This family child care home is operating with Four (4)-Star License which was issued on November 18, 2016. The last annual compliance visit occurred on June 11, 2025. Upon arrival, I was greeted by Ms. Daniel, who invited me in and I stated the purpose of my visit. We conducted a walk-through of the facility. The indoor and outdoor areas were monitored. Attendance was taken and observations made. I observed six (6) children in the indoor learning environment. The children were observed participating in morning routines and indoor free play, having lunch and resting. A full assessment of the child care requirements was completed today. Including supervision, staff/child ratio. The license was posted and all required records were made available. I monitored the provider’s file and a sampling of children’s records. The following violations were observed, cited and technical assistance was provided. Violation Number Comment Rule 1301 Operator did not complete the required number of on-going training hours as specified in rule. **The provider and the additional care giver have not completed the required in-service training hours based on education specified in rule.** GS 110-91(11); 10A NCAC 09 .1705(b)(5) 1831 A valid qualification letter was not on file and available for review at the facility. The qualifying letter for a family member was expired. G.S. 110-90.2 (b) & (d) & .2703(e) .1702(b)(1) The above violations must be corrected immediately and a corrective action letter sent to my office on or before June 22, 2026. You, Ms. Tamela Daniel, assisted me with the visit. A potential additional caregiver, B. Johnson, was also present. This family child care home is operating with four star rated license issued on 10/30/2019. Restrictions to the license include serving no more than three infants under the age one. The home's compliance history was reviewed with the operator. The program’s compliance history was eighty eight percent (88%) as of 6/11/25. A walk-through of the facility was completed today; all indoor and outdoor areas were monitored. I observed three (3) children in the indoor learning environment and found supervision and staff/child ratios to be in compliance. The children at the facility were participating in music and free time. The caregiver was interacting and meeting the developmental needs for the children. A full assessment of the child care requirements was completed today. The last fire drill was conducted on 6/5/25. The last shelter and lock down drill were 6/4/25. The last Outdoor inspection was completed on 6/9/25. Transportation The provider has gotten a new vehicle since the last visit. Vehicle safety inspections were current; liability insurance was current. Progressive insurance valid until 6/20/25. The safety inspection is valid through 2/2026. Five violations were cited during today’s visit. Violation Number Comment Rule 911 Copy of each child's immunization record, including the operator's own preschool child(ren), was not on file. Two children's files did not have immunization records on file. GS 110-91(1); .1721(a)(2) 1101 Operator or other transportation provider did not have written permission from each child's parents or guardian to transport the child. One child did not have written permission from each child's parent to transport the child. .1723(5) 1704 Summary of the NC Child Care Law was not given to each child's parent, guardian, or full-time custodian before the child was enrolled in the home and/or signed statement was not on file. Five children's files did not have a signed statement that the summary of laws was given to them. GS 110-102 2030 Operator did not provide a written statement to parents regarding the smoking and tobacco restriction. The provider did not provide a written statement to any of the parents regarding the smoking and tobacco restriction. .1719(a)(11) 2031 Operator did not provide a copy of the shaken baby syndrome and abusive head trauma policy to parents at time of enrollment, and / or within fourteen days of a changes to the policy. Five children's files did not have a signed copy of the shaken baby policy at time of enrollment. .1726(b)&(c) The violation(s) documented must be corrected immediately. On or before 6-25-25, I must receive a written, dated, and signed compliance letter that describes accurately and in detail how and when the violations were corrected. Also, please provide information regarding how the facility will maintain compliance in the future. Please be aware that any information submitted by you is considered legal documentation. Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. If it is determined the information provided in the letter is not true, this may be considered falsification of information. The Secretary shall provide to each operator of a child care facility a summary of this Article for the parents, guardian, or full time custodian of each child receiving child care in the facility to be distributed by the operator. Operators of child care facilities shall provide a copy of the summary to each child's parent, guardian, or full time custodian before the child is enrolled in the child care facility. The child's parent, guardian, or full time custodian shall sign a statement attesting that he or she received a copy of the summary before the child's enrollment. (c)Completion of cardiopulmonary resuscitation (CPR) and First Aid training shall not be counted toward meeting annual on-going training requirements. 10A NCAC 09 .1719 REQUIREMENTS FOR A SAFE INDOOR/OUTDOOR ENVIRONMENT The operator of a family child care home (operator) shall provide a physically safe and healthy indoor and outdoor environment that meets the developmental needs of children in care, including but not limited to the following: (11) notify the parent of each child enrolled in the facility, in writing, of the smoking and tobacco restriction; 10A NCAC 09 .1103 ON-GOING TRAINING AND PROFESSIONAL DEVELOPMENT (11) notify the parent of each child enrolled in the facility, in writing, of the smoking and tobacco restriction; 10A NCAC 09 .1721 REQUIREMENTS FOR RECORDS The family child care home operator shall maintain the following health records for each enrolled child, including his or her own child(ren) who are not school-age: (1) a copy of the child's health assessment as required by G.S. 110-91(1); (2) a copy of the child's immunization record; 10A NCAC 09 .1729 ADDITIONAL CAREGIVER AND SUBSTITUTE PROVIDER QUALIFICATIONS An individual who provides care for five hours or more in a week during planned absences of the family child care home operator shall: (1) be 21 years old; (2) have a high school diploma or GED; (3) have completed a First Aid and cardiopulmonary resuscitation (CPR) course within 12 months prior to caring for children; (4) have completed a health questionnaire; (5) have proof of negative results of a tuberculosis test or screening completed within 12 months prior to the first day of providing care; (6) have submitted criminal background check forms as required in Rule .2703 of this Chapter; (7) have documentation of annual on-going training as described in Rule .1703(d) of this Section after the first year of employment; (8) have completed ITS-SIDS training, if licensed to care for infants; (9) have completed Recognizing and Responding to Suspicions of Child Maltreatment training; and (10) have documentation that the operator has reviewed the requirements found in this Chapter, including the Emergency Preparedness and Response Plan, and in G.S. Chapter 110, Article 7. While the individual provides care at a family child care home, copies of information required by Subparagraphs (1) through (10) of this Paragraph shall be on file in the home and available for review by the Division. An individual who provides care for less than five hours in a week during planned absences of the operator shall be literate and meet all requirements listed in Paragraph (a) of this Rule except the requirements for annual training and a high school diploma or GED. The operator shall conduct 16 hours of orientation with all caregivers, prior to the individual caring for children, including substitute providers, volunteers, and uncompensated providers, who are providing care. The orientation shall include an overview of the following topics, specifically focusing on the operation of the facility: (1) recognizing, responding to, and reporting child abuse, neglect, or maltreatment pursuant to G.S. 110-105.4 and G.S. 7B-301; (2) review of the home's operational policies, including the written plan of care, safe sleep policy, the transportation policy, identification of building and premises safety issues, the emergency medical care plan, and the Emergency Preparedness and Response Plan; (3) adequate supervision of children in accordance with Rule .1711(a) of this Section; (4) information regarding prevention of shaken baby syndrome, abusive head trauma, and child maltreatment; (5) prevention and control of infectious diseases, including immunization; (6) firsthand observation of the home's daily operations; (7) instruction regarding assigned duties; (8) instruction in the maintenance of a safe and healthy environment; (9) instruction in the administration of medication to children in accordance with Rule .1720(b) of this Section; (10) review of the home's purposes and goals; (11) review of G.S. 110, Article 7 and 10A NCAC 09; (12) review of Section .2800 of this Chapter if the operator has a two- through five- star license at the time of employment; (13) an explanation of the role of State and local government agencies in the regulation of child care, their impact on the operation of the center, and their availability as a resource; (14) an explanation of the individual's obligation to cooperate with representatives of State and local government agencies during visits and investigations; (15) prevention of and response to emergencies due to food and allergic reactions; and (16) review of the home's handling and storage of hazardous materials and the appropriate disposal of biocontaminants. The operator and individual providing care shall sign and date a statement that attests that this review was completed. This statement shall be kept on file in the home and available for review by the Division. An individual who provides care during unplanned absences of the operator, such as medical emergencies, shall be 18 years old and submit criminal records check forms as required in Rule .2703(j) of this Chapter. The children of an emergency caregiver shall not be counted in the licensed capacity for the first day of the emergency caregiver's service. 10A NCAC 09 .1723 TRANSPORTATION REQUIREMENTS To assure the safety of children whenever they are transported, the operator, or any other transportation provider, shall: (5) have written permission from a parent to transport his or her child and notify the parent when and where the child is to be transported, and the name of the transportation provider. Parents may give standing permission, valid for up to 12 months, for transport of children to and from the home; 10A NCAC 09 .1726 PREVENTION OF SHAKEN BABY SYNDROME AND ABUSIVE HEAD TRAUMA The operator of a family child care home licensed to care for children up to five years of age shall develop and adopt policies to assist staff in preventing shaken baby syndrome and abusive head trauma. For purposes of this Rule, "staff" includes the operator, additional caregivers, substitute providers, and uncompensated providers. The policy shall include: A copy of the policy shall be given and explained to the parents of children up to five years of age on or before the first day the child receives care at the home. The operator shall obtain the parent's signature. The acknowledgement shall contain the following and be maintained in the child's file for review by the Division: You were provided with an opportunity to ask questions regarding interpretation and implementation of all child care requirements. Child care licensing rules and regulations are established to ensure a safe and healthy environment for children in care. Therefore, it is important for you to be knowledgeable of all of the licensing requirements that apply to your program. It is your responsibility to maintain compliance with all of the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the child care law and rules. This family child care home is operating with four star rated license issued on 10/30/2019. Restrictions to the license include serving no more than three infants under the age one. The home's compliance history was reviewed with the operator. The program’s compliance history was eighty eight percent (88%) as of 6/11/25. A walk-through of the facility was completed today; all indoor and outdoor areas were monitored. I observed three (3) children in the indoor learning environment and found supervision and staff/child ratios to be in compliance. The children at the facility were participating in music and free time. The caregiver was interacting and meeting the developmental needs for the children. A full assessment of the child care requirements was completed today. The last fire drill was conducted on 6/5/25. The last shelter and lock down drill were 6/4/25. The last Outdoor inspection was completed on 6/9/25. Transportation The provider has gotten a new vehicle since the last visit. Vehicle safety inspections were current; liability insurance was current. Progressive insurance valid until 6/20/25. The safety inspection is valid through 2/2026. A walk-through of the facility was completed today; all indoor and outdoor areas were monitored. I observed three (3) children in the indoor learning environment and found supervision and staff/child ratios to be in compliance. The children at the facility were participating in music and free time. The caregiver was interacting and meeting the developmental needs for the children. A full assessment of the child care requirements was completed today. The last fire drill was conducted on 6/5/25. The last shelter and lock down drill were 6/4/25. The last Outdoor inspection was completed on 6/9/25. Transportation The provider has gotten a new vehicle since the last visit. Vehicle safety inspections were current; liability insurance was current. Progressive insurance valid until 6/20/25. The safety inspection is valid through 2/2026. A walk-through of the facility was completed today; all indoor and outdoor areas were monitored. I observed three (3) children in the indoor learning environment and found supervision and staff/child ratios to be in compliance. The children at the facility were participating in music and free time. The caregiver was interacting and meeting the developmental needs for the children. A full assessment of the child care requirements was completed today. The last fire drill was conducted on 6/5/25. The last shelter and lock down drill were 6/4/25. The last Outdoor inspection was completed on 6/9/25. Transportation The provider has gotten a new vehicle since the last visit. Vehicle safety inspections were current; liability insurance was current. Progressive insurance valid until 6/20/25. The safety inspection is valid through 2/2026. This family child care home is operating with four star rated license issued on 10/30/2019. Restrictions to the license include serving no more than three infants under the age one. The home's compliance history was reviewed with the operator. The program’s compliance history was eighty eight percent (88%) as of 6/11/25. A walk-through of the facility was completed today; all indoor and outdoor areas were monitored. I observed three (3) children in the indoor learning environment and found supervision and staff/child ratios to be in compliance. The children at the facility were participating in music and free time. The caregiver was interacting and meeting the developmental needs for the children. A full assessment of the child care requirements was completed today. The last fire drill was conducted on 6/5/25. The last shelter and lock down drill were 6/4/25. The last Outdoor inspection was completed on 6/9/25. Transportation The provider has gotten a new vehicle since the last visit. Vehicle safety inspections were current; liability insurance was current. Progressive insurance valid until 6/20/25. The safety inspection is valid through 2/2026. While the individual provides care at a family child care home, copies of information required by Subparagraphs (1) through (10) of this Paragraph shall be on file in the home and available for review by the Division. An individual who provides care for less than five hours in a week during planned absences of the operator shall be literate and meet all requirements listed in Paragraph (a) of this Rule except the requirements for annual training and a high school diploma or GED. The orientation shall include an overview of the following topics, specifically focusing on the operation of the facility: (1) recognizing, responding to, and reporting child abuse, neglect, or maltreatment pursuant to G.S. 110-105.4 and G.S. 7B-301; (2) review of the home's operational policies, including the written plan of care, safe sleep policy, the transportation policy, identification of building and premises safety issues, the emergency medical care plan, and the Emergency Preparedness and Response Plan; (3) adequate supervision of children in accordance with Rule .1711(a) of this Section; (4) information regarding prevention of shaken baby syndrome, abusive head trauma, and child maltreatment; (5) prevention and control of infectious diseases, including immunization; (6) firsthand observation of the home's daily operations; (7) instruction regarding assigned duties; (8) instruction in the maintenance of a safe and healthy environment; (9) instruction in the administration of medication to children in accordance with Rule .1720(b) of this Section; (10) review of the home's purposes and goals; (11) review of G.S. 110, Article 7 and 10A NCAC 09; (12) review of Section .2800 of this Chapter if the operator has a two- through five- star license at the time of employment; (13) an explanation of the role of State and local government agencies in the regulation of child care, their impact on the operation of the center, and their availability as a resource; (14) an explanation of the individual's obligation to cooperate with representatives of State and local government agencies during visits and investigations; (15) prevention of and response to emergencies due to food and allergic reactions; and (16) review of the home's handling and storage of hazardous materials and the appropriate disposal of biocontaminants. The operator and individual providing care shall sign and date a statement that attests that this review was completed. This statement shall be kept on file in the home and available for review by the Division. An individual who provides care during unplanned absences of the operator, such as medical emergencies, shall be 18 years old and submit criminal records check forms as required in Rule .2703(j) of this Chapter. For each child being transported the operator did not have identifying information. .1723(13) 1306 Operator has not completed ITS-SIDS training every three years from the completion date of the previous ITS-SIDS training. The additional care givers ITS-SIDS expired 3/15/25. .1703(a)(4) 1997 Vehicle used for transportation did not have a fire extinguisher. The Emergency Preparedness and Response Plan means a written plan that addresses how a child care facility will respond to both natural and man-made disasters, such as fire, tornado, flood, power failures, chemical spills, bomb threats, earthquakes, blizzards, nuclear disaster, or a dangerous person in the vicinity, to ensure the safety and protection of the children and additional caregivers. This Plan shall be on a template provided by the Division available at https://rmp.nc.gov/portal/# completed within four months of completion of the Emergency Preparedness and Response in Child Care training, and available for review. 10A NCAC 09 .1718 REQUIREMENTS FOR DAILY OPERATIONS The family child care home operator (operator or operators) shall provide the following on a daily basis for all children in care: A written activity plan that shall: Include activities intended to stimulate the following developmental domains, in accordance with North Carolina Foundations for Early Learning and Development, available on the Division's website at https://www.ncchildcare.ncdhhs.gov//pdf_forms/nc_foundations.pdf: emotional and social development; health and physical development; approaches to play and learning; language development and communication; and cognitive development. You were provided with an opportunity to ask questions regarding interpretation and implementation of all child care requirements. Child care licensing rules and regulations are established to ensure a safe and healthy environment for children in care. Therefore, it is important for you to be knowledgeable of all of the licensing requirements that apply to your program. Upon arrival, I was invited in by the provider, Tamala Daniel, who was caring for 6 children with the additional caregiver, Rudean Thomas. She is Ms. Daniel’s mother. Children were having an outdoor time on the balcony playing with the toys and materials. There were play equipment set up on the balcony as well as in the playground. . I conducted a walk-through of the indoor and outdoor learning areas. I observed the children playing outside, eating lunch, and resting. I reviewed program records, staff and children’s files. This program does not administer medication as a policy. Transportation requirements were also monitored. Ms. Daniel stated she transports only the school age children during the school year. She is approved to transport children provided you have the parent’s permission and the children’s emergency and identifying information on the vehicle. I observed the following violations.
