIATION OF REQUIRED INFORMATION FOR OPERATOR AND ADDITIONAL CAREGIVERS” You sent me a copy of the completed “FCCH OPERATOR'S STATEMENTS OF RESPONSIBILITY” form prior to today's visit. The following violations were observed during today’s visit. Violation Number Comment Rule 1990 Infant feeding plans did not include the required information, including but not limited to the type and amount of milk, formula and food, and the frequency of feedings, and/or was not available for reference. The provider has one child 7 months old enrolled and did not have a feeding plan for this child. .1706(i) 2056 Documentation of the operator's Emergency Preparedness and Response plan was not completed and/or maintained on the template provided by the Division of Emergency Management. The provider was unable to locate the EPR plan during the visit. 10A NCAC 09 .1714(c) & .1721(e)(1) TECHNICAL ASSITANCE: -We discussed that you are required to monitor the EPR Plan annually. Add to your calendar as a reminder. Monitor it when you complete your Health Questionnaire or Professional Development Plan. Here is the link to access your EPR Plan: https://rmp.nc.gov/portal/portal.aspx#. You are also required to have a hard copy that is accessible at all times. The copy of the "How to Log On to the NC Child Care Emergency Preparedness and Response Plan" that you have will also help you to navigate through the website. -Your EPR plan needs to have the location of the Ready to Go File. A Ready to Go File means a collection of information on children, additional caregivers and the facility, to utilize, if an evacuation occurs. The file will need to include a copy of the Emergency Preparedness and Response Plan, contact information for individuals to pick-up children, each child's Application for Child Care, medication authorizations and instructions, any action plans for children with special health care needs, a list of any known food allergies of children and additional caregiver, additional caregiver contact information, Incident Report forms, an area map, and emergency telephone numbers. You have a copy of the “Ready to Go Kit Facility Checklist” developed by the NC Child Care and Safety Resource Center to use as a guide as well. -We discussed that any children that are 15 months and younger are required to have an Infant Feeding Schedule completed and updated as needed by the parent. Include this in your parent packet that you give to new families. Use the Children’s File Checklist as you receive the paperwork from families to assure that you have all the documents needed prior to the first day of enrollment. CONSULTATION: -- CC RULE .2828(b) address the Enhanced Program Standards for a Rated License and documentation of a self-study and self-assessment using the Family Child Care Rating Scale over a 3-month time period. Documentation such as an ERS book with score sheets, self-assessments and program adjustments will be reviewed by the Division as part of the rated license assessment. You will need to complete this to be eligible for two points in program standards. The ncrlap.org website is a great resource. -The summary of the law has been updated and can be found on the DCDEE website under “Provider Documents”. You will want to print it and post it and make sure to give it to any newly enrolled families. -The North Carolina child Care Resource and Referral Council (CCR&R) now has a challenging behavior helpline that staff can call and peak to a Behavior Support Advisor for advice and resources specific to the challenging behaviors in their classrooms: 1-888-600-1685 option 1. I also sent an email about this resource on April 4th. -Kimberly Cruz, Child Care Health Consultant, is a great resource. She is available for technical assistance and trainings for staff and children. She is also available to develop strategies to include and support children with special health care needs. You stated that were of this and your plan is to make the payment today. -We discussed the Rated Licensing process and the cohorts during the routine unannounced visit conducted in August 2023. The provider was unable to locate the EPR plan during the visit. 10A NCAC 09 .1714(c) & .1721(e)(1) TECHNICAL ASSITANCE: -We discussed that you are required to monitor the EPR Plan annually. Add to your calendar as a reminder. Monitor it when you complete your Health Questionnaire or Professional Development Plan. Here is the link to access your EPR Plan: https://rmp.nc.gov/portal/portal.aspx#. You are also required to have a hard copy that is accessible at all times. The copy of the "How to Log On to the NC Child Care Emergency Preparedness and Response Plan" that you have will also help you to navigate through the website. -Your EPR plan needs to have the location of the Ready to Go File. A Ready to Go File means a collection of information on children, additional caregivers and the facility, to utilize, if an evacuation occurs. The file will need to include a copy of the Emergency Preparedness and Response Plan, contact information for individuals to pick-up children, each child's Application for Child Care, medication authorizations and instructions, any action plans for children with special health care needs, a list of any known food allergies of children and additional caregiver, additional caregiver contact information, Incident Report forms, an area map, and emergency telephone numbers. You have a copy of the “Ready to Go Kit Facility Checklist” developed by the NC Child Care and Safety Resource Center to use as a guide as well. -We discussed that any children that are 15 months and younger are required to have an Infant Feeding Schedule completed and updated as needed by the parent. Include this in your parent packet that you give to new families. Use the Children’s File Checklist as you receive the paperwork from families to assure that you have all the documents needed prior to the first day of enrollment. CONSULTATION: -- CC RULE .2828(b) address the Enhanced Program Standards for a Rated License and documentation of a self-study and self-assessment using the Family Child Care Rating Scale over a 3-month time period. Documentation such as an ERS book with score sheets, self-assessments and program adjustments will be reviewed by the Division as part of the rated license assessment. You will need to complete this to be eligible for two points in program standards. The ncrlap.org website is a great resource. -The summary of the law has been updated and can be found on the DCDEE website under “Provider Documents”. You will want to print it and post it and make sure to give it to any newly enrolled families. -The North Carolina child Care Resource and Referral Council (CCR&R) now has a challenging behavior helpline that staff can call and peak to a Behavior Support Advisor for advice and resources specific to the challenging behaviors in their classrooms: 1-888-600-1685 option 1. I also sent an email about this resource on April 4th. -Kimberly Cruz, Child Care Health Consultant, is a great resource. She is available for technical assistance and trainings for staff and children. She is also available to develop strategies to include and support children with special health care needs. The last annual compliance visit was conducted on December 28, 2022. Upon arrival, I was greeted by you, Ms. Mozzella (Ms. Denise) Lyerly. And I stated the reason for my visit. The current Five-Star license effective July 24, 2019 was on the fireplace mantel located in the room used by the children. Your Family Child Care Home is licensed for eight children on first, second and third shifts 0-12 years of age. The restrictions on your license are daytime and overnight care; maximum of five preschool children at any time; fireplace/woodstove not used during operating hours and no more than two infants under age one. The last Environmental Rating Scale (ERS) was conducted on July 2, 2019. You are part of Cohort Two which means fiscal year (FY) 2034/2025 will be the preparation year for the rated license process and FY 2025/2026 will be the year the the rated license will need to completed. The 18-month compliance history prior to today’s visit was at 99%. I observed you and the children working on a puzzle together, free choice activities and reading books. I observed positive interactions between you and the children throughout today’s visit. There was one new child enrolled since my last visit and I monitored their file. I monitored the following items: supervision, staff/child ratios, CPR and First Aid, special training, criminal background checks completed, ITS-SIDS training, general safety, discipline, Emergency Medical Care Plan, storage of hazardous products, adequate/approved space, program records, posted license and restrictions met. The well water test was completed on April 20, 2023. I monitored the emergency drills and outdoor inspections and there were occurring as required. There were no violations observed during today’s visit. Violation Number Comment Rule 1828 The Family Child Care Home operator did not discuss the operational policies with parents on or before the child's first day of attendance.
